REGULAR MEETING MINUTES
May 18, 2009

RON ASPERO – Status on Redwood Circle Top Soil Depth – Mr. Aspero attended and stated that before the meeting, Connorstone Engineering visited the site. The seed in the soil is working. The December ice storm destroyed trees. The matter will be tabled to the June meeting pending a site visit and letter from the engineer stating that he looked at it. Mr. Aspero also said he has been in contact with Natural Heritage who at the time of the filing said there was endangered species, but later decided there was not. He asked Natural Heritage to modify the plan, to which they agreed. When the plan is recorded he will provide a copy for the file, along with correspondence from them. He was told that his Order of Conditions would need to amended.
JAMES RICCARDI (1210 Main Street) attended and presented a sketch to continue an electrical line and construct a proposed gate. The open trench will be approximately 3’ deep, but will be immediately stabilized. He was given a Request for Determination of Applicability to file.
MICHAEL HOLYOAK – PUBLIC HEARING – Notice of Intent (18 Boulder Way) Remove 17 trees to permit the construction of a septic system within 100’ of Rocky Pond. A gravel parking area is also proposed.
Timothy Paris (Connorstone Engineering) attended for the applicant. He stated that the proposed house would be constructed on the same footprint and will include a place to park. A well is also proposed. The project description on the NOI filed did not include the construction of a house or a well; it only states the removal of 17 trees to construct a septic system. Mr. Paris was made aware that the NOI needs to be revised. He was told to include a dewatering scheme, water runoff scheme, hay bales, silt fence, what they are using on the gravel parking area, and include on the construction notes that trees will be removed first and whether chipping will take place on or off site. Mr. Paris was also reminded that equipment cannot remain onsite at night. Mr. Paris requested a
continuance. M. Coakley motioned to accept the request for continuance; J. McGrath seconded; all agreed. It will be put on the June 15th Agenda at 7:15 p.m.
COMPASS POINTE ESTATES, LLC – PUBLIC HEARING (continued) – Notice of Intent (Main and Sewall Street – Compass Pointe) Construct a portion of a subdivision roadway and two detention basins within the buffer zone of Spruce Pond to the north and a red maple shrub swamp to the south.
J. Walsh recused himself from the matter. The applicant agreed to continue the hearing. J. McGrath motioned to accept the request for continuance; M. Coakley seconded; all agreed. It will be continued to June 15th at 7:30 p.m.
Discussions continued regarding the Enforcement Order. Mr. Krevosky stated that Quinn Engineering revised the sequencing regarding stabilization. Mr. Venincasa presented a letter dated May 18, 2009 describing the work to be done, which he would like to start immediately. He was reminded that a permanent basin still needs to be constructed. After reviewing the letter by the Commission, J. McGrath motioned to accept the plan detail dated May 12, 2009, Sheet 3, as stated in the letter from Jim Venincasa, dated May 18, 2009 for remediation work; M. Coakley seconded; all agreed. Mr. Venincasa is to inform the office before work is to begin.
COMPASS POINTE ESTATES, LLC – PUBLIC HEARING – Stormwater Control Application (Main and Sewall Street – Compass Pointe) Construct a residential subdivision located on Sewall Street.
The Hearing was opened and the applicant agreed to continue the hearing. M. Coakley motioned to accept the request for continuance; J. McGrath seconded; all agreed. It will be continued to June 15th at 7:30 p.m.
MARIO VILLANI – PUBLIC MEETING – Request for Determination of Applicability (510 Green Street) Create a pond measuring 40’x 80’.
Mr. Villani stated that the area is seasonally wet and not a stream. He proposes the depth of the pond to be 6’-8’. The matter was tabled until the June meeting so it can be determined whether the area is jurisdictional. A site visit is scheduled for Monday, June 1st at 5:30 p.m.
CELESTE FAY (19 Mill Road Circle) attended to express her concerns over work being conducted in what she believes is less than 100’ of a stream on Mill Road. A site visit will be needed before the June meeting. Mark Bertonassi (Building Inspector) will also follow up.

Vouchers were approved.
J. McGrath motioned to approve the Meeting Minutes dated April 21, 2009; M. Coakley seconded; all agreed.
Correspondence was reviewed.
M. Coakley motioned to adjourn the meeting; J. McGrath seconded; the Commission unanimously agreed. The meeting was adjourned at 8:35 p.m.
