BOARD OF HEALTH MINUTES
Meeting Held at Town Hall on February 22, 2011 at 6:00 PM

Also Present:   Bill Brookings, Health Agent, Nashoba Associated Boards of Health and
                        Michelle Carlisle, Health and Permitting Assistant

Call to order:  6:15pm

Minutes reviewed for 2/8/11:
  • M. Carlisle to ask Carol Gumbart, Conservation Administrator, what the outcome of the Burnham Road Hearing was.
  • C. Rogers moved to approve the minutes of 2/8/11, L. Andrews 2nd. All in favor.
Mail Reviewed:

Action/Discussion:
  • Board signed previously approved Trash Hauler’s License for Mitrano Removal Services LLC.
  • New Building permit application submitted by C. Rogers for 68-70 Spectacle Hill. Adding an 8X10 shed addition for a waiting area for customers. No flow change. Board signed off.
  • Board discussed potential changes to their regulations.
  • Shared System Request withdrawals – Century Mill Estates lots 45, 46 & 48, Kendall Homes lots 17 & 17A Drumlin Hill Road. Board discussed reasons why.
  • Groundwater Season.
  • L. Andrews moved that the dates of the groundwater season be March 15, 2011 to April 15, 2011, C. Rogers 2nd. All in favor.
  • L. Andrews moved that the groundwater offset be 5 feet, C. Rogers 2nd. All in favor.
  • Antimony, 40 Forbush Mill Road – new construction. VOC test done in September 2008 of the well water came back clean. Well water tested again recently, much more comprehensive, and the level of Antimony came back very high. Test lab is not certified. B. Brookings and Board require another test by a certified lab.
Building Permits Reviewed:
  • 24 Hudson Road – Finish space above garage. Bill signed 2/10/11.
Septic Permits Reviewed:
  • 575 Sugar Road D-Box Permit. D-Box replaced. Board signed permit.
  • Harold Smith, Harvard Road, Lot 3. Variance free. Long sewer line – 200 feet. Board requires Inspection by Homeowner. M. Carlisle to send letter and form.
Title V inspections reviewed:
  • 16 Century Mill Road – incorrect date. M. Carlisle to send letter requesting new report with correct date.
7:00PM Variance Request Public Hearing – Chris MacKenzie, Whitman & Bingham, Lot 3 Century Mill Road
  • Chris MacKenzie appeared before the Board along with his client, MJ PS, LLC, and their attorney, Joe Boynton and reviewed the variances requested from Bolton Board of Health Regulation 5: Distances – minimum distance between a well and wetland is 100 feet – proposing 26 feet; Regulation 13: Hydraulic Overloading – minimum distance between septic systems servicing separate buildings or facilities is 100 feet, proposing 60 feet and 64 feet.
  • Also requesting variances from the Bolton Board of Health Well Regulation 4.1(1): Well location requirements – minimum distance between a well and a wetland area is 100 feet, proposing 26 feet and the minimum distance between a well and an easement is 50 feet, proposing 44 feet.
  • C. Slade asked B. Brookings and Chris MacKenzie to inform the board of the additional variance request from Reg. 12: Alternate Systems. In addition, the use of the Infiltrators requires that the proposed system be increased. The design as it stands now, is insufficient.
  • Chris MacKenzie stated that due to what DEP stated and the Infiltrator manufacturer stated, they would go back to a traditional system and therefore they would not need the variance to regulation 12. B. Brookings stated that if they keep the FAST system for nitrogen reduction, then they still need a variance to regulation 12. C. MacKenzie stated that he doesn’t believe a FAST system is needed.
  • C. Slade stated that he believes the FAST system is a very good idea and would like to see it.
  • Discussion regarding whether to notify abutters about a continued hearing date or not.
  • Discussion regarding whether or not a variance to regulation 12 applies.
  • Attorney Joe Boynton submitted supporting documentation for this project.
  • Chris MacKenzie will redesign the system to a conventional system but they will keep the FAST system in place.
  • Hearing will be continued to March 22, 2011. Abutters will be renotified.
  • M. Carlisle to write letter.
Discussion regarding mosquito control and whether or not to join the Central Mass Mosquito Control Project.
