Conservation Meeting Minutes 11/21/2011

Shrewsbury Homes – PUBLIC MEETING – Request for Determination of Applicability – ANR lot division (199 Sewall Street)

Scott Goddard (Goddard Consulting) and Mr. Aspero were present.  The proposed project is to divide the ANR lot into three separate lots.  Lot 2 will contain the existing dwelling.  All work is located outside of the 100’ buffer and 200’ riverfront area.  Mark Coakley asked if any area would require hay bales.  Mr. Aspero stated that it is all gravel.  The total area of disturbance is less than one acre.  Mark said Lot 3 should have a limit of work since they owners may want to put in a lawn in the future.  Mr. Aspero did say that he is currently working with someone who will eventually want to do more work on the lot but is well aware that he would need to come before the commission.  Mr. Aspero agreed to install three monuments at the perimeter of the buffer zone to the BVW and on Lot 3.  M. Coakley made a motion to issue a Negative Determination by reason #4; C. Burkhardt seconded; all agreed.

Sandy Hartwell (144 Shrewsbury Street) – Discuss CEA possibly working near the wetland on the R.F. Desmarais property.  Ms. Hartwell cancelled.

Signature Homes Communities, LLC – PUBLIC HEARING – Notice of Intent – Main Street Lot 49 (Map 7, Parcel 51) Construct a duplex and perform site grading in the buffer zone to a bordering vegetated wetland and red maple shrub swamp.  

Glenn Krevosky was present for Signature Homes Communities.  The proposed altered area is under 10% (8.4%).  The septic system has the 25’ setback and is over 100’ from the wetlands, but they have not yet received Board of Health approval.  M. Coakley asked how he arrived at the buffer zone delineation and was told by Mr. Krevosky that the Commission agreed upon it under a previous filing in August 2010.  It was part of the same property and was split.   There was an ANRAD on the project.  Mark would like the methodology of flagging revisited.  Once the flags are in place, the Commission will conduct a site visit.  The applicant asked for a continuance.  M. Coakley made a motion to accept the request for continuance; C. Franz seconded; all agreed.  It will be on the December 19th Agenda at 7PM.

COMMISSION BUSINESS

Vouchers were approved.

M. Coakley made a motion to approve the Meeting Minutes dated October 17, 2011; C. Franz seconded; all agreed.

Consider issuing a Certificate of Compliance to David & Paula Markle for DEP#115-170 (Lot 2A Stiles Road; now 6 Juniper Hill Drive) – Because there is no as-built plan, it cannot be determined whether it was built to plan.  The attorney will be contacted and will need to provide an as-built and/or verification that it was in compliance with the Order issued.  Melanie will check with the Building Department first to see if they have an as-built.

Consider issuing a Certificate of Compliance to David & Paula Markle for DEP#115-175 (Lot 4A Stiles Road; now 6 Juniper Hill Drive) – Same as above.

Mt. Pleasant complaint from Jana Johnson, 24 Pleasant Lane (possible violation of wetlands) – The Commission feels the site is jurisdictional.  Mr. Vogel will be asked to attend a meeting before they apply for a building permit.

Jasiak Dance School, 730 Main Street (parking area installed in the riverfront area without proper permitting) – Chip Burkhardt said they removed grass, put down gravel, and put up a fence.  Mr. Jasiak came before the Commission on June 15, 2009 and was told the area is jurisdictional because it is within the 200’ riverfront area.  He was informed at that time that if he intends to proceed, he would need to file a Notice of Intent.  He will be asked to attend the December 19th meeting.

Stiles Crossing (Don Parker said Mr. Venincasa was pumping silt-laden water into the stormwater basin) – Mr. Venincasa should have contacted the Homeowner’s Association.  The Commission will thank Don Parker for bringing it to our attention and we will keep an eye on it.

Mr. Buxton brought in a memory stick containing photos of happenings at Sewall Pond/Brook.  Melanie will email to the members tomorrow.  Mr. Buxton said work is continuing on the dam and debris is now being thrown into the stream.  M. Coakley asked if he contacted the police and he said no.  He asked what could be done and was told that after viewing the photos, depending on the situation, an Enforcement Order could possibly be issued.

Chip Burkhardt made a motion to adjourn; Mark Coakley seconded; unanimously approved.  The meeting was adjourned at 8:30 p.m.
