Planning Board Minutes 12/06/2010

The meeting was called to order at 7:30 p.m.

Mr. Manter made a motion to approve the November 1, 2010 Meeting Minutes; Ms. Levy seconded the motion.  All in favor; none opposed; motion approved.

James Venincasa (Signature Homes Communities) ANR Plan (Frontage Lot on Route 70) – John Grenier was present for Signature Homes.  He stated that the lot is located at the rear of the Compass Pointe subdivision (beyond Spruce Pond dam) with frontage on Main Street (Route 70).  After discussion, Mr. Baker suggested the following findings:  the application refers to the “Plan of Land in Boylston, Massachusetts on Main Street” dated December 3, 2010; the landowner is Michael J. Vennencasa; the plan shows two lots, both with 150’ or more of frontage on Main Street, and both with greater than 30,000 square feet of area.  Ms. Levy motioned to accept the findings, approve the ANR plan, and authorize the Clerk to endorse; Ms. Hucknall seconded.  All in favor, none opposed; motion carried.

Review Draft Decision for Clear Wireless LLC – The draft decision, modified from that used for a prior application, was reviewed by the members for content/changes before the public hearing.  

Special Permit Application – Public Hearing (Clear Wireless LLC) – Eric Kallio was present representing Clear Wireless.  He stated they intend to install three antenna panels on the existing, abandoned AT&T antenna platform on the monopole located at 326 Shrewsbury Street.  Minimal changes will be made and there will be no increase to tower height.  Mr. Baker asked why the appearance of the antenna platforms looked different in the illustrations.  Mr. Kallio explained that they have an ice shield to protect the tower.  Mr. Kallio also explained that Clear Wireless is a broadband service with several other coverage areas in the Boston market.  Mr. Manter made a motion to close the Public Hearing, Ms. Levy seconded.  All in favor; none opposed.  Mr. Baker read the proposed conditions and noted minor corrections to be made to the proposed draft.  Mr. Manter made a motion to approve the permit, issue the decision as discussed, and authorize Mr. Baker to sign; Ms. Levy seconded.  A roll call vote was taken:  Mr. Manter – Yes; Ms. Levy – Yes; Ms. Hucknall – Yes; Mr. Baker – Yes; Ms. Ames – Yes.

Stiles Crossing Follow-Up – Mr. Manter visited the site on Sunday December 5th (see file notes).  He felt it would be advantageous for the members to visit the site to view the retaining wall now that it is visible.  Members agreed that the bulge in the retaining wall should be inspected and the wall certified by a structural engineer before the road can be accepted.  Mr. Baker reported his conversations with Mike Andrade (Graves Engineering).  Mr. Andrade contacted Ricciardi Brothers who said the work for the bonding company has been completed, and the retaining wall was not part of the contract.  It was a condition of the subdivision approval that the wall be structurally certified.  Mr. Andrade will contact the design engineer and report back to Mr. Baker.  Payment for a structural engineer was discussed.  Currently there is $711.00 remaining in the account for inspections.  A site visit report was received today from Graves which has not yet been invoiced.  In addition, there will be a final inspection report that will have to be paid.  Town funds cannot be used.  It will be the contractor’s (Venincasa) responsibility.  The homeowners will need to work it out with Mr. Venincasa.  

Mr. Baker stated that he had been contacted by a resident concerning the acceptance of the road.  He advised her to go before the Board of Selectmen to voice her concerns and, after speaking with the neighbors, schedule and attend the next Planning Board meeting (January 3, 2011) to discuss the progress.
