J. McGrath will contact Kelley Freda from DCR regarding Great Ponds.

DOUGLAS KIMMENS/MICHELLE RODIL – Request for Certificate of Compliance (25 School Street)

Mr. Kimmens appeared before the Commission to request a Certificate of Compliance.  He presented an as-built plan and approval from the Board of Health.  J. Walsh inspected the site which had re-vegetated.  M. Coakley motioned to issue a Certificate of Compliance; J. McGrath seconded; all agreed.

VROLYK, ROBERT – PUBLIC MEETING – Request for Determination of Applicability (5 Knob Cone Drive)  Break up and fill in pool and concrete deck around the pool.

Brad Brigham was in attendance for the applicant.  He stated that all work is to be inside the current retaining wall.  The liner and other pool material will be removed.  Concrete will be used as fill.  The applicant agreed to have erosion control material on hand if needed.  J. McGrath motioned to close the Public Meeting; W. Lonstein seconded; all agreed.  M. Coakley motioned to issue a Negative Determination by Reason #2; W. Lonstein seconded; all agreed. 

COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Notice of Intent (Main and Sewall Street – Compass Pointe)  Construct a portion of a subdivision roadway and two detention basins within the buffer zone of Spruce Pond to the north and a red maple shrub swamp to the south.

Because a quorum could not be met with Jeff Walsh recusing himself, the Commission agreed to continue the hearing to October.

COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Stormwater Control Application (Main and Sewall Street – Compass Pointe)  Construct a residential subdivision located on Sewall Street.

BOYLSTON WATER DISTRICT – PUBLIC HEARING – Notice of Intent (Sewall Street [N of Abbey Road to Compass Pointe])  Install a 6” to 8” diameter water main within the paved surface and gravel shoulder of Sewall Street, from approximately Abbey Road to the south entrance to the Compass Pointe subdivision.

Paul McManus and Scott McCubrey were in attendance.  Green cards were received.  The ad fee was not received.  The plans were reviewed.  Resources are Sewall Brook (perennial stream); riverfront area is the biggest concern.  The brook will be crossed on the top of culvert and will have no immediate impact on the brook.  A temporary sediment trap is proposed near Pine Street and sediment erosion control will be installed along Camp Harrington drive.  No alternatives were reasonable to which the Commission agreed.  Mr. Venincasa will install the section from Compass Pointe to the brook and to the school on the other end.  The Commission is concerned about the status of their filing, which originally only covered the section from Compass Pointe to the school.  The Water District’s permit would cover the work from Abbey Road to Compass Pointe, which the Commission is satisfied with.  J. Walsh reviewed pipe size with the applicant.  It was noted that a DEP file number (115-340) had been issued; no public comments.  A discussion as to how the NOI will be recorded was held.  The Commission suggested it be recorded against the Compass Pointe subdivision.  The Order is not subject to the Stormwater Bylaw.  W. Lonstein motioned to close the Public Hearing; M.  Coakley seconded; all agreed.  M. Coakley motioned to issue a standard Order of Conditions; J. McGrath seconded; all agreed.

COMMISSION BUSINESS

Vouchers were approved.

W. Lonstein motioned to approve the Meeting Minutes dated August 17, 2009; J. McGrath seconded; all agreed.

Correspondence was reviewed.

Alan Cosimini (Parks & Recreation) to discuss the new field – Mr. Cosimini appeared and was assisted by Jeff Walsh.  The plan to apply for a Stormwater Permit for building a new soccer field below the current field at Hillside was reviewed.  The plan will be submitted for the December meeting.  Future work will include irrigation and possible lighting.

Consider Request for Certificate of Compliance for Carl Iaccarino, DEP#115-266, Lot 6 Reservoir Street (former owner was Peter Coskie) – J. Walsh looked at the site and reviewed the as-built plan.  He reported that the site is not stabilized.  J. Walsh motioned to have Melanie notify the applicant that the Commission will not issue a Certificate of Compliance until the site is stabilized; M. Coakley seconded; all agreed.

Consider Request for Certificate of Compliance for David Humphrey, DEP#115-318, 742 Main Street – M. Coakley and J. Walsh visited the site.  M. Coakley motioned to issue a complete Certificate of Compliance; W. Lonstein seconded; all agreed.

Consider Request for Certificate of Compliance for Gregory Lafond (211 Stiles Road), former owner was Heather Lamoureux – J. Walsh visited the site.  J. Walsh motioned to issue a complete Certificate of Compliance; W. Lonstein seconded; all agreed.

Consider Extension Permit for Order of Conditions DEP#115-307, Lot 2A Mile Hill Road (Philip and Nancy Carlilse) – W. Lonstein motioned to issue a two-year extension to the Order of Conditions; J. McGrath seconded; all agreed.

Rand-Whitney Email (to discuss the possibility of changing the Monthly Inspection Reports to Quarterly) – J. McGrath motioned to agree to Quarterly Inspections; W. Lonstein seconded; all agreed. 

Cathy Phillips Stormwater Control Certificate of Compliance – Previously approved.  The on-going reporting requirements for Stormwater compliance was discussed.  J. McGrath will follow-up with C. Burkhardt.  Further discussion time will be added to the Agenda for the October meeting.

Agricultural Preservation Restriction Program (George Stowe) – The Commission prefers to review the entire application package from Mr. Stowe prior to signing any documents.

Stormwater Bylaw Bond (follow-up) deferred until the next meeting.

The Commission discussed Berlin’s request to monitor town land for ATV and snowmobile incursions.  It was noted that the Commission does not have responsibility for any lands.  J. Walsh will write a letter to the Berlin Conservation Commission on the matter.

W. Lonstein motioned to adjourn; J. McGrath seconded; all agreed.  The meeting was adjourned at 9:06 p.m.
