Conservation Meeting Minutes 12/19/2011

Signature Homes Communities, LLC – PUBLIC HEARING – Notice of Intent – Main Street Lot 49 (Map 7, Parcel 51) Construct a duplex and perform site grading in the buffer zone to a bordering vegetated wetland and red maple shrub swamp.  

Glenn Krevosky was present for Signature Homes Communities.  He said he was not directed to replace the flags and that it was Mr. Venincasa and John Grenier who put up the wetland flags.  Commission members visited the site and found remnants of old flags.  Mr. Krevosky apologized to the Commission and expressed his frustration with his client whom he told him repeatedly what needed to be done before this meeting.  There is also an abandoned concrete well that needs to be marked.  Test pits were not shown on the plan.  Mr. Krevosky again apologized and said he only received the plan by email this afternoon.  For the next meeting the Commission will require the following:  flag from 3G to 8G, identify and label test pits on the plan, indicate location of well, and stake the front corners of the lot.  The applicant asked for a continuance.  M. Coakley made a motion to accept the request for continuance; J. McGrath seconded; all agreed.  It will be on the January 17, 2012 Agenda at 7PM.

Pleasant Hill Farms – PUBLIC MEETING – Request for Determination of Applicability – 22 Pleasant Lane (Lot 42R) Construct a single family home.  (Mark Coakley recused himself from the matter)

James Tetreault (Thompson-Liston) and Mr. Vogel were in attendance.  It was suggested they file due to a resident complaint.  The closest vernal pool is located by lot 3.  There are no vernal pools associated with this lot.  Series E and F were determined to be federal jurisdictional wetlands.  They continue to put up hay bales and are looking for a negative determination.  Mr. Vogel stated that before a lot is cleared, they contact Thompson-Liston to be sure it is executed properly.  As a resident, Mark Coakley asked about the calculations.  He also said it was a wildlife habitat and asked if the Commission could possibly limit the scope of work for future construction.  J. McGrath made a motion to close the Public Meeting; C. Franz seconded; all agreed.  J. McGrath made a motion to issue a Negative Determination by reason #4; J. Walsh seconded; all agreed.  

COMMISSION BUSINESS

Vouchers were approved.

M. Coakley made a motion to approve the Meeting Minutes dated November 21, 2011; C. Franz seconded; C. Burkhardt & J. McGrath agreed; J. Walsh abstained from voting.

Review Cyprian Keys Annual Water Test Results – Jeff Walsh will follow up.

Sewall Pond/Brook Activity – Photos were received from Mr. Buxton showing activity taking place during the day and night.  If more photos are received, an Enforcement Order will need to be issued.

Sherry Fuller (Order of Conditions DEP#115-350, Shrewsbury Street) – The Fullers are looking to increase the amount of fill they can use to road height because they have an opportunity to acquire free fill.  J. Walsh told them that if they are disturbing an acre or more of disturbance, it would fall under our local stormwater bylaw rather than the wetlands regulations.  Plans will need to be prepared identifying the wetlands and erosion control measures that will be used to stabilize the site until completion.  It was also explained to them that an additional filing may be required if work is within the buffer zone and that the plans will need to be prepared by a professional engineer.  It was suggested that it would beneficial to do both filings at once to have all permits in place in the event they sell the property.  

Compass Pointe Email requesting Bond Reduction – The Commission will not entertain any bond reduction since the site is not stable.  No grates or catch basins have been installed as yet.  An email will be sent to the Planning Board recommending they not reduce the bond due to the negative impact on the sediment control and the fact that grates and catch basins have not be installed.  

Consider issuing a Certificate of Compliance to John & Paula Peterson for DEP#115-348 (21 French Drive) – J. Walsh visited the site and said there is loam, but no growth and recommends not issuing a Certificate of Compliance until after growth is in.  A letter will be sent to the Petersons.

Consider issuing a Certificate of Compliance to David & Paula Markle for DEP#115-170 (Lot 2A Stiles Road; now 6 Juniper Hill Drive) and DEP#115-175 (Lot 4A Stiles Road; now 6 Juniper Hill Drive) – C. Burkhardt will write a letter to the Attorney.

Consider issuing a Certificate of Compliance to James Vogel for DEP#115-300 (Lot 57 – 156 Green Street)- – J. Walsh made a motion to issue complete certification; C. Franz seconded; all agreed.

Chuck Jasiak – 730 Main Street (parking area installed in the riverfront area without proper permitting) – Mr. Jasiak was asked to attend after Chip Burkhardt noticed a fence and gravel driveway improvements without filing with the Commission.  Mr. Jasiak was before the Commission on June 15, 2009 after removing top soil and wanting to put down crushed gravel.  At that time he was told that the area is jurisdictional because it is in a riverfront area and was instructed to put up hay bales and loam and seed the area.  He was told at that time he would need to file with the Commission if he intended to do any work.  Mr. Jasiak takes full responsibility for the fence, but had no knowledge it was being installed.  He said he followed the building inspector’s instructions (he did not know his name).  He further said the building inspector walked the site with him and told him where to put the dirt.  He thought he was complying with the building inspector and the town’s request.  He additionally said the building inspector thanked him for doing it the right way.  Mr. Jasiak was told he needed to file a Notice of Intent showing all the work and would need to hire a consultant.  A progress report is required for the next meeting.  Mr. Jasiak was informed that he could be issued a cease and desist, Enforcement Order and/or be required to restore the area back to the original condition if he is not in compliance.

Mark Coakley made a motion to adjourn; Charlene Franz seconded; unanimously approved.  The meeting was adjourned at 9:30 p.m.
