James Ricciardi – INFORMAL DISCUSSION – Status update on Enforcement Order issued March 8, 2011

Mr. Ricciardi was present to discuss the status report on the School Street Enforcement Order.  He was asking for an extension of time to complete the work required because he is in negotiations with Bethlehem Bible Church to sell the property.  He said a gravel ramp is needed for access to clear out the trees which could be completed in one month.  The logs will be removed by winching.  The Commission is concerned with restoration.  Scott Goddard (Bethlehem Bible Church) was also present.  He delineated the wetlands previously.  He said at this time, the church does not know where they want it.  He will further assess the property.  Mark Coakley told them to provide the Commission with detailed plan or a letter indicating what is to be done.  They were requested to come before the Commission in July for another update.

Nouria Energy Corporation – PUBLIC MEETING – Request for Determination of Applicability – Redevelop the former Mobil Gas Station site (328 Shrewsbury Street)

Jeff Walsh recused himself from the matter.  Courtney Rheault (Graves Engineering) and Tom Healey (Nouria Energy) were present.  The parcel is .625 acres.  They propose to redevelop the former Mobil station with a gas station and convenience store.  The building will be further back.  The previous tank area was filled with stone.  Silt fencing and hay bales are proposed.  There was question whether it meets the Stormwater Control Bylaw.  Joe McGrath was concerned with groundwater since there are sites where the water flows into.  Mr. Healey stated that the fueling islands will be contained and they will have speedi-dri on site and the canopy will prevent rain from falling directly on it.  The canopy runoff will go into a filtration system.  They also propose a sediment bag at the first catch basin which is approximately 340’ away.  The existing septic system will be used.  It was determined that what they are proposing will not affect the wetlands.  J. McGrath motioned to close the Pubic Meeting; C. Burkhardt seconded; all agreed.  M. Coakley motioned to issue a Negative Determination of Applicability by reason #3; C. Burkhardt seconded; all agreed.

Donald LeBlanc – PUBLIC MEETING – Request for Determination of Applicability – Repair/replace garage (126 Nicholas Avenue)

Mr. LeBlanc was present.  He proposes to replace the garage.  There is a stream that runs through the yard.  The existing footprint will be used.  The foundation is not being replaced.  Cement blocks will be used to keep it off the ground.  Mr. LeBlanc said he was advised by the building inspector to come to the Commission for input.  He was also told that if work is to be done on the foundation, he will need to file a Notice of Intent.  C. Burkhardt motioned to close the Public Meeting; M. Coakley seconded; all agreed.  C. Burkhardt motioned to issue a Negative Determination by reason #2; M. Coakley seconded; all agreed.  

Michael Foley – PUBLIC MEETING – Request for Determination of Applicability – Install pool (1 Pleasant Lane)

Mr. Foley was in attendance.  He would like to install a salt pool and submitted photos for the Commission to view.  It is in the buffer zone and it is a jurisdictional wetland.  The pipe that goes through his property is owned by the Homeowner’s Association.  After discussions, it was decided that a Determination could be issued with the following conditions:  (1) discharge from the pool must not be into the wetland or stormwater management system, (2) plan must be submitted showing the line of work and erosion and sediment controls prior to the start of work, (3) drainage line must be shown on the as-built plan complete with the detail of the manhole at direction change and clean out access, (4) stormwater drainage line to be sized adequately to contain design flow, and (5) inspection by Commission prior to burying the pipe is necessary.  J. McGrath motioned to close the Public Meeting; C. Burkhardt seconded; all agreed.  C. Burkhardt motioned to issue a Negative Determination of Applicability by reason #3, adding conditions 1-5 as read by Mark Coakley; J. McGrath seconded; all agreed.

Tim Hess (DSA) – INFORMAL DISCUSSION – Proposed Linden Street project (Wildlife Sanctuary)

Mr. Hess and Dan Stimson (Sudbury Valley Trustee) were in attendance to ask the Commission’s feedback.  The client is proposing to create a wildlife sanctuary on Linden Street (previous Jameson Ridge property).  They plan to make it as green and sustainable as possible, and are in the early stages of development.  There is an existing residence on the site.  There will be cutting of vegetation.  They will not be in the riparian zone.  Some walking trails will cross wetlands.  Walking trails are exempt up to the point of crossing a wetland.  Wetland delineation will be needed.  A plan will be required showing the cuts and fills.

Mike Holyoak – INFORMAL DISCUSSION – Application Process (18 Boulder Way)

Mr. Holyoak was previously issued an Order of Conditions and has come before the Commission to inquire if he needs to re-file since he is turning the house for a better view.  The size remains the same.  He showed the Members photos indicating the old and new location.  After a review and discussions, the Commission determined there is no significant impact and therefore will not require an additional filing.  He was informed, however, that if he wants to create a retaining wall, he will need to file because the wall is a wildlife barrier.

Leanne Marien (Stiles Crossing) – Ms. Marien attended to discuss the status of Stiles Crossing and asked what the next step is.  They have 120 days from the town meeting to complete the checklist from Graves.  With the exception of the Venincasa lots, everything is completed.  She said the dirt that was thought to come from Lot 25 was from Ricciardi’s loam.  He has since put in a berm on each side of the lot and planted.  Mark Coakley said if an as-built plan was received from the town, the Commission will sign off on the road and put an Enforcement Order on two lots (primarily Lot 25).  She was told the town should request the Certificate of Compliance and to speak with the town administrator.  

COMMISSION BUSINESS

Vouchers were approved.

J. McGrath motioned to approve the April 25th Meeting Minutes as amended; C. Burkhardt seconded; all agreed.

Correspondence was reviewed.

Weston & Sampson Engineering – Shrewsbury NOI (Newton Pond Dam) – It was determined that they do not need to file an NOI with Boylston.  The pond level will remain the same.  J. Walsh will follow-up.

Resident Complaint (60 Stiles Road) – The town administrator forwarded the complaint to the building inspector.  Tony Zaharaidis will be asked for a copy of his findings.

The meeting adjourned at 9:30 p.m.
