Mr. Filsinger called the meeting to order at 7:00 p.m.
Mr. Filsinger made a motion to approve the April 25, 2011 Meeting Minutes as amended; Mr. Wyatt seconded the motion. All in favor; none opposed; motion approved.
Michael Holyoak, 18 Boulder Way (Application for a Variance) – Mr. Filsinger opened the hearing. Mr. Holyoak presented the revised plan. The “right of way” was added, and the “10 wide” removed. Mr. Holyoak said the reason Connorstone Engineering was reluctant to remove the wording previously was due to the fact that they were defining the road. All issues have been addressed to the satisfaction of the board. Mr. Filsinger made a motion to close the Public Hearing; Mr. Wyatt seconded the motion. All in favor; none opposed; motion approved Mr. Filsinger made a motion to grant the requested variances as shown on the revised plan submitted 5/3/2011 pursuant to the following findings by the board:
a.The Board finds that there are special conditions affecting the land or buildings involved but not affecting generally the Zoning District in which such land or buildings are located due to the small size and irregular shape of the lot would cause an odd shaped building envelope while meeting the 10 foot pond buffer required by the Conservation Commission.
b.The Board finds that a literal enforcement of the provisions of the Zoning Bylaw would involve substantial hardship, financial or otherwise to the Petitioner for the following reason that due to the shape and size of the lot, the petitioner would be unable to take full advantage of the sites best building location.
c.The Board finds that desirable relief may be granted without substantial detriment to the public good for the following reason that the distances to the lot lines would be similar to those of the previous house.
d.The Board finds that desirable relief may be granted without nullifying or substantially derogating from the intent and purpose of the Boylston Zoning Bylaw for the following reason that the proposed house is consistent with other houses in the neighborhood which are also built on small lots.
Mr. Wyatt seconded. A roll call vote was taken as follows: Arlene Murphy, Yes; Rob Cotter, Yes; Bill Filsinger Yes; Bradford Wyatt, Yes; Stephen Longton, Yes; motion carried.
Timothy Hess, DSA (Dewing & Schmid Architects) was in attendance to ask guidance from the board on how the application process works. His client is proposing to create a wildlife sanctuary on Linden Street (previous Jameson Ridge property). They plan to make it as green and sustainable as possible, and are in the early stages of development. He spoke with Tony Zahariadis (Building Inspector) who thought he should check with the ZBA because there will be two primary use buildings on the property (educational and residential) which may require a special permit. Mr. Filsinger felt this was more of a Planning Board issue rather than Zoning. Mr. Hess will contact the Planning Board.
