Conservation Commission Minutes 11/15/2010

DR. BRIAN McDERMOTT (Superintendent of Schools) – PUBLIC HEARING (continued)Notice of Intent (1001 Main Street)  Construct new school which includes the installation of a new stormwater management system.

William Maher, Project Manager for Nitsch Engineering, was in attendance.  He submitted a revised plan and stormwater report.  The peer review was not completed in time for tonight’s meeting.  He updated the board with changes since the last meeting which include the eight lane track being reduced to six lanes which will drop the impervious area, a perimeter drain included to discharge to the infiltration basin, additional grading, curved berm on the northern side, sediment fore bay for pretreatment has been included, and binder documents have been updated.  The applicant requested a continuance and asked for a special meeting.  J. McGrath made a motion to accept the request for continuance for a special meeting to be held on December 6th at 7:00 p.m.; C. Burkhardt seconded; all agreed.

Dave Getman (DCR) said that they will require the project to meet redevelopment under the stormwater regulations.  DEP felt that because there is an improvement to water quality it was permissible.

The applicant requested a continuance to the special meeting on December 6th.  C. Burkhardt made a motion to accept the request for continuance to run concurrently with the NOI filing on December 6th; J. McGrath seconded; all agreed.

INFORMAL DISCUSSION – Ron Aspero – Discuss Redwood Circle.

Mr. Aspero attended to find out if a filing was needed since the area behind the rain garden was already disturbed.  The original filing did not have lot detail.  DEP has since determined that there are no endangered species.  He said there are two more rain gardens/swales to be built.  He was told to file a Request for Determination of Applicability which can be scheduled for December 6th.

SCOTT GODDARD (Bethlehem Bible Church) – PUBLIC HEARINGAbbreviated Notice of Resource Area Delineation (85 Sewall Street)  Delineate wetlands.

Scott Goddard was present and provided a $2,000 check for the 53G monitoring account.  He said he is a professional wetland scientist and also a member of the church.  The 54+ acre property is currently under a Purchase & Sale Agreement.  He said points of access have been located from three streets (Sewall, School and Route 140).  There is an existing house, barn and shed.  The entire parcel has been delineated.  He has been working with Paul McManus (EcoTec) who conducted the field review.  Mr. McManus submitted his review letter dated November 15, 2010 via email.  Mr. Goddard stated there is no proposed project yet.  Mark explained to the audience members what an ANRAD is and what is jurisdictional to the Commission.  One resident asked if building was allowed in the wetlands and was told it was allowable within 100’ of a wetland and also in a resource area, but it becomes a burdensome process and is outlined in the Notice of Intent filing.  He also told the residents that the Commission spends considerable time on pre-development, making the applicant prove to us the effect it will have on other properties.  Patrick Healy (25 Sewall Street) asked if it was agriculturally exempt and was told yes.  He also asked if it is declared wetlands, are there restrictions on chemicals that can be used and was told yes.  Some residents asked if the pond was used for irrigation.  The Members did not know how it was used.  C. Burkhardt made a motion to close the Public Hearing; C. Franz seconded; all agreed.  J. McGrath made a motion to accept the Wetland Delineation Plan of 85 Sewall Street dated November 15, 2010; C. Burkhardt seconded; all agreed and an Order of Resource Area Delineation was issued.

INFORMAL DISCUSSION – Ansari Builders – Discuss Longley Hill.

Shamy (Project Manager) was in attendance.  He said they plan to finish the two houses.  Mark told him to become very familiar with what they are required to do and what is expected of them.  He was given a copy of the Order of Conditions and Stormwater Permit.  Mark explained the situation and how it was left by the previous developer.  Shamy was told to follow the sequencing process and provide a 24 hour contact number.  He was also asked and agreed to send the Commission a report on the condition of the site before they begin work.  A site inspection needs to be done to see if it is in compliance.  Shamy was told that as long as they comply with the sequencing, they can do the road as the Planning Board requested and reminded that if they open up the road, they need to put up hay bales and silt fencing and re-file for an Amended Order of Conditions.  He was also advised to talk to the engineer (Andrew Liston).  Mark is strongly opposed to changing the sequencing.  He said there should be a meeting with Shamy and Farooq Ansari to go over the phasing and site development sections of the plan.

COMMISSION BUSINESS

Vouchers were approved.

Chip Burkhardt made a motion to approve the Meeting Minutes dated October 18, 2010; Charlene Franz seconded; all agreed.

Correspondence was reviewed.  No action will be taken regarding the Notice of Intent to Sell Land (Lane/Bethlehem Bible Church).

Chip attended a stormwater meeting today and found out that the town is being grouped with the Merrimack River Watershed and will be subject to their requirements.  The cost per year is $75K-$100K.  The town will ask for a wavier.  Research needs to be done to compare towns of a similar size.  

Mark Coakley made a motion to adjourn; Charlene Franz seconded; unanimously approved.  The meeting was adjourned at 8:40 p.m.
