MARIO VIILLANI – Request for Determination of Applicability (510 Green Street) Create a pond measuring 40’x 80’.
A site visit was conducted and it was determined that it is a resource area and would therefore require a Notice of Intent. Mr. Villani stated he would use Glenn Krevosky. He was told to have Mr. Krevosky include the planting schedule, narrative with functions and values, and cross sections on pond for slope information. M. Coakley motioned to issue a Positive Determination by Reason #1; C. Burkhardt seconded; all agreed.
WILLIAM MAHER (Nitsch Engineering) – Tahanto project.
Mr. Maher (Nitsch Engineering) and Tina Stanislaski (HMFH Architects) attended for general information concerning the town project. They presented a survey of the proposed site. The wetlands were delineated previously. Ms. Stanislaski presented the different options available. At this point, the Members have no concerns. They will meet with DCR on Wednesday for further preliminary discussions concerning the aquifers.
BRIAN GAUCHER (191 Green Street) – Possible wetlands violation.
The site had recently been worked on. Dan and Jeff visited the site with Mr. Gaucher. The Members agreed that no work took place in a wetland and it is not jurisdictional. No action is necessary.
WILLIAM HENDERSON (179 Green Street) – Possible wetlands violation.
Steve Sears (David E. Ross Associates) was in attendance for Mr. Henderson. The GIS map of the area presented was not current. Mr. Sears stated there is a drainage ditch which he believed was noted on the septic plan and was to be maintained by Mr. Henderson, but never was. Fill was dumped in the area because Mr. Henderson wanted a lawn. He has since ceased working. After further discussions, it was determined that Mr. Henderson must file a Request for Determination of Applicability and appear before the Commission at the next meeting. If he chooses not to file, an Enforcement Order will be issued. Steve Sears will work with Mr. Henderson on the matter.
CHUCK JASIAK – Possible wetlands violation (730 Main Street).
Mr. Jasiak stated he wanted to add additional parking. He removed the top soil and wanted to put down crushed gravel. He would not be paving. He was told the area is jurisdictional because it is within the 200’ riverfront area. He was informed that if he intends to proceed, he would need to file a Notice of Intent and incur the expense of engineering fees and a wetland scientist. He was told that should he choose not to proceed, he will need to put up hay bales and loam and seed the area.
JAMES RICCIARDI – PUBLIC MEETING – Request for Determination of Applicability (1210 Main Street) Install underground electrical conduit and security gate foundations, associated grading, loaming and seeding.
After discussions, Mr. Ricciardi was told to put in hay bales for stabilization, backfill, loam and seed the area. J. Walsh motioned to issue a Negative Determination by Reason #3, D. Duffy seconded; all agreed.
MICHAEL HOLYOAK – PUBLIC HEARING (continued) – Notice of Intent (18 Boulder Way) Remove 17 trees to permit the construction of a septic system within 100’ of Rocky Pond. A gravel parking area is also proposed.
Timothy Paris (Connorstone Engineering) attended for the applicant. He addressed the items from last month. The dewatering scheme will be excavated out and hay bales will help filter it out; water runoff scheme will have crushed stone below the eaves; hay bales and silt fence will be installed between the property line and ledge; gravel parking area is remaining gravel; construction notes on sequencing are satisfactory. There was discussion as to chipping vs. loam and seeding. M. Coakley would like to see a 10’ natural buffer. J. Walsh motioned to close the Public Hearing; M. Coakley seconded; all agreed. J. Walsh motioned to issue an Order of Conditions to include Special Condition #31 – during well drilling, no sediment-laden water may be discharged to a resource area,
including Rocky Pond. If during well drilling the well sump, hay bales and silt fence are not sufficient to control sediment, then the drilling fluids shall be collected and pumped farther upgradient for additional treatment; and #32 – the Certificate of Compliance will only be issued once a 10’ strip along the bank is allowed to grow to a natural state easterly from the east side of the dock to the easterly property line; M. Coakley seconded; all agreed.
COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Notice of Intent (Main and Sewall Street – Compass Pointe) Construct a portion of a subdivision roadway and two detention basins within the buffer zone of Spruce Pond to the north and a red maple shrub swamp to the south.
J. Walsh recused himself from the matter. Glenn Krevosky stated that they cleaned out the sediment in the temporary basins. Mr. Venincasa stated that they intend to start loaming and seeding on June 29th. With regard to de-stumping, he said that the Dept. of Agricultural will not allow the chips to be moved off site until September. He also stated that the Planning Board accepted the plans with changes to Detention Basin B. Mr. Venincasa submitted an undated letter which stated that the Conservation Commission approved the subdivision plans. For the record, M. Coakley said that the Commission has not approved the subdivision plan as stated in Mr. Venincasa’s undated letter submitted tonight. Mr. Venincasa was advised to reply to the Commission in a letter, copying
Graves Engineering, addressing items 6, 7, 8 & 9 of Graves Engineering letter dated June 3, 2009. He was told to be specific and date the letter. With regard to 8 & 9, he was told to ask for relief from the existing bylaws. Mr. Venincasa is also required to provide cuts and fills for all phases of the entire subdivision. Mr. Krevosky stated that he will have Quinn Engineering calculate them. He was asked about the stream crossing for the water main, to which he stated that the Water District is doing. He was told to submit a letter from the Water District indicating that they will be responsible for the filing. Plans for the dam will be required before the hearing can be closed. Mr. Venincasa said they are waiting for a dam repair proposal from DCR. He said a site inspection was conducted by Tom Wang (dam inspector) of H2O. The applicant requested a continuance. M. Coakley motioned to accept the request
for continuance; C. Burkhardt seconded; all agreed. It will be continued to July 20th at 7:30 p.m.
COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Stormwater Control Application (Main and Sewall Street – Compass Pointe) Construct a residential subdivision located on Sewall Street.
Discussed in conjunction with the above.
COMMISSION BUSINESS
Vouchers were approved.
J. Walsh motioned to approve the Meeting Minutes dated May 18, 2009 with changes noted; M. Coakley seconded; all agreed.
Correspondence was reviewed.
The Commission regretfully accepted the resignation of Dan Duffy effective June 17th.
C. Burkhardt will contact the Town Administrator about bond authority under the current stormwater bylaw.
Reorganization of the Commission went as follows: Mark Coakley motioned to nominate Jeff Walsh as Chairman for FY2010; Dan Duffy seconded; all agreed. Jeff Walsh motioned to nominate Mark Coakley as Vice Chairman, Chip Burkhardt seconded; all agreed.
M. Coakley motioned to adjourn the meeting; J. Walsh seconded; the Commission unanimously agreed. The meeting was adjourned at 9:00 p.m.
