REGULAR MEETING MINUTES
February 13, 2007

7:00 p.m. - PUBLIC HEARING (continued) – Notice of Intent – (Ron Aspero) – Map 38, Lot 24 Central Street (Lot 2-F)
Construct a portion of a single family dwelling, well, associated driveway and portion of driveway within the buffer zone.
Site distances were briefly discussed. The location seems to be the best for the road and driveway placement. Tim Paris (Connorstone Engineering) was asked to supply the Commission with a copy of the information that was sent to the wetland scientist. To date, there has been no response from Natural Heritage.
The applicant requested a continuance. M. Coakley motioned to accept the request for continuance; J. Walsh seconded; the Commission unanimously agreed. It will be on the March 19, 2007 Agenda at 7:00 p.m.
7:15 p.m. - PUBLIC HEARING (continued) – Notice of Intent – (Ron Aspero) – 377/385 Central Street
Roadway construction for a four lot subdivision filling of 4,290 sq. ft. of wetland.
Ron Aspero and Tim Paris (Connorstone Engineering) were present. The Members in attendance were satisfied with the alternative analysis. The applicant filed for a 401 water quality permit. The outstanding issues from the last meeting have been met. The Planning Board requested comments from the Commission concerning the Homeowner’s Association and Maintenance Contract. More time was needed to review the document. It will be discussed in detail at the March meeting. The Commission talked about including a special condition to the Order of Conditions referencing the plan concerning deed restriction. The contract also needs to reference the stormwater management plan (#13e). #13 f&h need to be incorporated. J. Walsh would like to have documents finalized
earlier so that they can be reviewed by the Commission prior to the meeting. Mr. Paris said they are all set with the box culverts. J. Walsh explained the Army Corps. calculating methods (footage vs. meters). The applicant requested a continuance. D. Duffy made a motion to accept the request for continuance; M. Coakley seconded; the Commission unanimously agreed. It will be on the March 19th Agenda at 7:05 p.m. The reduction for the project fee ($2,500 from $5,000) was not discussed.

Correspondence was reviewed.
M. Coakley motioned to accept the Meeting Minutes of December 18, 2006; J. Walsh seconded; the Commission unanimously agreed. M. Coakley motioned to accept the Meeting Minutes of January 16, 2007 with changes noted; J. Walsh seconded; the Commission unanimously agreed.
Consider issuing Certificate of Compliance for Jeffrey DeCiccio & Sharon Bryant, 579 Central Street (Lot 2), DEP #115-150 – A letter was sent on January 4, 2007. No one attended the meeting tonight.
Consider issuing Certificate of Compliance for Pleasant Hill Farms Subdivision Lot 30R (DEP #115-250) – No representative showed. No action taken tonight.
Consider issuing Certificates of Compliance to Ron Aspero for Lot 3 School Street (DEP #115-301) and 489 Central Street (DEP #115-306) – D. Duffy will contact Mr. Aspero. Will be discussed at the March meeting.
Consider issuing Extension to Order of Conditions to Khalid Naseem for Lots 1C, 2C & 3C Stiles Road (DEP #115-235) - A letter will be written to Mr. Naseem denying the request to extend. The request was received in the office on January 29, 2007 (written January 23, 2007). It will reference the Act stating that it is required to be received by the Commission 30 days prior to the expiration.
M. Coakley motioned to extend the Order of Conditions for Mike Daly (Lot 6 Reservoir Street), DEP #115-266; D. Duffy seconded; the Commission unanimously agreed.
Ken Sydow attended at the Commission’s request (due to a complaint received from a resident) to discuss outstanding Orders of Conditions on 24, 30, 32, 34 and 36 Boulder Way. Partial Certificates of Compliance were issued for the septics. The wells were not put in. The Orders were issued in August of 2003 and have since expired. It was suggested that Mr. Sydow request Certificates of Compliance for them less the well work. M. Coakley did a site visit and suggested Mr. Sydow put in rip rap to catch the flow and do plantings. Mr. Sydow agreed. The Determination on file is valid as long as it is just for filling the potholes. With regard to the TLB on the property, Mr. Sydow said it is more than 100’ away from the water.
D. Duffy motioned to adjourn the meeting; G. Desautels seconded; the Commission unanimously agreed. The meeting was adjourned at 8:45 p.m.
