Planning Board Meeting Minutes
Tuesday, March 10, 2009

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, March 10, 2009 at 8:00pm.

Members Present:        Ed Nolan, Chairman
Bill Gorlin, Member

                        David Turiano, Building Inspector
                        Sarah Yackel, Planning Consultant

Call to Order: Chairman Nolan called the meeting to order at 8:00pm.  

PB-13-2005 PAC WATER CORP- SUBDIVISION: The Planning Board held a public hearing for an application for an expired conservation subdivision for a 26 acre property located on Cedar Drive East and Long Hill Road East.  Final conservation subdivision plat approval for the premises was dated October 9, 2007 and expired one year thereafter.

Upon motion by Member Murray, seconded by Member Lotter, the Board voted unanimously to open the public hearing.  

Village Attorney Pozin stated it wasn’t an extension because it was expired.  He stated the applicant was back for a re-approval.  

Mr. Jim Ryan, Consultant for the Applicant, stated there were no changes in the plan and it was now fully compliant.  

Upon motion by Member Gorlin, seconded by Member Lotter, the Board voted unanimously to close the public hearing.  

Upon motion by Member Gorlin, seconded by Member Lotter, the Board voted unanimously to approve the application.  

PB-2-2009- JOSEPH FERREIRA - VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL):  The Planning Board reviewed an application for a steep slopes permit to construct a new single family dwelling.  The property is located at 77 Brookwood Drive.

Mr. Joseph Paiva, Architect for the Applicant, explained the application.  He stated they designed the house to be integrated with the existing slopes and the drawings were reviewed by the Village’s Consultant.  

Village Engineer Turiano stated the proposed house would be fully zoning compliant, it met the required setbacks and it didn’t need a MTPP.  

Member Gorlin requested the other homes in the area be shown on the drawing.  

The Board had general discussion about the proximity to the Old Croton Aqueduct.  

Member Gorlin requested the details of the retaining wall.  

Mr. Paiva stated it would be a stone wall.  

Member Lotter asked for an explanation of the site’s drainage plan.  

The Board tabled the application to the next month and requested details for the retaining wall, the proximity to the Aqueduct and that the surrounding homes be placed on the drawings.  

Chairman Nolan requested a draft resolution be started.  

MINUTES

Upon motion by Member Lotter, seconded by Member Gorlin, the Board voted unanimously to approve the minutes of February 10, 2009 as amended.  

VILLAGE ENGINEER’S REPORT

  • Former Building Inspector Anthony Turiano passed away.  He was the Building Inspector for 1955 to 1993.  It is a great loss to the Village.  
  • Sewer work is taking place on Scarborough road.  
  • Sidewalk work and guiderail work will start shortly.  
  • Work will resume on the Village Pocket Park.  
  • The full water supply project will go out to bid in the spring.  
Member Lotter congratulated the Village on the reopening of the newly expanded Library and Community Center.  

ADJOURNMENT

Upon motion by Member Gorlin, seconded by Member Murray, the Board voted unanimously to adjourn the meeting at 8:40pm.
