BOARD OF HEALTH MINUTES
Meeting Held at the Florence Sawyer School Conference Room on January 10, 2012 at 6:30 PM
Members Present:        Christopher Slade, Chair, Christopher Rogers, Member and Laura Andrews, Clerk
Also Present:   Bill Brookings, Health Agent, Nashoba Associated Boards of Health and
                        Michelle Carlisle, Health and Permitting Assistant

Call to order:   6:33pm

Mr. Balco informed the Chair that he was recording the meeting.

Minutes reviewed for 12/13/11:
  • L. Andrews moved to approve the minutes of 12/13/11, C. Rogers 2nd. All in favor 3/0.
Mail Reviewed:
  • C. Slade stated that he received a letter from Mr. Caviness at 556 Main Street stating that the old well is disconnected and the lally columns are up as a barricade between the driveway and the well.
  • Mr. Sullivan from Mike Sullivan Well Drilling, Co. appeared at the meeting and stated that Mr. Caviness may keep the well instead of destroying it. He’ll let the Board know.
Action/Discussion:
  • Set meeting dates through June 2012. Board reviewed and approved.
  • 103 Kettle Hole Rd., Hills – well variance.
  • Mr. Sullivan stated that they don’t have a plan yet. But Mr. Hills need to dig a new well because he’s running out of water when his neighbors water their lawns.
  • B. Brookings stated that the lot lines need to be staked.
  • C. Slade stated that since it’s a deep rock aquifer he wouldn’t have a problem being less than 150’ from the septic in 2mins per inch soil. Doesn’t affect the neighbors, so less than 50’ is ok.
  • Board requires a plan before making any decisions.
  • 192 Hudson Road, Jurnak – no Certificate of Compliance (COC).
  • House is complete but not sure if the house is occupied.
  • M. Carlisle to check with Mike and send letter for COC.
  • 320 Hudson Road, Barton – 3 bedroom septic permit vs. 4 bedroom house.
  • Mr. Barton appeared before the Board. He stated that the house is a 4 bedroom house and has been since he bought it in 1980.
  • B. Brookings stated that the permit and plan on file is for a 3 bedroom. Plan was updated to 4 trenches for a 4 bedroom system, but a final as-built was never given to the Board. Therefore, unsure if there are actually 3 or 4 trenches. The 3 trenches could be longer and deeper to accommodate a 4 bedroom system, but more investigating needs to be done.
  • C. Slade asked if the homeowner can update the system to a 4 bedroom. B. Brookings stated that he could but then the system will need to be updated to the current code.
  • C. Slade stated that unfortunately the current code ties our hands since there is no record that the system is for 4 bedrooms.
  • Remote participation in Board Meetings.
  • C. Rogers - no objections.
  • L. Andrews - gives her an opportunity to participate when she’s traveling.
  • C. Slade - no objections.
  • 48 Hudson Rd., McKinley - recommend water test.
  • Rebuild after house had burned down.
  • B. Brookings recommends a water test. Board agreed.
  • M. Carlisle to send letter.
  • Doggie Daycare proposal at the Salt Box.
  • B. Brookings stated Board needs detailed use of the building, proposal for disposal of waste, if floor drains are being used and if so, are they in compliance with DEP UIC regulations, is this a kennel.
  • Most important issue is that the system in question is in failure.
  • B. Brookings stated they are a pre-existing non-conforming Public Water Supply. DEP told BB that if it’s a similar use, DEP would approve.
Building Permits Reviewed:
  • 277 Main St., Shankle – sunporch. Bill signed 12-9-11.
  • 53 Fox Run Rd., Philips – finish room over garage. Bill signed 12/20/11.
  • 426 Main St., Marcus – remove roof and replace. Bill signed 12/20/11.
Septic Permits Reviewed:
  • 279 Long Hill Road, Patterson – extension request for expired permit. Permit Extension Act.
  • B. Brookings states that he does qualify for an extension under this act.
  • B. Brookings to put through the extension.
Inspections reviewed:
  • 26 Twin Maple Rd., Sullivan – Title 5. Board approved.
  • 119 Wilder Rd., Banik – Title 5. Additional information required. Water test and COC. M. Carlisle to send letter.
  • 115 Wilder Rd., Ward – Title 5. Board approved.
  • B. Brookings stated that Mr. Coolidge is ready for re-inspection at 168 Berlin Road.
  • B. Brookings also stated that we are missing information for 212 Berlin Rd. M. Carlisle to send letter.
  • C. Slade stated he will do Annual Report.
  • C. Slade stated that he spoke with the Town Nurse and asked if we had a program to help people who have become mentally distraught and do things to harm themselves or others. Nurse stated no. After discussion with the Board, C. Slade will check into potential programs.
  • Mr. Churchill of 24 Wheeler Road appeared before the Board regarding a building application for an addition. Back in July of 2001, the previous owner proposed a similar addition. At that time, the Board requested a Title 5 Inspection. The addition was never built and a Title 5 Inspection was never done. A Title 5 was done when the Churchill’s purchased the property in 2003.
  • C. Rogers stated that personally he would have one done, just to make sure the system can handle the addition.
  • Board approved and B. Brookings signed the building application.
  • B. Brookings stated that he heard the entire Bemis property has been sold. Several things will need to be taken care of by the new owners. M. Carlisle to check with the assessor’s office.
L. Andrews moved to adjourn the Board of Health meeting at 7:22pm, C. Rogers 2nd. All in favor 3/0.
