DCR (John Scannell) – PUBLIC HEARING – DEP File # TBD. Robert Wildey, VHB Inc., Engineer for DCR, Ed Whatley, VHB, Inc., Pat Austin, DCR Watershed Protection. Mr. Wildey presented plans for re-paving part of Route 70, and changing stormwater measures. This project will be from the Clinton Line down past Mile Hill Road. It was noted that the plans had not been signed by a professional engineer, and that the advertising fee had not yet been paid. There are several Wetland areas adjoining the area. Most work will be done in the roadbed, with some adjacent work in the buffer zones along the roadway for installation of measures. Culverts which currently bypass the road and feed clean runoff directly into the reservoir will not be
changed. Two new storm drains will be introduced north of Mile Hill Road. The Commission recommended that a sub-drain be installed just north of Mile Hill Road to address ground seepage, to which the applicant agreed. Two current outfalls that do not have treatment will be abandoned. The major stormwater structure will be located just before the Clinton Line and Route 62, with work in the buffer zone of the adjacent wetlands. Due to the location and right-of-way concerns, the stormwater structure will be less than 50’ from the roadway, so the applicant is requesting a waiver from the setback requirement in the Town Stormwater Control Bylaw. Erosion and sediment control measures will be installed. The applicant also provided pictures of some of the wetland areas. Further details were discussed, including stockpile and equipment parking locations. The SWPPP for these locations, which have not been determined yet, will be
provided by the contractor. J. McGrath made a motion to close the Public Hearing, which was seconded by C. Burkhardt, and passed unanimously. M. Coakley made a motion to issue a standard Order of Conditions with the following special conditions: 33) any stockpile or equipment storage area shall have erosion and sediment control on the downhill gradient of the area and be delineated on the final plans, and be a minimum of 25’ from any resource area; 34) Final Plans need to be stamped by a Professional Engineer. J. McGrath seconded the motion and the Commission approved unanimously. M. Coakley made a motion to issue a standard Permit for the Stormwater Control Bylaw with the following special conditions: 21) applicant shall file a stormwater pollution prevention plan with the Commission prior to any work; 22) the Commission shall waive the 100’ setback requirement for the stormwater structure located adjacent to Sta. 142, and a 25’ setback will be observed instead. J. McGrath
seconded the motion and the Commission approved unanimously.
WORCESTER COUNTY HORTICULTURAL SOCIETY – PUBLIC MEETING. RFD for repaving of driveway at Worcester County Horticultural Society Tower Hill location. Mr. John Trexlor, Director, presented plans for the paving work of Fuller Drive, from French Drive to the facility. The width and the layout will not be changed; some minor work will be done to deepen the drainage basins at the top of the hill. The retention basin at the base of the driveway will be retained. The existing asphalt will be re-used as road base. Sediment and erosion control measures will be installed per the plan. J. McGrath made a motion to close the Public Hearing, which was seconded by C. Burkhardt and approved unanimously. A motion was made to issue a Negative Determination, reason 3,
by C. Burkhardt, with the following condition: adequate erosion and sediment control measures will be installed adjacent to the wetland area at the base of the driveway. J. McGrath seconded the motion, and the Commission approved unanimously.
INFORMAL DISCUSSION – Inspection of Stiles Crossing by Eco-Tec on 1 April, 2011. Ralph Visconi, 10 Ridgefield Circle, a homeowner and representative of the Homeowners Association, appeared to discuss the report. The report listed several deficiencies, and it was noted that a Certificate of Compliance had not been issued. Mr. Visconi stated that the homeowners were anxious to get the road accepted by the town for plowing and maintenance. He indicated that there were major access issues last winter due to poor plowing by the developer. There was a discussion by the Commission members about the status of the lots. The lot where material is stockpiled is still owned by Signature Homes. The Commission discussed the possibility of issuing an Enforcement Order
against Signature Homes regarding the condition of Lot 25, but deferred that at this time. Per the Eco-Tec report, the Commission agreed that there are significant issues which would preclude our approval of the request to turn the road over to the town. The Applicant detailed the highlights of the Graves Engineering Report prepared on the same issue for the Planning Board.
COMMISSION BUSINESS:
A motion was made by C. Franz to accept the meeting minutes from 29 March, 2011, that was seconded by J. Walsh, and approved unanimously.
Vouchers were approved and correspondence was reviewed.
C. Burkhardt visited the area adjacent to 10 Clearview Street in Timberbrook, based on a citizen complaint of dumping in a resource area. Chip noted that the area was near Malagasco Brook. Lawn debris had been dumped in the riverfront area near the brook on the Timberbrook. The Commission decided to send a letter to the Homeowner’s Association of Timberbrook, with a copy to David Getman/DCR.
J. Walsh reported on a site visit on a lot off of Nicholas Avenue in response to a report that trees were being cut down adjacent to a Vernal Pool. Jeff spoke to the landowner who agreed to keep a setback from the vernal pool.
C. Burkhardt approved having Woodard & Curran prepare the 2010 NPDES Stormwater Annual Report.
The Commission reviewed the Stormwater Collection and treatment report from Phillips Precision, and was satisfied with the report.
