REGULAR MEETING MINUTES
June 16, 2008

7:30 p.m.    SYLVAN REALTY TRUST PUBLIC HEARING (continued) – Notice of Intent & Stormwater Control Application – Sylvan Realty Trust – Stiles Road (Lots 1 & 2)
Construction of two single-family homes.

James Tetreault was in attendance and discussed the remaining action items from the last meeting concerning the drainage calculations (revised to call for a box culvert to be installed in place of the existing corrugated metal pipes), and the 3” diameter force main to be HDPE DR17 pipe.  There was also discussion on the language to be used for hazardous waste.  M. Coakley motioned to accept the email language submitted earlier; D. Duffy seconded; all agreed.  It will be Special Condition #31 on the Order.  D. Duffy motioned to include a deed restriction on Lot 1 to restrict the development to one dwelling as Special Condition #32; M. Coakley seconded; all agreed.  D. Duffy motioned to accept Special Condition #33 stating that if a septic system inspection identifies a problem that affects a wetland resource area, the Commission shall be notified within 48 hours of inspection and copied on the report to the Board of Health; C. Burkhardt seconded; all agreed.  M. Coakley motioned to close the Public Hearing; D. Duffy seconded; all agreed.  C. Burkhardt motioned to issue a standard Order of Conditions with Special Conditions #31, #32, #33; M. Coakley seconded; all agreed.

Stormwater Control Application – C. Burkhardt motioned to issue Stormwater Control Permit #2008-2; M. Coakley seconded; all agreed.

8:00 p.m.    RAND-WHITNEY PUBLIC HEARING (continued) – Notice of Intent & Stormwater Control Application – 160 Shrewsbury Street
Construct 411,650 sf office/manufacturing/warehouse building with associated driveways, parking areas and utilities.

Andrew Liston addressed issues from the Graves Engineering May 12, 2008 letter to the Planning Board. D. Duffy had concerns that the Operation & Maintenance was vague.  The Commission will require an acceptable Operation & Maintenance plan before issuance of a Certificate of Compliance.  Mr. Liston said that the four replication areas should be completed this week.  They are also trying to limit access to 2 and 4 wheelers with the possible use of boulders.  Special Conditions added will be: (#36) add sheet to the plans to incorporate SWPP, (#37) prior to installing treatment unit, the applicant shall supply documents certifying compliance with 80% TSS removal in a 1” storm, and (#38) an acceptable Operation & Maintenance plan will be required before the issuance of a Certificate of Compliance.  D. Duffy motioned to close the Public Hearing and Stormwater Control Bylaw Application Hearing; M. Coakley seconded; all agreed.  M. Coakley motioned to issue a standard Order of Conditions adding Special Conditions #36, #37, #38; C. Burkhardt seconded; all agreed.  C. Burkhardt motioned to issue Stormwater Control Permit #2008-3; M. Coakley seconded; all agreed.

8:30 p.m.    PUBLIC MEETING/HEARING – Request for Determination of Applicability and Stormwater Control Permit – Catherine & Steven Phillips – Shrewsbury Street (Map 17, Parcel 40)
Construct an industrial building approximately 7500 square feet.

Kevin Hardiman (Ross Associates) said that no information has changed regarding stormwater.  They go before the Planning Board July 7th.  Regarding the June 16, 2008 Graves Engineering letter, #13 – swales on site, meets DEP requirements.  #16 – erosion measures will be on the Operation & Maintenance plan.  Mr. Hardiman said that grades may change but the location of the stormwater features will remain the same.  C. Burkhardt motioned to include Special Condition (#21) applicant shall submit materials to show compliance with concerns raised in Graves Engineering review letter dated June 16, 2008, and (#22) applicant to provide revised Operation & Maintenance plan prior to start of construction; J. McGrath seconded; all agreed.  C. Burkhardt motioned to issue Stormwater Control Permit #2008-4 with Special Conditions added; J. McGrath seconded; all agreed.

8:45 p.m.    COMMISSION BUSINESS

Vouchers were approved.

D. Duffy motioned to approve the Meeting Minutes dated April 22, 2008 and May 19, 2008; W. Lonstein seconded; all agreed.  D. Duffy motioned to approve the June 2, 2008 Special Meeting Minutes with changes; W. Lonstein seconded; all agreed.

Correspondence was reviewed.

Fuller Motorhome Rental (Enforcement Order) – J. Walsh to follow up.

Redwood Circle (top soil depth) – M. Coakley to follow up.

Cyprian Keyes (site visit) – Not discussed tonight.

Consider issuing Certificate of Compliance for DEP #115-270 (Worcester Pistol & Rifle Club) 255 Sewall Street – After a site visit today, the Commission issued a Certificate of Compliance.

Joe McGrath – Stormwater – Not discussed tonight.

C. Burkhardt motioned to adjourn the meeting; D. Duffy seconded; the Commission unanimously agreed.  The meeting was adjourned at 9:10 p.m.
