Members present: Mary Ciummo (Chair), Leslie Breeze, Rob Hagopian, Barbara Bing, Deborah Kellett, Peter Ross, Tom Kittler

The meeting was called to order by Mary at 7:05
Minutes from the February 24 meeting were accepted with revisions.

New Business:  
Fence Bylaw:  We discussed ideas for our meeting this evening with the Planning Board regarding our proposed warrant article.
  • We continue to be uncertain as to whether it should be considered as a zoning bylaw or an administrative bylaw.  Need clarification and guidance from the Planning Board.
  • We want it in a form where our goals/intents are best met.
  • Mary will email Don Lowe to see if he has gotten an opinion on this from town counsel.
Follow-up:
Houghton Farms development (following up on 2/24 Planning Board meeting):
  • We had thought that pathways were required within a development.  Apparently they are not.
  • Do we have to create a law/rule that requires them, as well as for pathways along main roads bordering the development?  Need for making changes in the rules and regs.:  something that spells if out, so that the Planning Board’s job would then be to see that the rules are conformed to.
  • Should plan to talk with Jennifer Burney about strategies.
We suspended our meeting to attend the Planning Board meeting at 7:35.

Planning Board meeting:
  • They recommended changes to the proposed bylaw and wanted us to include diagrams.
  • They suggested that we talk with property owners about problem intersections prior to town meeting, to avoid an awkward situation at the meeting.
  • Need for clarity from town counsel on provision #5 (remedies and “further action”)
  • We should try to meet with the Selectmen before the public hearing scheduled for March 24th – two weeks from tonight.
PWSC meeting continued:
  • We need to meet with BOS; their meeting is tomorrow night (March 11).  Mary will call Linda Day to try to get on their agenda.
  • We agreed that it is best to let the Selectmen be the first point of contact when a citizen is concerned about an intersection; up to citizen to take a concern to the BOS.  We advise/make recommendations.  BOS may choose to send an issue directly to the DPW or police.
  • Peter will incorporate modifications to the proposed bylaw, as recommended by the Planning Board and then send to members of BOS.
  • Use easements to determines restricted areas in #3
  • Add “within restricted areas” to #4
  • Include diagrams
  • Add “commercial driveway” to #1
  • Add “or historic structures” to #3
Action Items:
1.  Mary will contact Linda Day about getting a place on the agenda for the March 11 Selectmen’s meeting.
2.  Mary will ask the Selectmen if we can talk independently with town counsel
3.  Peter will incorporate modifications to the proposed bylaw (including diagrams), as suggested by the Planning Board and approved tonight by PWSC.

The meeting was adjourned at 8:48 p.m.
The next meeting is scheduled for 7:30 on Wednesday, March 24, 2010, at the Bolton Public Library, for a public hearing on the town meeting warrant articles
