PUBLIC MEETING – YMCA (Camp Harrington), 320 Sewall Street – Request for Determination of Applicability seeking a determination that the mapped perennial stream Sewall Brook, located in the central portion of the property, is an intermittent stream upstream from the culvert located proximate to the camp store.
Paul McManus (EcoTec) and Stephan Lockney were in attendance. Mr. McManus submitted photo documentation of no flow conditions as required by CMR 10.58(2)d. Mark Coakley said there was case that was adjudicated approximately ten years ago in an attempt to do the same thing. There was a finding that it was a perennial stream because of the downstream. There is drawdown on Morningdale well 1. There is not enough information submitted to make a decision on tonight; more research and verification is needed. It was suggested Mr. McManus contact Jay Billing at Northeast Geoscience. Mr. Billings was in approximately five years ago and at that time detected a drawdown. Teresa Prunier (Boylston Water District) said it is relatively dry during the summer and there was a drawdown on the
well. She agreed that Mr. McManus should contact Jay Billings for more information. The applicant requested a continuance. M. Coakley motioned to accept the request for continuance; C. Burkhardt seconded; all in favor; motion approved. It will be on the December 16th Agenda at 7:00 p.m.
MICHAEL TROTTO (Worcester Sand & Gravel) – Mr. Trotto said he received the commission’s letter late due to his hospitalization. He said he enlisted Thompson-Liston Associates to do the required filing. The commission will verify this in the morning. Safety on the cuts was discussed. While Mr. Trotto said he would cut the edge, he was instructed not to do that since the Earth Removal Board issued a Cease and Desist. He was told he could put up temporary fencing and/or signs.
MICHAEL MAY – Before discussing the Route 140 update, Mr. May commended the work and effort Joe McGrath put into the presentation for the Mt. Pisgah grant (Tri Town Landscape Protection Partnership). He said the Select Board felt the state funds would be used to move land into tax status. He also said they felt pressured to act and would be walking into a problem. Mr. May said he did not want to send negative information to the commission and that there was not an unwillingness to support it, but said it was the wrong request at the wrong time. He said the Banner article had some inaccuracies. Mark Coakley said the Selectmen had no pre- and post-tax analysis in their decision. Mr. May said they didn’t have the luxury of doing that because they had a short time
line. He also said there was a question on lack of control and that SVT could pass off the management of the land. The Board of Selectmen has a discomfort with tax pilot programs; lack of definition. Mark Coakley said it was a non-binding, no strings attached grant. Mr. May said it could come back before the board if they can see utilization of the land.
Route 140 – The objective is to develop the land. There are approximately 400+ acres in Boylston and 200 in Shrewsbury. The Business Marketing Committee has met with Shrewsbury and will follow-up. Wayne Belec will provide three mark-ups for the property at no cost to the town. A comprehensive plan will be written. The BMC needs representatives from the Planning Board, Board of Health and Conservation for input on the major issues (water, sewer, septic traffic). Meetings are held the last Wednesday of the month. Mr. May will forward the Route 140 power point presentation to the commission along with the BMC meeting minutes.

Mark Coakley made a motion to approve the October 21, 2013 Meeting Minutes; Charlene Franz seconded; all agreed; motion approved.
Longley Hill Update – Notification will be sent to the Building Inspector not to issue any more Building Permits to Mr. Ansari. No progress has been made. He will be invited to attend the December meeting.
A copy of the October 21st Meeting Minutes will be sent to Mr. Noury (115 Shrewsbury Street – converting the heating system from oil to gas).
Newton Pond Update – A confirmation letter from Weston & Sampson was received. This is not what the commission requested. The Town of Shrewsbury is not recognizing that we issued an Enforcement Order. It does not answer our questions. This letter will not be accepted as closure of the project. Tabled until December.
The annual water test letter from Cyprian Keys was received. Chip will review the file to see if they need to continue testing.
Compass Pointe – Notification will be sent to the Building Inspector not to issue any more Building Permits to Mr. Venincasa. The catch basins are not in. He will be invited to attend the December meeting.
An email with photos was received from David & Lauri Esposito (2 Compass Circle). Chip will follow-up.
Consider issuing a partial Certificate of Compliance to DEP #115-98 (Lot 32, 46 Adams Street) part of Mt. Pleasant Estates – Mark Coakley made a motion to issue a partial Certificate of Compliance; Chip Burkhardt seconded; all agreed; motion approved.
Consider issuing a Certificate of Compliance to DEP #115-335 (18 Boulder Way) Michael Holyoak (Amended Order of Conditions) – A site visit is needed before rendering a decision.
Sewall Pond – Chip met with Maryann DiPinto. She was happy with what she observed. She asked the status on the association for the pond. Don Hoffses mentioned the septic systems and was told he should go to the Board of Health. Teresa Prunier said there is beaver activity and most neighbors have damage and said it is up to DEP to do something. The whole composition of the pond has changed. An email with photos was received from Don Hoffses today.
A motion was made at 8:30 p.m. to adjourn by Mark Coakley; seconded by Chip Burkhardt, and passed unanimously.
