Planning Board Meeting Minutes
Tuesday April 8, 2008

A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Municipal Building on Tuesday, April 8, 2008 at 8:00pm.

Call to Order: Chairman Tung called the meeting to order at 8:00pm.  He thanked Jay Teitelbaum for his service and welcomed Ed Nolan as the new regular member and Robert Murray as the new alternate member.  

PB-1-2008-PUBLIC HEARING THE CLUB AT BRIARCLIFF MANOR AMENDED SITE PLAN, WETLAND, STEEP SLOPE REVIEW (CLASSIC RESIDENCE BY HYATT):  The Planning Board held a public hearing on an application from Briarcliff Manor Investors LLC (BMI) for an amendment to the site plan approval previously granted for a Continuing Care Retirement Community containing a total of 385 living units and support facilities on this site. The Planning Board also sought input in connection with the Planning Board’s review of the application under the State Environmental Quality Review Act (SEQRA).  The property is located at Scarborough Road, Lodge Road, and Central Drive and was formerly owned by The Kings College.

Member Gorlin recused himself from this application.  Upon motion by Member Lotter, seconded by Member Neveloff, the Board voted to reopen the public hearing.  

Mr. William Null of Cuddy and Feder explained the application and new materials submitted on behalf of the Applicant.  

Mr. John Sullivan, the architect for the Applicant, explained the Lower Village town homes and stand alone residences.  
Ms. Michelle Lee of Sullivan Architecture described the architecture and square footage of the Lower Village buildings.  

Member Neveloff asked the dimensions of the attic storage areas.  

Ms. Lee stated she would verify the information for the next meeting.  

Mr. Rich Rosen of Perkins Eastman discussed the upper building.  

Chairman Tung asked if there were any significant changes from the earlier plans.  

Mr. Null stated they were still designing the parking, the cell tower tree and the proposed location for the tennis courts.  He stated they would submit a full package of what they showed.  He asked at what point they should go before the ARAC.  

Following Board discussion, Chairman Tung stated the Board would refer them to the ARAC, who should be presented with a full package of architectural drawings and information.  

Ms. Susan Jainchil stated she had begun a draft SEQRA findings statement based on AKRF’s earlier review memos and would update it when the Applicant’s submission was complete.  

Chairman Tung stated he would like to see a drawing of the parking structure and other areas, and the monopole, for the next meeting.  

Member Neveloff stated he liked the layout and the design but would like the Villas to be decreased in size a bit.  

Upon motion by Member Neveloff, seconded by Member Nolan, the Board voted to adjourn the Public Hearing to the May 13, 2008 meeting.  

PB-2-2008 – MANOR HOLDING CORP (1159-1175 PLEASANTVILLE ROAD) SITE PLAN APPROVAL: The Planning Board reviewed an application to approve a site plan to construct a retaining wall, re-grade and re-pave the existing parking area.  The property is located at 1159-1175 Pleasantville Road and is developed with an existing multi-tenant building.  

Mr. Bill Lochnauer from Hudson Engineering explained the application, noting that trees had been added adjacent to the improved parking area.  

Mr. Joe Weldon, owner of the property, stated he would say no to a cross access easement currently but it wasn’t a closed issue.  

Member Neveloff asked Mr. Weldon to speak to the Village Attorney about what had been done in the past.  He stated he would be against the application without a cross access easement.  

Chairman Tung stated the Board was looking toward the future and the cross access easement was the first step for a more vibrant business district.  

Member Neveloff asked Village Attorney Pozin to forward copies of other easements to Mr. Weldon.  

PB-08-2008- MARGARET MCGARRITY - VILLAGE CODE CHAPTER 220-15, PROTECTION OF NATURAL RESOURCES REVIEW (STEEP SLOPES APPROVAL):  The Planning Board reviewed an application for a steep slopes permit for an addition to an existing single family dwelling.  The property is located at 2 Valentine Road.

Mr. Bill Sharman, the architect for the Applicant, explained the application.  

Village Engineer Turiano stated the steep slopes map was last updated in the 1970’s and it didn’t accurately reflect the property’s slope.  

Upon motion by Member Neveloff, seconded by Member Nolan, the Board voted unanimously to approve the application.  

VILLAGE ENGINEER’S REPORT: by Village Engineer Turiano
·       The capital budget process was underway
·       Drainage projects were continuing

Member Neveloff stated the access onto Route 9A going north off of Pleasantville Road was in disrepair.  

ADJOURNMENT

Upon motion by Member Gorlin, the Board voted unanimously to adjourn the meeting at 9:20pm.
