COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Notice of Intent and Stormwater Control Permit Application (Main and Sewall Street – Compass Pointe) Construct a portion of a subdivision roadway and two detention basins within the buffer zone of Spruce Pond to the north and a red maple shrub swamp to the south.
A request for continuance was received today. It will be continued to February 8th at 7:15 p.m.
HABITAT FOR HUMANITY – PUBLIC HEARING – Notice of Intent (1 Mill Road Circle) Construct a two-unit duplex/condo. This was inadvertently advertised in the Worcester Telegram for 8:40 p.m.
James Tetreault was in attendance for the applicants. The project will be a combination of two lots, both of which predate 1996. A plan was submitted which was recorded at the Registry of Deeds in Plan Book 659, Plan 46, dated June 1. 1992. Habitat for Humanity proposes to construct a duplex. The lot is being donated by Charles and Claire Fitts. Soil tests have been conducted with the BOH agent. The lot borders another property (owned by Celeste Faye) that does have wetlands. Because they could not contact Ms. Faye, two holes were dug off the cart path, which they will label the wetland boundary. There is a perennial stream. Proposed work is within the buffer zone and riparian zone. Mr. Tetreault stated that there are no comparable properties because the
land was donated. M. Coakley said there is an economic impact because there is an economic value of the lot, and because it was a gift, there would be a tax write-off. Applications have not yet been filed with the Board of Health or Zoning. M. Coakley had concerns with approving the project as a single-family house. He also had concerns as to what the Commission would be voting to exempt them from. There are two resources areas (BVW in the buffer zone, which does not appear to be an issue, and riverfront area; the lot existed before 1996 and was approved by the Planning Board). Mr. Tetreault will contact DEP regarding the wording for a duplex and single-family house and ask for guidance. M. Coakley will also contact DEP. What the Commission requires is DEP clarification and to be sure the project satisfies the regulations and riverfront requirements. The applicant requested a continuance. C. Burkhardt motioned to accept
the request for continuance; C. Franz seconded; all agreed. It will be on the February Agenda.

Vouchers were approved.
The Longley Hill Monitoring Account needs to be replenished. Melanie will contact Mr. Ali and request an additional $2,000.00.
M. Coakley motioned to approve the Meeting Minutes dated December 21, 2009 with changes noted; C. Burkhardt seconded; all agreed.
Correspondence was reviewed.
The Annual Report was reviewed and will be submitted to Lori Esposito.
Consider Request for Certificate of Compliance for Francis McKeary & Nancy Spadorcia (DEP #115-125) 44 Rocky Pond Road – Mr. McKeary was in attendance. Items from the previous request (June 1993) were addressed. Conditions did not allow for a site visit. It will be tabled until February. Mr. McKeary was advised to inform the office when there is no snow cover and the Members will conduct a site visit.
Consider Request for Certificate of Compliance for Harmon Law Offices (Millin Family Trust) DEP #115-230 (1 Underwood Avenue) – Due to snow cover, a site visit could not be conducted. There is an as-built plan on file with the Board of Health. The law office will be informed that it will be tabled until February.
C. Franz motioned to adjourn; C. Burkhardt seconded; all agreed. The meeting was adjourned at 8:45 p.m.
