7:00 p.m.  - PUBLIC HEARING (continued) – Notice of Intent – (Ron Aspero) – Map 38, Lot 24 Central Street (Lot 2-F)
Construct a portion of a single family dwelling, well, associated driveway and portion of driveway within the buffer zone.

The applicant requested a continuance.  D. Duffy motioned to accept the request for continuance; J. Walsh seconded; the Commission unanimously agreed.  It will be on the February 13, 2007 Agenda at 7:00 p.m.

7:15 p.m.  - PUBLIC HEARING (continued) – Notice of Intent – (Ron Aspero) – 377/385 Central Street
Roadway construction for a four lot subdivision filling of 4,290 sq. ft. of wetland.

Ron Aspero, Tim Paris (Connorstone Engineering) and Paul McManus (EcoTec) were present.  Mr. Paris said they received the report from Graves and the Planning Board does not have any outstanding technical issues.  They are filing for a water quality permit to avoid a deed restriction.  He reviewed the alternative analysis report (copy in file) which included two new alternatives.  The maintenance plan will need to be looked at further.  Paul McManus (EcoTec) discussed the issue of the existing driveway.  He found that the driveway and culverts are down gradient and controlled by leaf dams and would not affect the hydrology.  He said the elevations on the original plan did not match the 40 scale plan.  Tim will check on this.  Regarding the replication area, he said the wetland should be moved only once and done when there is no water coming through.  He said that “marsh” terms are not the appropriate terms to use.  No sizes were mentioned with regard to woody vegetation.  There are red maples.  Have field flexibility on the plan and identify the trees beforehand.  The Homeowner’s Association would be responsible for water level management at the culvert.  Stormwater calculations regarding the referenced dry wells should be included on the plan.  Jeff Walsh’s concern is the sand issue (catching it quickly).   The applicant will revise the plan to include catch basins with 4-foot sumps in lieu a forebay.  Mr. Aspero would agree to no cut perimeter zones.  It would be on the deed and also included in the deeds for individual lots.  A special condition will need to be put on the Order of Conditions.  The Commission wants to be copied on the NPDES construction reports.  The applicant has filed with Natural Heritage.  They have 30 days to issue a decision.  The Commission has to accept the decision concerning rare wildlife habitat only.  If a decision is not reached after 30 days, the Commission is forced to make a decision based on the information provided.  The outstanding issues for the next meeting are:  revise wetland replication details, put dry wells on plan, add modified catch basin, and add marker (4 x 4 concrete posts) with 6” original mark on it.  The applicant requested a continuance.  D. Duffy made a motion to accept the request for continuance; M. Coakley seconded; the Commission unanimously agreed.  It will be on the February 13th Agenda at 7:15 p.m.  Briefly discussed was the project fee.  The applicant would like to reduce the original amount of $5,000.00 requested to $2,500.00.  This will be discussed at the next meeting.

8:00 p.m.  - PUBLIC HEARING – Notice of Intent – (Bernard Petkus) – 119 Nicholas Avenue
Replace failing cesspool with new sewage system and related grading.

Steve Sears (David E. Ross Associates) attended for the applicant.  Green cards were submitted.  He will call the office regarding the ad fee and will forward  it.  There was some discussion on features at the site.  The nearby stream is intermittent.  D. Duffy motioned to close the Public Hearing; J. Walsh seconded; the Commission unanimously agreed.  D. Duffy motioned to issue a standard Order of Conditions; J. Walsh seconded; the Commission unanimously agreed. 

Mr. Sears submitted a revised septic plan showing fewer impacts regarding Walter Swann (119 Green Street).  C. Burkhardt motioned to accept the amended plan; G. Hollands seconded; the Commission unanimously agreed.

8:15 p.m.  - DISCUSSION (Follow Up) – Stiles Crossing (DEP #115-258) – Enforcement Order Issues
Steven Kressler (attorney for applicant), Peter O’Connell (consultant for applicant), and Paul McManus (consultant for the Commission) were in attendance.  Mr. O’Connell provided an update of erosion control measures taken at the site.  Takes about eight days to siphon water from southern stormwater facility.

Mr. McManus’ issues – Lot 15 needed to be mulched – work has been done.  A swale created on Lot 14 to capture runoff from the cul-de-sac.

Berm in basin 1 seems to have made a big difference.  Mr. O’Connell said they would give the Commission 1-2 day notice when sediment is going to be removed from basin 1.  M. Coakley motioned to lift the Enforcement Order dated November 2, 2006; G. Hollands seconded; the Commission unanimously agreed.  M. Coakley motioned to lift the Erosion & Sediment Control Enforcement Order; J. Walsh seconded; the Commission unanimously agreed. 

8:30 p.m.  - COMMISSION BUSINESS

Vouchers were approved.

Correspondence was reviewed.

Review & approve Meeting Minutes dated 12/18/06 and any Site Visit Minutes – Will be reviewed at the February meeting.

Consider issuing a Certificate of Compliance for Jeffrey DeCiccio & Sharon Bryant, 579 Central Street (Lot 2), DEP 115-150 – Mr. DeCiccio started to explain that a disturbed area had been repaired.  M. Coakley explained the intent of a replication area and cited specific requirements on the approved plan.  Plants had been purchased from Bigelow’s per Mr. DeCiccio.  G. Hollands will visit the site tomorrow with the applicant.  No action taken tonight.

Consider issuing Certificates of Compliance for the following Pleasant Hill Farms Subdivision Lots:  Lot 5 – DEP 115-254 and Lot 30R – DEP 115-250:  (M. Coakley recused himself from the matter).  Dave Farrar (Marchionda Associates) attended for the applicant.  Regarding Lot 5 – Mr. Farrar gave the Members a copy of the recorded conservation easement for Lot 5 (and also Lot 30).  J. Walsh motioned to issue a Certificate of Compliance; D. Duffy seconded; the Commission unanimously agreed.  Regarding Lot 30 – The letter Mr. Farrar submitted concerning plantings and their ability to survive was discussed.  It lacked specific information relative to what type of soil depths were observed.  If plantings are to be the alternative, the Commission wants to know that there is enough soil for the plants to survive.  Mr. Marchionda said a plan will be submitted showing the test pits.  The Commission would like to see a plan signed, stamped and prepared by a suitably qualified professional. 

Longley Hill – Not discussed.

Stormwater Regulations – An informational meeting will be held on Monday, February 26th at 7:00 p.m.

D. Duffy motioned to adjourn the meeting; C. Burkhardt seconded; the Commission unanimously agreed.  The meeting was adjourned at 10:27 p.m.
