REQUEST FOR DETERMINATION – PUBLIC MEETING: Steland Investments; Tom Healey, Director, Technical Services, Nouria Energy; Jim Ricciardi, Ricciardi Construction, and Courtney Rheaul, Graves Engineering were in attendance.
Project located at 260-328 Shrewsbury Street; for installation of a 10" water main from Dragon 88 to the site of the former Mobil Station. The applicant was advised that his ad fee was outstanding. J. Walsh recused himself. Mark explained the RFD Process to the many abutters present. Ms. Rheaul discussed the plan for extension of the water main from Dragon 88 along the Route 140 shoulder to the former Mobil station site. The Commission noted the wetland areas on opposite side of Route 140, and discussed the proposed stormwater mitigation efforts. The location of under road culverts and storm drain outflows was also discussed. The floor was then opened to abutters for questions. Bruce Symonds, School Street: Have they tested for any ledge in the area? Ans: Unknown (J. Ricciardi). Irene Symonds, School Street: Will Mobil continue to test their water? Ans: (Tom Healey) Nouria Energy is aware of the environmental issues on the site; Exxon Mobil is still responsible for
any mitigation. Nouria is in touch with CDM, who is still monitoring the site. Donna DiPilato, Shhrewsbury Street, indicated that the remediation equipment had been removed per a notice she had obtained from the DEP. Robert Dunne, West Boylston: what depth will the pipe be? Ans: 5' (J. Ricciardi). Mrs. DiPilato: Would there be an impact from blasting? Mr. Ricciardi explained the process for obtaining a blasting permit and doing a pre-blasting survey. Vincent DiPilato, Shrewsbury Street indicated that Mr. Ducat has a wetland area on his site next to the equipment storage yard on Route 140. The Commission is familiar with the area and felt this was far enough away from the proposed construction site that there would be no impact. C. Burkhardt made a motion to close the Public Meeting, which was seconded by C. Franz and approved unanimously. M. Coakley made a motion to issue a Negative Determination, reason #3; with the
standing condition that all stormwater measures be installed per the provided plan from Graves Engineering dated 2/23/11. The motion was seconded by J. McGrath, and approved unanimously.
INFORMAL MEETING: Jonathan Trexler, Tower Hill. Mr. Trexler was advised to file a RFD for re-paving of the entry driveway.
AMENDED NOTICE OF INTENT - PUBLIC HEARING: Farooq Ansari; Longley Hill Development; Request to amend Order #115-342, to modify construction phasing for Longley Hill Road subdivision. The Chairman advised the applicant that some funds were required for the 53G Peer Rreview Account. Mr. Ansari explained his role as the current owner, and that he wants to continue the road in the subdivision down to Stiles Road. The current order covers this area in question, but Mr. Ansari wants to change the phasing specified in the order to meet a request of the Planning Board to complete the road cuts so that the road is passable down to Stiles for town plowing access. Mr. Ansari's written request was made via email on 6 March. Mr. Ansari indicated that there was no
change to the plans. The Commission reviewed the original plan phasing. Mr. Ansari indicated that all cuts and fills in the original Phase one are complete, with the exception of the final grading around the house lots. The Commission agreed that the amendment to the Order was required to waive the final stabilization of the Phase 1 sites and start Phase 2. Mr. Ansari indicated that Lot 7 was to be used for temporary storage during the remainder of the excavation. The Commission asked what Mr. Ansari's plan was for the road work. He indicated that the drainage would go in and the road would be graveled only. The floor was then open to abutters. Clayton Marshall, Stiles Road: Would the road be fully completed and paved? The Commission explained that the intent was to complete the road and have it accepted it as a town way. The Commission related conditions that have to be in place, such as drainage
structures. Pam Marshall, Stiles Road: Would Mr. Ansari be building anything near French Brook? The Commission reviewed the planned detention basins planned for the site. Pashan Reddy, Maple Way: Will upper and lower Stiles road meet? The answer is no. J. McGrath made a motion to close the Public Hearing, which was seconded by M. Coakley and passed unanimously. J. McGrath made a motion to adjust the phasing on the master construction plan, sheet D3, dated 2/14/02; rev. 11/8/02; to allow for Phase 2 work to begin prior to the final stabilization on Phase1 lots. The motion was seconded by M. Coakley and passed unanimously. M. Coakley recommended that we resume site inspections using Eco-Tec; the Commission concurred.
ENFORCEMENT ORDER: Jim Ricciardi, School Street Tree Removal. The Enforcement Order was issued on 3/8/2011 for removal of trees in a jurisdictional area. Location is on School Street across from Boylston Auto Body. The Enforcement Order was issued based on an initial site visit by C. Burkhardt and a subsequent visit by M. Coakley, and J. McGrath that was prompted by a call to the Commission administrator by a citizen. The Commission discussed conditions at the site, a description of the work performed, and reviewed topographic maps showing an intermittent stream on the site. Several trees were cut in the potential wetland area. The Commission agreed that the site was jurisdictional. Mr. Ricciardi indicated that he had
purchased the land from the town, and that he felt his tree clearing was not an issue. The Commission discussed with Mr. Ricciardi his options to file for an ANRAD, or to file a Notice of Intent. The Commission requested that Mr. Ricciardi have information for the Commission within 60 days, including wetland delineation, the impact of the prior work on the wetland, and remediation planned. The Commission discussed the flow of the intermittent stream, and also advised Mr. Ricciardi to remove the trees that he had already cut down from the site, using care to minimize damage to the site. Stumps were not to be removed, and no additional cutting is to take place. A motion was made by C. Burkhardt to ratify the Enforcement Order, with a provision allowing for tree removal of those trees already cut, and the requirement to file a Notice of Intent for the work required to mitigate the work indicated by the Enforcement Order
within 60 days. J. McGrath seconded the motion; which was unanimously approved.
INFORMAL MEETING: Robert Dunne, West Boylston. Mr. Dunne, who works for the DEP, came before the Commission as a private citizen to provide an update on the activity by Bethlehem Bible Church on their property on 85 Sewall Street. He indicated that he is a member of the Church Building Committee, and that the Committee is in the process of determining plans for the property, with the intent of getting all necessary permits in the near future.
COMMISSION BUSINESS:
A motion was made by C. Franz, seconded by M. Coakley and approved unanimously to accept the minutes from 15 February, 2011.
The Commission reviewed a notice received from VHB Engineers on behalf of the DCR and MA DOT for partial repaving of Route 70. VHB was advised that the work will be subject to the Town By-law, as well the WPA.
The Commission reviewed vouchers and correspondence.
The next meeting will be held on April 25th.
A motion was made by M. Coakley, seconded by C. Franz, and approved unanimously to revoke the Associate Member status for Teresa Prunier, and to remove her from the Commission’s distribution list.
