Bethlehem Bible Church (Public Hearing) – Notice of Intent continued - After-the-fact tree removal in the buffer zone (School Street).
Scott Goddard was present, along with James Ricciardi (owner). Paul McManus (EcoTec, Inc.) completed a field review of the property and recommended some changes in his letter dated September 15, 2011. Mr. Goddard agreed with the recommendations and revised the flags accordingly. The bank was not specifically delineated. Mr. Goddard stated that all that remains to do is remove the logs and take the machines offsite. He also said the site is thriving and should re-vegetate in one year. He is asking the Commission to lift the Enforcement Order issued to Mr. Ricciardi in March and to confirm the BVW delineation. The Commission had no further issues and there were no comments from the audience. Jeff Walsh made a motion to lift the Enforcement Order issued to Mr. Ricciardi on
March 8, 2011 for School Street, across from Boylston Auto Body; Joe McGrath seconded; all agreed. Joe McGrath made a motion to close the Public Hearing; Jeff Walsh seconded; all agreed. Jeff made a motion to issue a standard Order of Conditions, adding Special Conditions #35) an undelineated bank within the noted BVW must have additional delineation completed prior to any additional work beyond this Order; 36) remaining felled logs near School Street entrance to be removed; and 37) delineation of BVW on site is confirmed; no other resource areas are confirmed. Joe McGrath seconded; all agreed.
First Realty Management – Timberbrook Follow-Up
Roger Goldman (Timberbrook) and Susan Renaud (First Realty) were in attendance. They were asked to come in because of a violation that the Commission became aware of on Lot 34 (#14 Timberbrook). Chip Burkhart visited the site and found that grass clipping were being dumped within 200’ of the Malagasco Brook. Mr. Goldman approached the residents about putting up a chain, but they were not in favor of that. The Commission advised him that if he chooses to put up a fence, to put reflective tape on it to warn ATV riders. Mr. Goldman did put up no trespassing/no dumping signage. The issue is to clear out the debris and prevent it from happening in the future. They were told it needs to be removed and not spread out. The Commission is willing to work with them by drafting a
letter to the residents informing them that it is not acceptable to dump grass clippings there and cite the regulations. Melanie will obtain the list of residents for Clearview, Underwood and Fairacre along with lots 21, 22, & 23. Chip will draft the letter. Mr. Goldman and Ms. Renaud were asked to contact the Commission when the area is cleaned out so the Members can look at it.
James Venincasa – Stiles Crossing Update
Glenn Krevosky (EBT Environmental) and Mr. Venincasa were present. Mr. Burkhardt explained that Don Parker contacted the Commission about unstable soil that was running into the stormwater basin. Chip visited the site and found that the silt fence was put in, but was inadequate, and there were no hay bales. Mr. Krevosky stated that after the storm, he double staked hay bales and installed silt fence. Mr. Venincasa was asked the time frame for stabilization. He said he plans to pour the foundation within two weeks. He said he also plans to hydro seed. He was reminded that he is still subject to the Erosion & Sediment Control Permit. Chip, along with other Members, expressed their disappointment that this continues to happen on this particular lot. Mr. Venincasa was
again reminded that he needs to stabilize the lot before beginning work. Mr. Krevosky told the Commission that he will visit the site after any significant rain.
COMMISSION BUSINESS
Vouchers were approved.
Jeff Walsh made a motion to approve the Meeting Minutes dated August 15, 2011; Joe McGrath seconded; all agreed.
Sewall Pond/Sewall Brook Follow-Up – Dick Buxton and Dave Kalinowski were in attendance. There is a site visit scheduled for Friday, September 23rd with Mary Ann Dipinto (DEP). Ms. Dipinto will attend the October meeting. It is still uncertain why the problems are occurring now. The Commission will have more information at the next meeting. It was noted that a permit is needed to work on the dam. The Commission would prefer the parties work it out themselves and will not get involved in a civil matter.
Mike and Patricia May (603 Cross Street) – Agricultural Use – Responding to the email received from Mark Coakley regarding the May property changing their use to agricultural, it would fall under the Stormwater Regulations, not the Wetlands Regulations.
Consider issuing a Partial Certificate of Compliance for 52 Columbus Road, DEP #115-98 (part of Mt. Pleasant Estates) – This was approved via email to accommodate an expedited closing.
Chip Burkhardt made a motion to adjourn; Jeff Walsh seconded; unanimously approved. The meeting was adjourned at 9:00 p.m.
