REGULAR MEETING MINUTES
November 19, 2007

7:00 p.m. - STATUS REPORT – Rand-Whitney – Josh Brandt (Cutler Associates) and Nick Smith (Rand-Whitney) were in attendance. Mr. Brandt presented the Commission with the wetland report from Northeast Ecological Services regarding the wetland restoration. They would like to proceed immediately to remove the rock. Restoration will take place in the spring. An Enforcement Order was issued to keep the project separate from the Notice of Intent.
7:15 p.m. - PUBLIC MEETING – Town of Boylston Conservation Commission - To adopt Stormwater Regulations to be enacted under Boylston General Bylaws, Article VI, Section 9 – Stormwater Control Bylaw.
Joe McGrath, Emily Scerbo (Woodard & Curran) and Chip Burkhardt were attendance for the Stormwater Committee. Ms. Scerbo explained the Members comments and what she incorporated into the regulations. She refreshed definitions along with adding more depth, staying consistent with the stormwater policy. Thompson & Liston’s comments will be considered, but were not incorporated since they were received just a few days ago. Joe McGrath will provide a modified version before the next meeting. A final copy will be ready for the next meeting. It was discussed that applications should have guidelines for filing, an instruction checklist and applicable forms. Melanie to check on performance bond procedures. Setting up a separate account for the stormwater policy with
the same provisions as the wetland protection funds should also be considered. A request for continuance was made. M. Coakley motioned to accept the request for continuance; C. Burkhardt seconded; all agreed. It will be on the December 17th Agenda at 7:00 p.m.
7:30 p.m. - PUBLIC MEETING – Request for Determination of Applicability – Spring Garden (Cyprian Keyes) 284 E. Temple Street - Construct a 40’ x 30’ pole building to be used as a Callaway Performance Center.
Richard Zepp (Cyprian Keyes) was in attendance. He explained that the building will be put on the pavement. There will be no work in the buffer zone. M. Coakley motioned to issue a Negative Determination adding that hay bales be put at the limit of buffer zone work and an as-built plan be submitted after completion; C. Burkhardt seconded; all agreed.
David Humphrey – 742 Main Street came in for an informal discussion regarding the property. He needs a septic system and is within the riverfront area. He was told he would need to file a Notice of Intent.
7:45 p.m. - COMMISSION BUSINESS
Vouchers were approved.
Meeting Minutes dated October 15, 2007 were approved. Site Visit Minutes dated October 11, 2007 were approved with changes.
Correspondence was reviewed.
Consider issuing Certificates of Compliance for the following DEP File Numbers (requested by Cheryl Morrill (Harry Kotseas Law Office) :
DEP #115-98 Cross Street – A Certificate of Compliance could not be issued. No as-built plans were ever received nor any engineering plans stating that the work was completed according to plan.
DEP 115-79 Cross Street – A Certificate of Compliance could not be issued. No as-built plans were ever received nor any engineering plans stating that the work was completed according to plan.
DEP 115-54 Off Cross Street – A Certificate of Compliance was issued June 15, 1987, but a recorded copy was never received in the office. A letter will be written stating that one was issued and a copy will be provided.
DEP 115-181 Off Cross Street – A Certificate of Compliance was issued February 16, 1999 and recorded 99 March 2, Book 21107, Page 68.
Determination of Applicability for Lot 25Y Adams Street – According to Ms. Morrill, the Conditions were never recorded with the Determination. A letter will be written stating that Determination was recorded and the conditions have been completed to the satisfaction of the Commission.
Consider issuing Certificate of Compliance for DEP #115-150 (Jeffrey DeCiccio) 579 Central Street – M. Coakley motioned to issue a Certificate of Compliance; C. Burkhardt seconded; all agreed.
Discuss Banner Article Regarding Fuller Motorhome Rentals – A letter will be written to the Selectmen informing them that the Commission never received any request from them, any other board, or from Fuller Motorhome Rentals.
C. Burkhardt motioned to adjourn the meeting; M. Coakley seconded; the Commission unanimously agreed. The meeting was adjourned at 9:40 p.m.
