BOLTON PLANNING BOARD
Minutes of Meeting
December 8, 2004 at 7:30 P.M.

Present:  Lawrence Delaney, Russell Karlstad, Frank Lazgin, Douglas Storey, Stephen Garner (Associate Member), Betsy Cussen (Town Clerk)

ADMINISTRATIVE BUSINESS
1.  Choose Date for Subdivision Rate Hearing
The Planning Board is proposing revisions to the subdivision rules and regulations as well as the current fees that are collection.  A public hearing will be scheduled for January 12, 2005 at 8:45 pm.

2.  Review 11/10/04 Minutes
The meeting minutes of November 10, 2004 were reviewed and approved.  A final copy will be proofed at the next meeting for signature.  

3.  Set Process for Review of Other Minutes (March - September 2004)
Meeting minutes for March 2004 through September 2004 will be available for review by the Board at the next meeting on January 12, 2005.  

SCHEDULED ACTION ITEMS
4.  Bob Moss/Review Harvard Road Backland Lot and Common Driveway Decisions
Present:  Bob Moss
Mr. Moss came before the board for approval of a backland lot and common driveway.  The Bolton Conservation Commission would like the drainage downsized.  Plans are being drawn with the requested revisions to the drainage basins.  The Conservation Commission also wants the open space left in perpetuity.  Mr. Moss is proposing either deeding the open space to the town or a homeowners' restriction with a 30 year restriction.  Mr. Moss' proposal would be along lines of the type of restriction that is presently on the property.  The delineation of the open space line may change if it is deeded to town, due to possible connectivity with other Town owned parcels. After discussion, it was decided to reopen the hearing on January 12, 2005 at 7:45pm.  The hearing will be advertised as a reopening of hearing.

5.  ANR Plan Filed By Larry Ducharme - Lot 36 Northwoods Estates (Frontage on Harvard Road)
Present:  Larry Ducharme
Mr. Ducharme came before the Board to discuss dividing Lot 36, Northwoods Estates into two parcels for ease of figuring out rollback taxes.  After discussion, the Board voted to unanimously to accept Mr. Ducharme's proposal.  Plan of Land Bolton, MA prepared for Brandon Ducharme, 401 Harvard Rd, Bolton prepared by Ducharme and Wheeler, 1092 Main Street, Bolton MA 01740.

OTHER BUSINESS
6.  Andy Bendetson - Proposed Century Mill Estates Project
Mr. Bendenson came before the board to discuss the proposed development, Century Mill Estates.  Since our Rate of Development Bylaw changed, Mr. Bendenson's options have changed.  It is possible to make the development smaller.  Mr. Bendenson is now leaning toward subdivision under the current bylaws or possibly a FOSPRD.  The Board wanted to make sure he was doing this voluntarily.  A new plan would incorporate old ideas and would not maximize the amount of houses.  Currently, there are percs for 55 lots on approximately half of the land.  Mr. Bendenson is assuming, with high degree of reliability, that he can perc an additional 15 house lots on the remaining 100 acres.  Mr. Bendetson is planning to develop between 70-80 lots.  

7.  Request for Quail Run Bond Release
Vin Gately is requesting a release of the money being held by the Town for Quail Run.  After discussion, the Board voted to release the funds pending receipt of the deed by the Town.
