Bethlehem Bible Church (Public Hearing) – Notice of Intent - After-the-fact tree removal in the buffer zone (School Street)
Scott Goddard was present. He stated that the property is still owned by Mr. Ricciardi, but still under agreement with the church. Mr. Ricciardi had agreed to remove the trees, but it has not happened yet. Mr. Goddard said the wetlands were delineated and surveyed. Partial delineation was completed under an ANRAD in November 2010. He said he would like to take a nothing approach after the trees are removed. The Members felt that leaving the site as is may not be the best approach and would like it peer reviewed. Mark Coakley made a motion to engage EcoTec to conduct the peer review. The scope of the work will include confirming the boundaries and assessing the current vegetation and recommendations of the applicant. A request was made by the applicant to continue the
hearing. Mark made a motion to accept the request for continuance; Joe McGrath seconded the motion; all agreed. It will be on the September 19th agenda at 7PM. Mark will contact EcoTec. Mr. Goddard will submit $1,500 for peer review. Paul Aucoin (120 Nicholas Ave) noted that drainage goes into Sewall Pond.
Barbara Dennis (Public Meeting) – Request for Determination of Applicability - Demolish and construct new garage (126 Nicholas Avenue)
Gary Burroughs (contractor for Barbara Dennis) was present, along with Ms. Dennis and Mr. Hoffses. They provided a plan showing erosion control measures as requested by the Commission. Mark made a motion to issue a Negative Determination by reason #3; Jeff Walsh seconded the motion; all agreed. They were instructed to call the office and building inspector when it is staked and hay bales are in place.

Mark made a motion to accept the Meeting Minutes dated July 18, 2011 with changes noted; Jeff seconded; all agreed.
Jeff Walsh was appointed the representative for the Earth Removal Board and Joe McGrath and Chip Burkhardt the representatives for the Stormwater Committee.
Tahanto Building Project Peer Review Funds – Chip will be asked for the outcome.
Stiles Crossing – Don Parker provided photos of the site taken on August 10th showing the water runoff. Chip will be reminded that letters need to be sent to the homeowners informing them of the partial certificate of compliance, along with notifying Signature Homes that erosion control is needed on Lot 25R.
Sewall Pond/Sewall Brook Site Visit by Joe McGrath – Joe went over his site visit report for the audience and Members. Since the July 27th report there have been more complaints. Paul Aucoin (120 Nicholas Ave) came to speak to the Commission. He requested and was given copies of the site report visit, along with a copy of the letter received from Karen Stanton and Dave Kalinowski. He became overexcited asking for the previous months’ minutes. He was told they were not yet approved and that the board was taking this matter out of agenda order as a courtesy but that he could be asked to wait for the commission business to be completed before discussions take place. Joe McGrath said he did not know if it was a dam because the water was flowing. Jeff Walsh said
more action needs to be taken to be sure it is jurisdictional to the commission. At the last meeting, the water was down and the residents were told to contact the office if the problem continued. The commission thought the issue was resolved. Mr. Hoffses said it had been breached again and the water went down again. The water continues to go up and down. He said there is beaver activity. Mark Coakley suggested a site visit. Joe McGrath suggested possibly having a specialist attend, to which Mr. Aucoin was adamant that if that was done, he would complain to the taxpayers. He continued on to say he lived there longer than anyone else and how the stream ran. Richard Buxton (133 Mill Road) said silt goes under Mill Road. He said he did construct something, but it was ripped out. Additionally he said the pond goes down between 4AM-7AM. Joe said there may be something upstream causing the impact. He is
concerned with the health of the pond and said it is not healthy for the water. A site visit was scheduled for Friday, August 19th at 6:30 p.m. Findings will be reported at the next meeting. The audience was told that Mr. Buxton gave his permission for the Members to enter his property and it is private property, therefore you would need to be invited by him to attend.
Mark Coakley made a motion to adjourn; Jeff Walsh seconded; unanimously approved. The meeting was adjourned at 8:15 p.m.
