O’DRISCOLL, DONNA – PUBLIC HEARING – Notice of Intent (614 Main Street) Replace existing failing cesspool with a new sewage system and related grading within the 100’ buffer zone of a vegetated wetland.
Steve Sears (David E. Ross Associates) was in attendance for the applicant. It is an upgrade project to replace the cesspool. The system will be a Presby. There will be minimal removal of vegetation. J. McGrath motioned to close the Public Hearing; C. Burkhardt seconded; all agreed. J. McGrath motioned to issue a standard Order of Conditions; C. Franz seconded; all agreed.
HENDERSON, WILLIAM – PUBLIC MEETING – Request for Determination of Applicability (179 Green Street) Install a drainage pipe and regrade the area to eliminate flooding that is caused by an existing street drain.
Steve Sears (David E. Ross Associates) was in attendance for the applicant. He presented a topography worksheet and would like the guidance and opinion of the Commission on how to have his client proceed. He said the standing water was not there originally. The Commission agreed that regardless of the prior condition, it is now a wetland and they would prefer to see the fill taken out and the area returned to its original state. J. Walsh conducted a site visit and said that it qualifies as a wetland bordering a stream. A wetland scientist will be needed to flag the hydric soil area. It was determined that a Notice of Intent will need to be filed. Mr. Sears will relay the information to the applicant. J. McGrath motioned to close the Public Meeting; C. Burkhardt seconded; all
agreed. J. McGrath motioned to issue a Positive Determination; C. Franz seconded; all agreed.
COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Notice of Intent (Main and Sewall Street – Compass Pointe) Construct a portion of a subdivision roadway and two detention basins within the buffer zone of Spruce Pond to the north and a red maple shrub swamp to the south.
An email request for a continuance was received this afternoon to the September meeting from EBT Environmental.
COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Stormwater Control Application (Main and Sewall Street – Compass Pointe) Construct a residential subdivision located on Sewall Street.
An email request for a continuance was received this afternoon to the September meeting from EBT Environmental.
JAMES TETREAULT (Thompson-Liston) – Discuss how to proceed with Longley Hill.
James Tetreault and Iqbal Ali were in attendance to discuss the Longley Hill project. Mr. Tetreault stated that the project is up to date with the Planning Board. The Order of Conditions has lapsed with Conservation. He was concerned with the new DEP rules that are now in effect (specifically infiltration). They were informed that there is now a Stormwater Control bylaw they would have to adhere to and they would need to file for the current conditions. J. Walsh had concerns with the cuts and fills and does not want to have large amounts of area left open. He would like to see the building lots created and stabilized. Excavation would also be a concern. C. Burkhardt agreed that it should be stabilized as it proceeds. A stormwater bond was also discussed.

Vouchers were approved.
J. McGrath motioned to approve the Meeting Minutes dated July 20, 2009; C. Burkhardt seconded; all agreed.
Correspondence was reviewed.
Consider Request for Certificate of Compliance for Carl Iaccarino, DEP#115-266, Lot 6 Reservoir Street (previous owner was Peter Coskie) – Tabled until the next meeting so a site visit can be conducted.
Cathy Phillips Stormwater Control Certificate of Compliance – C. Burkhardt motioned to issue a Certificate of Compliance for SCP-2008-4; C. Franz seconded; all agreed.
Stormwater Bylaw Bond – After last month’s meeting, M. Coakley was to gather information from Graves and forward it to the Town Administrator who will discuss with Town Counsel. It should be a separate bond from the Planning Board and should be implemented on a case by case basis.
Joe McGrath was approached by Jackie Bissonnette, an abutter to Gary Tuthill, regarding his project. She asked why she was not notified and Joe explained to her that a Request for Determination does not require abutter notification. He referred her to the Building Inspector who required the post holes.
Jeff Walsh spoke with Scott McCubrey (Water District). He said they would be filing the application and wanted to know which form to use. After discussions, it was determined that a Notice of Intent will be necessary. Jeff will let him know.
J. McGrath motioned to adjourn the meeting; C. Franz seconded; the Commission unanimously agreed. The meeting was adjourned at 8:35 p.m.
