Planning Board Meeting Minutes
Tuesday November 13, 2007
A regular meeting of the Planning Board of the Village of Briarcliff Manor, 1111 Pleasantville Road, Briarcliff Manor, New York 10510, was held in the Village Hall on Tuesday, November 13, 2007 at 8:00pm.

Call to Order: Chairman Tung called the meeting to order at 8:00pm.
Prior to beginning the published agenda, Chairman Tung stated that the Board had received correspondence relating to the Old Sleepy Hollow Estates application requesting adjournment to the December Meeting. This was the third such request in as many months.
Village Attorney Pozin stated that the public hearing for this application had been held and closed, and that although the applicant had extended the time for the Board to act with each request for adjournment, it was in the best interests of all parties to move the application forward. He stated the Board could encourage the applicant to attend the next meeting by advising it in writing that the Board could deem the application abandoned if not further processed at that time.
Member Lotter asked if it was deemed abandoned, could the applicant bring it before the Board again.
Village Attorney Pozin stated they could come back with the same or a different project and either way it would be deemed a new application.
Upon motion by Member Lotter, seconded by Member Teitelbaum, the Board voted unanimously to draft a letter to the applicant advising it that the Board could deem the application abandoned if it was not further processed at the December 2007 meeting.
PB-15-2006- PUBLIC HEARING - THE CLEARVIEW SCHOOL, SUBDIVISION APPROVAL:
Upon motion by Member Teitelbaum, seconded by Member Gorlin, the Board voted unanimously to open the public hearing.
Upon motion by Member Teitelbaum, seconded by Member Gorlin, the Board voted unanimously to adjourn the public hearing to December 11, 2007.
PB-12-2007- ST. THERESA’S CATHOLIC CHURCH – AMENDED SITE PLAN AMENDMENT AND SPECIAL USE PERMIT AMENDMENT RECOMMENDATION: St. Theresa’s Catholic Church filed an application for an amendment to its Special Use Permit with the Board of Trustees and an application for a related site plan amendment with the Planning Board. The Board of Trustees referred the Special Use Permit application to the Planning Board for review and recommendation. The work includes a new pathway, lighting and stairway between the church and the school and associated regrading of property. The property is located at 1394 Pleasantville Road. The pathway and lighting work had already been completed, as was the clearing and some excavation for the stairway.
Mr. Andrew Saunders explained the application of behalf of the Church.
The Board had general discussion relating to the application.
Member Gorlin requested a No Parking sign be installed on the downhill side of Central Drive after the curve, south of the proposed stairway.
Village Engineer Turiano stated he would review the suggested sign and restriction with the Village DPW.
Member Teitelbaum asked if they could approve the application with conditions so the children didn’t have to walk in the street.
Member Gorlin asked that the original staircase be demolished and cleaned up.
Chairman Tung asked that the slopes adjoining the stairway be re-vegetated.
Member Lotter stated she had a concern about the children walking on the grass between the stairs and the asphalt walkway. She asked if the stairway could be used to take care of the grading issue and if a path could be built to provide an alternative to walking on the grass between the stair and the church entrance.
Member Teitelbaum stated it didn’t have to be asphalt. It could be crushed stone or another material that worked well.
Mr. Saunders stated they would alter the drawings and would like permission to get started while the weather was cooperative.
Member Teitelbaum requested a night time site inspection for the lighting wattage.
Member Gorlin recommended making the top stair landing sufficiently long (perhaps 1 ft. longer than shown) in order to accommodate the possible future addition of a code compliant sidewalk along the street.
Chairman Tung noted the applicant agreed to time and day limitations on the lighting. He stated with the conditions discussed, the Board could make a positive recommendation to the Board of Trustees.
Upon motion by Member Gorlin, seconded by Member Teitelbaum, the Board voted unanimously to approve the application with the following conditions and if necessary make a SEQRA determination:
1. The Church shall be required to re-vegetate and landscape all areas disturbed by the proposed site improvements, including the area of the abandoned staircase and the sloped area located just west of Central Drive disturbed by grading activities.
2. The hours of the walkway lighting shall be limited to between 5:00 pm and 10:00 pm Monday through Friday and the walkway lighting shall not be utilized on weekends.
3. The appropriate wattage of the walkway lighting fixtures shall be determined by the Village Building Inspector based on a nighttime site inspection.
4. A connecting walkway be provided between the bottom of the new stairs and the north entry walk to the church building.
PB-13-2007- BARRY AND LINDA SCHWARTZ, SUBDIVISION APPROVAL: The Planning Board reviewed an application to subdivide 3.6 acres into two (2) residential building lots and construct one (1) new dwelling. The property is located at 140 Central Drive and located in the R20B Zoning District.
Mr. Ralph Mastromonaco explained the application on behalf of the applicant.
The Board had general discussion relating to the application. They requested additional information including lot lines, topographic detail, adjoining lots, proposed sewer trenching, trees to be removed and zoning information. They further requested that a slope map, a wetland map, and the aerial photograph presented at the meeting be submitted as part of the application. The Board also requested sight lines of the existing and proposed driveways.
Chairman Tung suggested the applicant meet with the Village Engineer and Planning Consultant to review the requested information for completeness.
PB-14-2007- 139 SCARBOROUGH ROAD – TREE PLANTING PLAN: The Planning Board reviewed an application for a Tree Planting Plan as required by Chapter 220 – 9B of the Code of the Village of Briarcliff Manor for property located at 139 Scarborough Road.
Mr. Paul Jankovitz explained the proposed MTPP on behalf of the applicant.
Chairman Tung stated it was his understanding that the intent of the provision in the law was to soften the view of applicable proposed houses or additions from surrounding locations. He further stated the law allowed the Board discretion in applying the MTPP, dependent on the specific conditions of the proposed building and site and the need for such supplemental landscaping. He stated that this property and the area of the proposed addition was wooded and well screened from neighboring properties and the applicant shouldn’t have to spend money unnecessarily. He stated he’d personally be happy to approve the plan as shown, but would also entertain approving the plan in part or waiving it all together.
Mr. Jankovitz requested a waiver of the tree planting requirement on behalf of the applicant.
Upon motion by Member Lotter, seconded by Member Teitelbaum, the Board voted unanimously in favor to waive the tree planting requirements of Chapter 220-9B based on the location and nature of the proposed building addition and the existing vegetation on the site.
PB-15-2007 – EAST HILL CABINETRY – SIGN PERMIT APPROVAL: The Planning Board reviewed an application for a sign permit. Property located at 127 Woodside Avenue.
Mr. Steve Chester of Signs Inc. explained the application.
Chairman Tung requested future applications reference the Pantone number of any proposed colors, or a specific manufacturer’s paint chip.
Upon motion by Member Gorlin, seconded by Member Teitelbaum, the Board voted unanimously to approve the application.
VILLAGE ENGINEER’S REPORT
§ The Kings College Property will submit in January to amend their site plan.
§ A draft SSES for Ossining sewer districts was received. The Village’s sewer law was very antiquated and the County recommended it be reviewed.
§ Assistant Village Manager Richards gave birth to a baby girl Ivana Grace on November 1, 2007.

Upon motion by Member Teitelbaum, seconded by Member Gorlin, the Board voted unanimously to adjourn the meeting at 10:05pm.
