Conservation Meeting Minutes 03/19/2012

ROBERT FULLER – Public Hearing – Stormwater Control Permit Application (150 Shrewsbury Street – Map 9, Lot 14).  Fill in land to road height.

Robert and Sheri Fuller were present. Green cards were submitted.  Plans were presented for review.  The ad fee has not been paid.  Mr. Fuller stated that the site is up the hill on personal property.  He would like to fill in the low spots with fill mostly on the Route 140 side.  The objective is to be able to accept free fill when the opportunity presents itself.  He said he is working with Don Parker and John Desautels.  The pipe to be used is 15”.  After lengthy discussions, the members determined there is not enough information presented to act upon tonight.  Questions from the engineer to be addressed are (1) is the pipe adequately sized for  a 25 year storm,  (2) hydrology calculations and model (using a sketch or map) should be included for assumption purposes, (3) need to know what they modeled is accurate, and (4) what is the capacity of the new pipe.  The Fuller’s were informed that this work is jurisdictional to the Stormwater Control Bylaw (local).  They were reminded that should they do work between the 50’ and 100’ buffer zone, it would be jurisdictional to the Wetlands Protection Act (state) and they would need to file a Notice of Intent.  They will need to bring in a revised plan showing the boundary lines and silt fence outside the 100’ buffer zone.  The audience was asked if they had any questions.

Bruce Symonds (429 School Street) was concerned with ledge and blasting.  Chip explained to him that they are before us for the Stormwater Control Bylaw.
Bob Mecca (379 School Street) had questions about the filing.  Chip explained to him that the Commission’s purpose is to administer the state regulations as well as town (local) bylaws.  He further explained that tonight the Commission is acting upon the local bylaw, which is allowable, and the Commission wants to make sure it is it done the right way.

Irene Symonds (429 School Street) asked about blasting.  She was told that is not jurisdictional to the Commission.  The Fire Department handles that.

Another resident asked if the flow would be towards Cross Street.  He was told the work proposed is on the School Street side.

The applicant requested a continuance.  Joe McGrath made a motion to accept the request for continuance; Mark Coakley seconded; all agreed.  It will be on the Tuesday, April 17th Agenda at 7:00 p.m.

EXXON MOBIL ENVIRONMENTAL SERVICES – Public Meeting – Request for Determination of Applicability (295 & 332 Shrewsbury Street).  Shrewsbury Street waterline tie-in project.

Magdalena Lofstedt (CDM) was present representing the applicant.  She is a professional wetland scientist and has delineated the wetlands.  The trench will be 1’-2’ wide.  There will not be any blasting; it will be chipped.  The service connections will be enclosed in a protective sleeve.  There will not be any interruption in service.  Joe McGrath made a motion to close the Public Meeting; Mark Coakley seconded; all agreed.  Chip Burkhardt made a motion to issue a Negative Determination by Reason #3, adding that a copy of the bound Request for Determination of Applicability be maintained onsite during work; Joe McGrath seconded; all agreed.

COMMISSION BUSINESS

Vouchers were approved.

Joe McGrath made a motion to approve the Meeting Minutes dated February 27, 2012; Chip Burkhardt seconded; Mark Coakley, Joe McGrath and Chip Burkhardt agreed; Jeff Walsh abstained from voting.

Tuesday, April 17th was confirmed as the date for the next meeting.

Chip made a motion to adjourn; Jeff seconded; unanimously approved.  The meeting was adjourned at 8:00 p.m.
