7:00 p.m. - PUBLIC HEARING (continued) – Notice of Intent – (Ron Aspero) – Map 38, Lot 24 Central Street (Lot 2-F)
Construct a portion of a single family dwelling, well, associated driveway and portion of driveway within the buffer zone.
Tim Paris (Connorstone Engineering) said that Natural Heritage is considering the project as a whole with Redwood Circle. Natural Heritage requested the backyard be tighter. Mr. Paris said that it was originally 30’-35’. It is now approximately 15’. The Commission has no material issues and is awaiting a response from Natural Heritage. The applicant requested a continuance. M. Coakley motioned to accept the request for continuance; J. Walsh seconded; the Commission unanimously agreed. It will be on the April 17, 2007 Agenda at 7:00 p.m.
7:15 p.m. - PUBLIC HEARING (continued) – Notice of Intent – (Ron Aspero) – 377/385 Central Street
Roadway construction for a four lot subdivision filling of 4,290 sq. ft. of wetland.
Paul McManus (EcoTec) updated the Commission. He said that the Commission has to wait for a response from Natural Heritage regarding rare wildlife habitat before issuing an Order of Conditions. He further commented that the revision date needs to be put on the plan, the plans were hard to understand, and he would recommend adding a comment that replication needs to be done in a no flow area (revise “low flow” to “no flow”) on the plan. Tim Paris (Connorstone) explained the existing and proposed plantings. He said he added notes regarding Conservation having the final decision as to what trees stays and/or get transplanted. Mr. McManus suggested changing “Conservation Commission” to “qualified professional”. Dan Duffy would like the
Commission to retain some control without accepting the responsibility. It was discussed having a pre-construction meeting once the site is mobilized and before any work begins. Ron Aspero said that replication and excavation would be performed simultaneously. Mr. Paris was asked about rain garden #2 elevations. He said he had data on #1 and #2 and the elevations are several feet below water level. Mr. McManus said the OEM language should say “shall” instead of “should”. He also gave the Members the DEP policy regarding BWV and banks. It tells the applicant and the Commission how to deal with thresholds. The applicant should be asked to quantify the bank. Mr. McManus also said that banks of intermittent streams are jurisdictional and should be on the NOI and evaluation done for the record, even though he does not see that any change will happen.
Mr. Aspero said that he had a meeting with the state and said that if he took the other lot out of the picture, they have no jurisdiction with Natural Heritage. Prior to October 1st, it was a separate legal building lot. He is working with the state. They asked if migration basins are proposed. Mr. Aspero said that there will be four. They also asked for wider headwalls. Mr. Aspero said they made a larger retaining wall and there is less impact on the wetlands. He further said he added more preserved woods. Concrete monuments will be placed every 100’.
Jeff Walsh briefly discussed the Army Corps. openness ratio concerning banks. Natural Heritage prefers a three-sided culvert rather than a box, which is what Mr. Paris is proposing. He said he is replicating the bank but also preserving part of it. The plans have been submitted to Natural Heritage.
The applicant requested a continuance. M. Coakley made a motion to accept the request for continuance; G. Desautels seconded; the Commission unanimously agreed. It will be on the April 17th Agenda at 7:05 p.m. The reduction for the project fee ($2,500 from $5,000) was not discussed.
7:30 p.m. - PUBLIC HEARING – Notice of Intent (Kalamat, LLC) – 81 Shrewsbury Street
Demolish existing house, driveway, etc., and construct a new building, parking, utilities, etc.
Kevin Quinn (Quinn Engineering) and Frank Tomaiolo (Kalamat, LLC) were present. Mr. Quinn said it is a proposed 8,000 sq. ft. commercial building. The bank will occupy part of it. The survey was conducted by Baystate Environmental Consultants. He said there is no BVW within 100’ of the site. No work is proposed in the resource area. Haybales and silt fencing will be installed. Stone tracking pads will also be used. They have been to two hearings with the Planning Board and are preparing a traffic study for them. They are working with Graves Engineering. Very little work in the buffer zone. Drainage goes into Spruce Pond. They have deep sump hooded basins. The Commission wants ESC measures to be in place between the water main tap and the
bank. The Commission also requested copies of Graves Engineering before issuing the Order of Conditions. In addition, the Commission wants to be notified of the pre-construction meeting (this would be a condition on the Order). The applicant requested a continuance; M. Coakley motioned to accept the request for continuance; D. Duffy seconded; the Commission unanimously agreed. It will be on the April 17th Agenda at 7:30 p.m.
7:45 p.m. - PUBLIC MEETING – Request for Determination of Applicability (Jon & Annette Miles) – 727 Main Street
Replace failing sewage system.
Steve Sears (David E. Ross Associates) was in attendance for the applicant. This is an upgrade. It has been designed up front for a better fit. ESC measures will be installed. M. Coakley motioned to issue a Negative Determination by reason #3; J. Walsh seconded; the Commission unanimously agreed.
8:00 p.m. - PUBLIC MEETING – Request for an Erosion & Sediment Control Permit (Ron Aspero) – 377 & 385 Central Street
Consider issuing permit to construct a five-lot subdivision.
Tim Paris said the ESC plan is on Sheet 3 of the Subdivision plan. There will be specific stockpiling areas. Rain gardens to be used as sediment control until stabilized. The Stormwater Control Bylaw does not apply to this project since it was filed before it took effect. The project will have to adhere to the previous Erosion & Sediment Control Bylaw. M. Coakley said that all information needs to be on the plan. This will be a condition on the Order. There should only be one plan. The applicant requested a continuance. M. Coakley made a motion to accept the request for continuance; C. Burkhardt seconded; the Commission unanimously agreed. It will be on the April 17th Agenda at 7:05 p.m.
Mr. Aspero asked if he could briefly discuss another issue (363 Mile Hill Road). He is presently framing a house. Haybales and silt fencing are in place. The owner inquired about constructing a garage. Mr. Aspero suggested that if it is going to be done, it should be done now before he closes the site. It will be where work is currently taking place. J. Walsh motioned to accept the applicant’s proposal to construct a barn foundation noting it is already in an area to be disturbed, therefore creating no additional impact to the resource area. Future requests require barn to be shown on as-built plans and all other necessary as-built plan features provided the barn is done during house construction; C. Burkhardt seconded; the Commission unanimously agreed. A copy
of the Minutes will be placed in the 363 Mile Hill Road file for future reference.

Consider issuing Certificate of Compliance for Jeffrey DeCiccio & Sharon Bryant, 579 Central Street (Lot 2), DEP 115-150 - No applicant or representative was in attendance.
Consider issuing Certificate of Compliance for Pleasant Hill Farms Subdivision Lot 30R (DEP 115-250) - No applicant or representative was in attendance.
Consider issuing Certificates of Compliance to Ron Aspero for Lot 3 School Street (DEP #115-301) and 489 Central Street (DEP #115-306) - Certificate of Compliance was not issued pending site visit.
Consider issuing Certificates of Compliance to Ken Sydow for 24 Boulder Way (DEP #115-240); 30 Boulder Way (DEP #115-238); 32 Boulder Way (DEP #115-239): 34 Boulder Way (DEP #115-242) and 36 Boulder Way (DEP #115-237) - Certificates of Compliance were not issued pending site visits.
There were discussions about the upcoming stormwater regulations. The Commission requested updated red-lined stormwater regulations once they become available. Chip will follow-up with Emily about making revisions. He will also email the office about posting a public hearing to adopt the regulations.
J. Walsh motioned to adjourn the meeting; D. Duffy seconded; the Commission unanimously agreed. The meeting was adjourned at 9:44 p.m.
