Board of Selectmen Minutes 2009/03/09
Date of Meeting:        Monday, March 9, 2009
Location:               Town Hall, 221 Main Street
Time:                   7:00  PM – 8:25 PM
Members Present:        Chairman James Stanton; Roger Deal; Ken Sydow
Others Present: Nancy Colbert, Town Administrator; Lori Esposito, Administrative Assistant; others as noted on sign-in sheet.

Town Counsel not present.

7:00 PM -- Assessors’ Office Update Re: Triboro Crane & Rigging:  Carl Cravedi/James Holyoak present to report on findings of business operating on Shrewsbury Street.
·       Most of the equipment on the property is not subject to a personal property tax.
·       They are only subject to tax on machinery used in the conduct of their business.
·       The generators are loaned out; machinery is registered, so is subject to excise tax.
·       Jim asked if they are registered in Boylston.  Carl said he doesn’t know, he would have to get plate numbers and run them.  But, if they trace the equipment as garaged somewhere else, okay not to register in Boylston.  If the registration says another town and they have insurance for that town, we can’t collect tax.
·       Ken told Carl to have Chief Sahagian run the plates, then find out where they are registered and go from there.
·       Roger asked if we can collect anything on the property for taxes. Carl said it should be being taxed presently but he can’t confirm that until he looks it up.  Roger asked him to also confirm whether it is being taxed properly.  Ken Sydow said it depends on where the vehicle/property is municipally garaged.  If here, we should be getting excise tax.  Carl stated that if the crane has tracks, it is not registered on the road and should be subject to personal property tax.

7:15 PM-- Don Parker, DPW Superintendent:
·       Roger inquired as to the status of the ice storm debris.  Don said we have been chipping a little; are waiting to hear what FEMA is doing.  Nancy said nothing has been decided yet by FEMA; supposed to have information last week but has not received it.
·       Don received a letter from Ellie Millard on Rocky Pond Road regarding his help last week with her fallen horse.  Brief discussion of episode held.
·       MOTION:  Ken made a motion to vote sand and salt budget overspending; motion seconded, voted All in Favor.
·       Don asked who is responsible for maintenance of the school grounds.  There is a collapsed catch basin in the Boylston Elementary School parking lot that needs to be fixed.  If there is a maintenance budget, then the Highway Department can charge it to the school after they fix it.    Nancy will check with School Superintendent Brian McDermott.
·       We need to get out of the oil contact with Assabet Valley Collaborative at $3.99/gallon.  Can we break or end the contract if we’ve met or exceeded our estimated gallons for the year?  Nancy will look into.
·       Compass Pointe – Don feels the developer should not be allowed to breach the dam.  Roger asked if there is any truth to the rumor that there is a $5M lien against the Compass Pointe property.  Don doesn’t know.
·       A brief discussion was held regarding continuing removal of brush from the ice storm.

7:40 PM – Building Inspector, Mark Bertonassi, Monthly Report to the Board:
·       Roger asked how does the amount of work being done compare to this time last year.
·       Mark said last year ten permits ($10K total) were issued versus eight ($3K total) this year.
·       Route 140 – Triboro Crane & Rigging.  Mark’s findings:  
o       Most of the equipment is junk/storage
o       Zoning bylaw allows a contractor yard
o       Equipment is either registered or rented out
o       We can tax the junk and maybe that will discourage the storage of it
·       Trench  permitting
o       Mark is the permitting authority
o       Nancy recommended a $20 fee for an application
o       MOTION:  Ken Sydow made a motion to charge a $20 fee; Roger Deal seconded the motion; voted All in Favor.
o       Asked Nancy about having Health Agent appointed as alternate agent.

Sign Request:    Permission granted for a sign to be put up at corner of 140/70 for BBRAVO High School musical to be held April 3, 4 and 5.  Voted all in favor.

Compass Pointe:  
·       Met with Water Department re: water line installation on Sewall St. / Compass Pointe
o       Water Department will supply the pipe, Venincasa will install it
o       Water Department will install line at the bridge (20 feet before and 20 feet after)
·       Subdivision approved September 2005 expires September 2010.
·       Ken said we will look to Nancy Colbert for review and recommendation, along with Town Counsel’s recommendation.
·       Nancy said the Planning Board needs to have everything, including decisions, in writing and put into their modified decision.  We need to have a vehicle to “memorialize” everything that can also be recorded.  Also, perhaps the road can be paved in a phase plan as the subdivision progresses.
·       Jim Venincasa said he doesn’t want to commit to something he’s not sure he can do. This plan he’s laying out now is financially feasible and he can commit to it.  The road hasn’t been paved in 25 years and he shouldn’t be responsible for the entire road after installing water lines for a sub-division.
·       Jim Stanton stated he would like something in writing from Town Counsel as to whether or not they are required to pave the road, based on what the Planning Board approved.
·       Ken Sydow said his understanding is that the Planning Board denied the plans that included the paving of the road; however, when it went to court and was re-decided, there were different plans that did not include a requirement to pave.

Upon motion made and seconded, the meeting was adjourned at 8:25 PM.
