DR. BRIAN McDERMOTT (Superintendent of Schools) – PUBLIC HEARING – Notice of Intent (1001 Main Street) Construct new school which includes the installation of a new stormwater management system.
William Maher, Project Manager for Nitsch Engineering, was in attendance. He gave a presentation outlining the proposed conditions. He said most of the work is contained to the existing school. The new school will not be within the buffer zones. Most drainage will be directed toward Main Street with catch basins. There are leaching areas for the septic system. The infiltration system has been designed for a 100 year storm. They propose to convert an existing catch basin to an outlet control structure. There will be no traffic or interference with school activities during construction. The existing driveway will remain and there will be additional access driveways for visitors and buses. Mr. Maher said there will be no additional riverfront area disturbance other
than what there currently is. There may be a reduction in track lanes which would result in less impervious area in the riverfront. Mr. Maher said he filed with MEPA and spoke with Mr. Gage who said they expect to issue a certificate on Friday. Mr. Gage recommended gate valves be installed in case of emergency spillage. Jeff Walsh said it needs to be included on the stormwater management plan. With regard to administrative issues, DEP has not yet issued a file number. Mr. Maher submitted certified postage receipts (green cards have not been received by them as yet). Dr. McDermott said the ad fee needs to be approved. Mr. Maher was made aware that the stormwater permit application will need to be advertised and the abutters notified again. Mark Coakley discussed peer review process. Jeff Walsh did not take part in the discussions. The drawings are not stamped. They will need to provide a stamped copy, along with
drainage calculations, to the peer reviewer and work directly with them. Mr. Maher said that because of time frames involved with requesting a variance from DCR who requires all permits in hand, they would need an Order of Conditions and Stormwater Permit by November/December. The Members agreed that if needed, a special meeting could be held. Mark Coakley said to include on the plan the construction sequence, cuts and fills, stockpile areas, construction stabilization, and a note referencing the Stormwater Management Plan. The project will not be out to bid until March 2011. Mr. Maher will supply draft documents to the Commission until a contractor is selected, at which time he will submit final documents. The site entrance mat was discussed and Mr. Maher explained the erosion control measures to be used. Joe McGrath made a motion for peer review and to use Graves Engineering as the reviewer to review the Stormwater Bylaw and Notice of
Intent; Chip Burkhardt seconded; Mark Coakley agreed; Jeff Walsh abstained from voting. Mark will contract Mike Andrade. A letter will be written to Dr. McDermott requesting $5,000 for peer review.
Dave Getman (DCR) was present to say they are working with the applicant. Their concern is with the north side of the project and SWPPP. He noted that the stormwater regulations state that “stormwater discharges to a Zone I or Zone A are prohibited unless essential to the operation of a public water supply.” He said there is drainage and an existing structure. He is waiting to hear from DEP why it is permitted when the regulations say it should not. Mr. Maher said that pre-treatment is 44% and there is a decrease to Zone A.
The applicant requested a continuance. J. McGrath made a motion to accept the request for continuance; C. Burkhardt seconded; all agreed. It will be on the November 15th Agenda at 7:00 p.m.

Joe McGrath made a motion to approve the Meeting Minutes dated September 20, 2010; Chip Burkhardt seconded; all agreed.
Correspondence was reviewed.
Town-Owned Property Auction – Joe McGrath spoke with the Town Administrator and expressed his disappointment that the Commission was not given the opportunity to possibly put them into open space or put a conservation restriction on them.
Lucy Pendell (64 Melrose Street) emailed/called the office with her concerns that one of the properties that abut her property is a wetland. Joe will follow up with Nancy Puff to find out who purchased the property and inform them that they need to come before the Commission before starting any work.
Compass Pointe – Chip drove by and said the site appears to be stable.
Longley Hill – The new owner (Farooq Ansari) was given a copy of the Order of Conditions and Stormwater Control permit that was issued in December. He will be contacted and reminded that he must contact the office 48 hours prior to starting any work and invited to attend a meeting.
25 Ethan Allen Drive – Mike Kewley & Cheryl Casey attended to ask the Commission for guidance on how to deal with beavers on their property. Jeff said they can breach the dam or trap them. Dave Getman (DCR) suggested they call him and he will put the in contact with Dan Clark (beaver control specialist for the state).
Mark Coakley made a motion to adjourn; Joe McGrath seconded; unanimously approved. The meeting was adjourned at 8:30 p.m.
