Conservation Commission Minutes 05/18/2010

COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Notice of Intent and Stormwater Control Permit Application (Main and Sewall Street – Compass Pointe)  Construct a portion of a subdivision roadway and two detention basins within the buffer zone of Spruce Pond to the north and a red maple shrub swamp to the south.

Jeff Walsh recused himself from the matter.  James Venincasa, Cheryl Morrill and Glenn Krevosky were present.  Surety was discussed.   C. Burkhardt will follow-up with the Town Administrator who was to contact Town Counsel after the last meeting.  It will be special conditioned on the Stormwater Permit.  Mr. Venincasa was asked if the land survey was completed.  He stated it was and that he did a site walk with the abutters and they were “all set”.  Ms. Morrill said there is no paperwork from the surveyor, just an agreement with Mr. Venincasa and the abutters to remove stumps and reseed the area for them.  She said that approximately 15 square feet of loam was on one lot, and 90 square feet of stumps on another lot, both of which will be removed within 30 days.  No trespassing signs have been posed on site.  The revised plans were reviewed by Graves Engineering.  Ms. Morrill said they are working on the Homeowner’s Association Agreement with the Planning Board.  She was reminded that the Order will not be released until it is received and agreed upon by Town Counsel.  Special Conditions were discussed, written, and will be included on the Order.  They will be as follows:  #35) Prior to release of the Order of Conditions, the Applicant shall have established, and recorded at the Worcester County Registry of Deeds, the Homeowner’s Association for the project, to the satisfaction of Town Counsel and other Town Boards; and #36) Prior to the release of the Order of Conditions, the Applicant shall provide sufficient funds, to be held in escrow by the Commission, to cover inspection and engineering review costs for the project, based on an estimate provided by the Commission’s consultant engineer.  The proponent was asked if they had any objections to any of the conditions, to which they answered no.  The audience was asked if they had any questions.  The audience had no input.  C. Burkhardt motioned to close the Public Hearing; J. McGrath seconded; all agreed.

With regard to the Enforcement Order, Mr. Venincasa stated that 400 lbs. of additional seed was put down.  M. Coakley said that after three site visits, there is still next to nothing coming up.  C. Burkhardt agreed and said he was there today and could not see any growth. Mr. Krevosky also agreed and said that approximately 10% is starting to grow.  Mr. Venincasa said the sediment trap has been cleaned out and hay bales put down.  The Members were satisfied with the opinion of Graves Engineering review letters dated May 6 & May 17, 2010.  M. Coakley made a motion to lift Enforcement Order #115-331 dated October 19, 2009; J. McGrath seconded; all agreed.

J. McGrath made a motion to issue an Order of Conditions with standard conditions and adding two Special Conditions, #35 & #36, as read by Mr. McGrath; C. Franz seconded; all agreed.  The Order will be held pending compliance to the Special Conditions.

J. McGrath made a motion to issue Stormwater Control Permit #2010-1 to Signatures Homes, adding Special Condition #21) prior to the release of the Stormwater Permit, the Applicant shall provide surety in the form to be determined by Town Counsel, in an amount to be determined by the Commission’s consultant engineer, so that all conditions of the Stormwater By-Law, and all Stormwater control measures and structures are fully implemented should the project be cancelled or significantly delayed; M. Coakley seconded; all agreed.  The Permit will be held pending compliance to the Special Condition.  Plans received this evening will be included. The proponent was asked if they had any objections to any of the conditions, to which they answered no.  The audience was asked if they had any questions.  The audience had no input.

BOYLSTON YOUTH SOCCER – PUBLIC HEARING – Stormwater Permit Application (221 Main Street)  Construct soccer field at Hillside.

Jeff Walsh was in attendance as the representative for BYS.  He disclosed that he is a Member of the Commission and recused himself as a Member.  In addition, he stated that he was a volunteer for the BYS before becoming a Commission Member and there is no financial gain involved.

The plan was reviewed.  The intent is to construct a soccer field at Hillside.  They plan to remove the top soil, grade the soccer field, and replace the soil.  There will be no importing or exporting of materials.  They will utilize the materials on site.  They hope to install the sprinklers at the same time.  Mr. Walsh said the design may shift slightly, but is currently balanced.  J. McGrath made a motion to close the Public Hearing; W. Lonstein seconded; all agreed.  C. Burkhardt made a motion to issue Stormwater Control Permit #2010-2; J. McGrath amended the motion to issue Stormwater Control Permit #2010-2 and waive town fees; C. Franz seconded; all agreed.

COMMISSION BUSINESS

Vouchers were approved.

J. McGrath made a motion to approve the Meeting Minutes dated April 27, 2010 with changes noted; W. Lonstein seconded; all agreed.

Correspondence was reviewed.

Consider issuing a Certificate of Compliance to Carl Sharpe, 20 Woodland Drive (DEP #115-344) – The site was visited; the Members were satisfied.  McGrath made a motion to issue a Certificate of Compliance to DEP #115-344; J. Walsh seconded; all agreed.

J. Walsh motioned to adjourn; C. Burkhardt seconded; all agreed.  The meeting was adjourned at 8:30 p.m.

After the meeting adjourned, Wendy Lonstein informed the Members that she will not be serving another term on the Commission.
