PUBLIC HEARING (continued) – James Goulet, 383 Sewall Street – Notice of Intent and Stormwater Control Permit Application to create a 6-lot low impact development residential subdivision and associated drainage improvements.
Wayne Belec (Project Manager) said the plan was reconfigured. It will include five houses instead of the proposed six. The hydrology calculations have been revised to include impervious surfaces and lawn areas for six house lots (leaving one future ANR lot). The culvert pipe will now be 12” instead of the proposed 6”. As a result of the drainage concerns raised by the Bedards, the basin has been redesigned to include an area of coarse sand which will extend from the ground surface to sandy parent material below. The July 12, 2013 comment letter from Graves Engineering was addressed and discussed as well as the July 15, 2013 letter from Waterman Design Associates, Inc. requesting waivers from the 75’ setback from the property line, vegetation, and fencing. Joe McGrath
said it could be difficult to grant the waiver not knowing the house locations. Mr. Belec said Lot 1 will no longer have a drywell. Lots 4 and 5 will require an additional filing with the Commission. Members did not have any issues with the waiver for fencing. Chip Burkhardt made a motion to close the Public Hearing; Joe McGrath seconded. Chip Burkhardt made a motion to issue a standard Order of Conditions, adding Special Conditions #33 stating that a copy of the O&M plan is to be provided to the Commission prior to the commencement of construction activities, and #35 stating that Lots 4 and 5 shall require an additional filing under the Wetlands Protection Act; Joe McGrath seconded; all agreed; motion approved.
Joe McGrath made a motion to approve the applicant’s two requests per the July 15, 2013 letter from Waterman Design Associates, Inc., which was then withdrawn in order to refine the permit. To be included as Special Conditions on the Stormwater Permit will be #21 – the Commission grants a waiver to the 75’ right of way offset requirement in the applicant’s July 15, 2013 letter to the Commission from Waterman Design Associates, Inc., for infiltration basin #100 only, #22 – the Commission grants a waiver to the vegetative screening requirement requested in the applicant’s July 15, 2013 letter to the Commission from Waterman Design Associates, Inc., for infiltration basin #100 only, and #23 – the Commission grants a waiver to Article VI, §9.7.I.4.e requested in the
applicant’s July 15, 2013 letter to the Commission from Waterman Design Associates, Inc. Joe McGrath made a motion to issue a Stormwater Permit to include the three Special Conditions as previously discussed; Chip Burkhardt seconded the motion; all agreed; motion approved.
PUBLIC MEETING – Matthew Partridge, 266B Main Street – Request for Determination of Applicability to install a natural gas line.
The Commission viewed the property with Google earth. Mr. Partridge said NStar will be installing a natural gas line. Mark Coakley made a motion to issue a Negative Determination by Reason#1; Chip Burkhardt seconded; all agreed; motion approved.

Mark Coakley made a motion to issue a Certificate of Compliance; Chip Burkhardt seconded the motion; all agreed; motion approved. The Certificate of Occupancy was then signed by the Chairman.

TLPP Program Update – Joe said the Telegram & Gazette and the MetroWest News both ran articles on the project. The representatives in addition to Joe are Mia McDonald (Northborough Conservation Agent), and Walter Bickford (Berlin Conservation Commission). There is a minimum requirement of 500 acres to obtain a grant which would pay for surveys. He said there are ten lots in town he would like the town to turn over. He will be attending a Selectmen’s meeting in August to discuss town owned property.
126 Nicholas Avenue, Barbara Dennis (yard under water) – Ms. Dennis said her yard is under water. She said that back on July 4th there was a huge runoff and the water ran like it should. Now what was once grass is now wetlands and the stream is filled with silt. Mark Coakley said there was beaver activity. Bill Cazaropoul (102 Nicholas Ave) said Mr. Buxton keeps building dams and today saw a man-made dam. Chip Burkhardt said permits are absolutely needed to remove or create dams with the Army Corps of Engineers, dam safety, etc. He also said that Mr. Buxton’s property line is the middle of the brook, and we don’t know that anybody has done anything wrong; there are no filings with the commission, and there is beaver work. Ms. Dennis said she has
significant ponding on her property. Sue and Bill Hudson (120 Nicholas Ave), who purchased their home in March, said they also ponding. Ms. Dennis said when she purchased her home in 2006 it was mowable and walkable; now it is permanently flooded. She said on July 7th it flowed and receded at an amazing rate. She further said in 2011 the water came up and never went down. She requested to see the photos referred to in the November 21, 2011 Meeting Minutes. Theresa Prunier (25 Coderre Road) said she has been on all the properties, has seen the work Mr. Buxton has done, has seen the beaver activity, and said they are looking for help. Mark said the file would be reviewed again and a site visit conducted. Joe said we should hire an engineer to look at it. Ms. Prunier said there is definitely a beaver problem and it would be nice if DEP would put in pipes and beaver traps. Mark asked if any septics were impacted. Ms. Prunier said hers is moved back. Mr. Buxton will be asked
for permission to go on his property. Joe also suggested, as a resident, that they notify the Board of Selectmen and DPW.
