Board of Selectmen Minutes 12/15/2008
Date of Meeting:        Monday, December 15, 2008

Time:                   6:30 PM –  8:30 PM
Members Present:        Chairman James Stanton;  Roger Deal; Ken Sydow
Others Present: Nancy Colbert, Town Administrator; Joseph Connelly, Interim Town Administrator;  Lori Esposito, Administrative Assistant; others as noted on sign-in sheet.

6:50 PM:  Report of the Interim Town Administrator.  
·       Joe Connelly advised of progress on the window replacement at the Town Hall, first floor.
·       A used pickup truck has been found for $18,000 for the Highway Dept.  Purchase requires Finance Committee Reserve Fund transfer of $15,000.
·       43D Grant Approval.  According to Adam Costa, Interagency Permitting Board is not meeting in January.  This could delay approval until February or March.
·       Do not have School Department FY’10 preliminary budget figures.  Presentation will be delayed until that part is received.  Possibly next week.
·       MCJTC Lease:  spoke with David Devine (DCAM) and is awaiting his counter-offer.

Police Chief Monthly Report to Board of Selectmen:
·       Reviewed monthly statistics
·       November 26 – former Mt. Pleasant employee charged with theft of over $500
·       December 9 – two house breaks on Pleasant Lane
·       December 16 – Poe Avenue case scheduled in court
·       New Level 3 sex offender working in Boylston (4 Main Street at sign shop [Rte 70]).  Lives in Worcester.
·       Court date scheduled for larceny investigation.  
·       Storm damage at Police station – phone, cable out.
·       Officer Shepard still out due to shoulder injury.
·       Dispatcher Collins still out on FMLA; calls in weekly; unknown return.

Jim Stanton thanked Tony, as well as all other departments and residents, for their help over the weekend with the ice storm.

Joe Flanagan (present) was thanked for his and his department’s help throughout the weekend also.

7:12 PM:  Propane Hearing:  Osterman Propane, installation of 3000-gal above-ground propane storage tanks on Mt. Pleasant property.
·       StephenMadaus:  Section 13, Chapter 140a – notice is required to abutters.  Mike O’Brien (Osterman)  provided certified returned receipts of abutter notifications.
·       Fire Chief is satisfied with his inspection of storage tank.
·       Mr. O’Brien – changed heat in building to all propane.  
o       1500-gal tank already on property; adding more storage since heat converted to propane;
o       Not a new installation, just adding storage which prompts license.
·       Motion made to approve; motion seconded; voted All in Favor.
·       Per Town Counsel, need to annually submit renewal of license to clerk.  Abutters can appeal to state Fire Marshall.


December 12 Ice Storm:
·       Chief Flanagan:  some surrounding communities are still without power (80 – 100%).  We’re in pretty good shape.  If wires were pulled off a house, resident needs to call an electrician.  
·       There will be no extension on open burning law; residential burning begins January 15, 2009 and goes to May 1, 2009.
·       DEP will grant municipalities burning permits.
·       Received FEMA preliminary damage forms – due this Wednesday, December 17.
·       Ken asked Don Parker about chipping roadside brush.  Can we bring in crews to help before snow falls?  How long might it take to get it done?  Don said we need to pay bills up front, even if reimbursable.  FEMA sets rates of reimbursement.  We can only charge our help against it if its overtime, not normal working hours.
·       Joe Flanagan said companies can charge what they want; FEMA will reimburse only a certain amount.  Roughly 75% is the average reimbursement.
·       Ken requested Nancy work with the DPW to get done what’s needed and get whatever help is necessary.
·       Jim:  possibly hire temporary help.  The Board would support whatever is necessary.

Used Truck Purchase:
Motion was made to authorize the purchase of a 2004 F350 Super Duty pickup truck, sum not to exceed $18,000, with $3,000 from Highway Department and $15,000 from Reserve Fund transfer. Motion seconded; voted All in Favor.

Stephen said the Board needs to approve the disposal of the existing used truck being replaced.

Nancy will have a disposal plan at the next meeting for that and any other trucks that might be surplus.

Eric Brose signed Reserve Fund Transfer and gave it to Joe Connelly.

At 7:56  PM on a motion made by Selectman Ken Sydow, and seconded by Roger Deal, the following roll call vote was recorded to go into Executive Session under MGL Chapter 39, §23B ¶ 3, to discuss collective bargaining; and MGL Chapter 39, §23B, ¶ 6, to consider purchase, etc., of real property:  James Stanton-yes, Roger Deal – yes, Ken Sydow -- yes.  The Board agreed they would reconvene only to adjourn.

Motion made to adjourn; motion seconded; voted All In Favor.

Meeting adjourned at 8:30 PM.
