Mr. Baker called the meeting to order at 7:30 p.m.
Approval of December Minutes - Ms. Hucknall made a motion to approve the December minutes, Ms. Ames 2nd the motion; all in favor. Minutes approved, Mr. Duffy abstained from voting.
John Farnsworth – School Street – ANR - Present was Mr. Farnsworth, Land Surveyor with DeFalco Engineering Service on behalf of Mr. John Brown of 419 School Street Boylston, Ma.
Mr. Farnsworth presented an ANR application to convey a portion of Mr. Brown’s property over to the Sportsmen’s Club and to move a lot line to make Mr. Brown’s property less nonconforming. The garage is currently 5 feet from the property line.
Mr. Duffy asked when the house was built, Mr. Farnsworth was not sure, and he stated at least 20 years ago.
In order to endorse the plan, Mr. Duffy asked that the wording “Except as to lot frontage and area” be deleted from the plan. He then proposed the following findings:
The plan of land located in the Town of Boylston, MA., prepared for John Brown at 419 School Street, Boylston, MA.
The plan is located in the rural residential district, which required 200 feet of frontage and 40,000 sq. feet of area. Plan shows a pre-existing nonconforming lot to which is to be added 2487 sq. feet making it less nonconforming;
The remaining property is not to be considered a build able lot. The parcel is to be only joined with the other lots owned by Boylston Sportsman Club.
Ms. Hucknall made a motion to accept the findings, approve the plan, and authorize the Clerk, Mr. Duffy, to endorse. Mr. Duffy 2nd the motion; all in favor, motion carries. Mr. Farnsworth will arrange with Mr. Duffy to have the corrected plan endorsed.
Woodland Heights Surety Release - Michael Mennagio provided the Planning Board with a copy of an Affidavit from Town Counsel stating that Rachel Road has been accepted as a public way. Woodland Heights is an extension of Sylvan Lane. Mr. Mennegio requests release of all remaining surety.
Mr. Baker discussed the open items which were the cleaning of the catch basins, street sweeping and detention basins. Mr. Mennagio signed an agreement with Don Parker that would make him responsible for the completion of these items. Street light were also to be installed.
In order to release the bond Mr. Duffy would like a letter from Don Parker confirming that the work has been completed.
Mr. Baker will contact the Light Board and Don Parker.
Rt 140 Zoning Change (Fuller Property) - Mr. and Mrs. Robert Fuller submitted a petition to the Selectman’s office to list the zoning change on the warrant for the town meeting in May.
Mr. Fuller would like a property, across from his current temporary storage lot on Rt. 140, re-zoned industrial and new dimensional requirement added for the allowed “sale and rental of recreational vehicles”.
Mr. Duffy stated his concern that the parcel may have wetlands. Applicant must address that issue as well as neighbor concerns at the required public hearing.
The Board agreed that no action will be taken with regards to the zoning change at this time. Mr. Baker will follow up with the Selectman’s office.
Subdivision changes - The Board reviewed the Subdivision Rules and outstanding issues.
