BOLTON ZONING BOARD OF APPEALS
Minutes of Meeting
November 3, 2004 at 7:30 P.M.

Present:  Patrick Sullivan, Jake Foote, Charles Lord, Jackie Smith, Elaine Lucas (Town Counsel), Nat Tipton (Town Planner)
1.  Pondside Comprehensive Permit Hearing
Tipton explained that Gerard Ahearn was not able to attend the hearing due a commitment at work.  Sandy from Judith Nitsch working on the traffic report indicated they would not be able to complete their review and complete a review for another three weeks.  On motion made by Jake Foote, seconded by Patrick Sullivan, the Board agreed to continue the hearing on November 23rd at 6:30pm.  
2.  711-713 Main Street Special Permit Hearing
The Board agreed to hold a hearing on December 8th at 7:30pm for a special permit application submitted by James and Noelle Drewicz seeking the alternation of pre-existing non-conforming uses and structures pursuant to Zoning Bylaw §2.1.3.3.
3.  Executive Session:  Bolton Manor
Charles Lord recused himself from this discussion.
At 8:05PM, pursuant to the M.G.L. c. 39, 23B§ of the Open Meeting Law, the Board on a Roll Call vote agreed to enter executive session to discuss strategy with respect to litigation if an open meeting may have a detrimental effect on the litigating position of the Town.  Vote:  3-0  (Patrick Sullivan, Jake Foote, Jackie Smith).  
At 8:40PM, the Board on a Roll Call vote agreed to exit executive session.
On a motion made by Jake Foote, seconded by Jackie Smith, the Board agreed to authorize the filing of the agreement to the Housing Appeals Committee.  Vote: 3 -0  (Patrick Sullivan, Jake Foote, Jackie Smith).
