BOARD OF HEALTH MINUTES
Meeting Held at the Houghton Building on March 13, 2012 at 6:30 PM
Members Present:        Christopher Slade, Chair and Christopher Rogers, Member
Not Present:            Laura Andrews, Clerk
Also Present:   Bill Brookings, Health Agent, Nashoba Associated Boards of Health and
                        Michelle Carlisle, Health and Permitting Assistant

Call to order:    6:38pm

Minutes reviewed for 2/28/12:
  • C. Rogers moved to approve the minutes of 2/28/12, C. Slade 2nd. All in favor 2/0.
Mail Reviewed:

Action/Discussion:
  • 326 Still River Rd., - complaint regarding the abandoned house.
  • Mr. Dan Senie came before the Board to state that the home is empty and there is various debris scattered about the lawn including trash and a mattress.
  • Unsure who the owners are. Power is on.
  • Harold Brown, along with the police, entered the house when there was a sound of running water.
  • M. Carlisle to try and find out who the owner of record is.
  • 305 Wattaquadock Hill Rd., Donald Perham – failed system.
  • C. Rogers explained that an escrow account was setup several years ago to pay for a new system. Property is currently condemned and empty. Attorney Victor Bass, who represented Donald Perham, has sent a letter asking to dissolve the escrow account.
  • C. Slade will contact Attorney Bass to inquire as to where the money will go since the property needs a new septic system if someone wants to purchase the property and move in.
  • M. Carlisle to put on next agenda and find out who the owner of record is.
  • 25/27 Forbush Mill Rd., Nashoba Valley RE – abandoned well.
  • B. Brookings explained that there is an existing well in use and an abandoned one. Board would like to know what is being done with the abandoned well.
  • M. Carlisle to send letter.
  • 22 Woobly Rd., Kula – distribution box replaced without a permit by an unlicensed installer.
  • B. Brookings explained that Larry Favreau installed a distribution box without pulling a permit from NABH and without a license.
  • Larry Favreau has since pulled a permit with NABH and Board has approved.
  • M. Carlisle to send letter.
  • Shared systems on Harvard Road and Main Street.
  • 248 Harvard Rd. owes money toward the shared system escrow.
  • C. Rogers asked what the Board’s recourse is. M. Carlisle stated that the agreement stipulates legal action.
  • M. Carlisle to contact Town Counsel.
  • M. Carlisle asked the Board if they want letters sent to the other shared system property owners who still owe money toward the escrow account. Board said yes.
  • M. Carlisle to send request for payment.
  • Shared systems for Century Mill Estates.
  • C. Rogers stated that he believes there is a stipulation in the Hallmark Project where a portion of the sales of the home goes into the escrow account for the shared systems.
  • B. Brookings to do some research.
Building Permits Reviewed:
  • 3 Vaughn Hill Rd., Mazzola – addition to detached garage. Bill signed 2/28/12.
  • 39 Butternut Lane, Kimball – basement remodel. Bill signed 3/6/12.
  • 31 and 33 Sunset Ridge Lane – new condos. Bill reviewed and signed at the meeting, 3/13/12.
Septic Permits Reviewed:
  • 5 Manor Rd., Rogers – Distribution Box permit. Board approved.
  • 608 Main St., Bickford – Distribution Box permit. Board approved.
Inspections reviewed:
  • 4 Mt. Wachusett Lane, Kicklighter – Title 5. Board Approved.
  • 82 Teele Road, HSBC – Title 5. Power now turned on. Requires new Title 5 six months after occupancy.
  • M. Carlisle to send letter.
  • 16 Rocky Dundee Rd., Kennedy – Title 5. Board Approved.
  • 121 Wattaquadock Hill Rd., Barry – Title 5. Failed system.
  • M. Carlisle to send a letter.
  • 608 Main St., Bickford – Title 5. Conditional pass. Requires a new distribution Box.
  • 32 Farm Rd., Karey – Title 5. Board approved.
7:00 – 7:15 p.m.       Joan Barry, 121 Wattaquadock Hill Rd. came in at 6:30pm to drop off a check.
  • Bill Brookings reviewed the plan with the Board.
  • Long sewer line required deed restriction for annual inspection by homeowner.
  • M. Carlisle to send letter.
Bill Brookings attended a seminar today. In this seminar he learned that current items reviewed by DEP under Title 5, will be moved to the local level.
  • Board discussed how to have an engineer review these plans. C. Slade stated he would bring up the idea of having NABH coordinate that at the Executive Committee meeting Thursday night. Cost would go to the applicant.
C. Rogers moved to adjourn the Board of Health meeting at 7:51pm, C. Slade 2nd. All in favor 2/0.
