BOARD OF HEALTH MINUTES
Meeting Held at Town Hall on November 23, 2010 at 6:30 PM

Call to order: 6:30pm
Minutes reviewed for 10/26/10
- L. Andrews moved to approve the minutes of 10/26/10 w/ the addition of Christopher Rogers as being present, C. Rogers 2nd. All in favor.
Action/Discussion:
- C. Rogers asked for an update on the two hearings. Discussion regarding the several variance requests for 58 East End Road.
- New building permit for AT&T wireless tower to add equipment to an already existing tower and an equipment shelter. Board reviewed plans.
- C. Slade – if there is no flow rate, we don’t have a problem.
- 88 Drumlin Hill Road, new building permit application – finish a basement.
- Brings room count over the 5 bedroom septic. Requires a Deed Restriction.
- M. Carlisle to forward to property owner for Deed Restriction to be recorded.
- Landfill monitoring wells – approval to test. Board approves to test. M. Carlisle to notify Joel Frisch.
- Harvard Road shared system – 244 Harvard Rd. Mr. & Mrs. Black sold the house to Mr. & Mrs. Holloway in August of 2007.
- M. Carlisle to send letter to new owners requesting payment.
- 248 Harvard Road shared system – owner unable to pay.
- Discussion regarding a potential lien on the house. Winona and Dorothy are elderly and currently own the property. Dorothy is currently in a nursing home.
Building Permits Reviewed:
- 15 Wattaquadock Hill Rd. – Road sign for Public Safety building. Bill signed 10/29/10.
- 48 Hudson Road – Rebuild house after fire. Bill signed on 11/9/10.
7:00PM Variance Request Public Hearing – Lot 1 Vaughn Hill Road
- Scott Hayes, Foresite Engineering – variance request to Board of Health Regulation 3: Groundwater Elevation.
- S. Hayes reviewed plan with the Board. New construction.
- William Allen, abutter, asked what the purpose of the hearing is. C. Rogers stated that the current regulations will be changed in the future and Regulation 3 will be changed to a new way of measuring high water.
- W. Allen asked the board if the plan meets all other regulations. C. Slade stated that since Title 5 came out, abutting property owners are very well protected.
- L. Andrews moved to approve the variance request as presented, C. Rogers 2nd. All in favor.
7:15pm Variance Request Public Hearing – 58 East End Road
- Scott Hayes, Foresite Engineering – variance request to 310 CMR 15.000 State Environmental Code, Title 5, section 15.405(i) Contents of Local Upgrade Approval and Board of Health Regulations 2: Reserve Area, Regulation 3: Groundwater Elevation, Regulation 4a: Percolation Test, Regulation 5: Distances, Regulation 10: Locus Maps and Regulation 12: Alternative Systems.
- S. Hayes presented an updated variance request letter.
- S. Hayes reviewed the plan with the Board. Existing house. System in failure, no break-out.
- Board reviewed each variance request.
- B. Brookings – on an upgrade, this is the best possible design. Board requires an inspection two years after installation for Cultec systems.
- C. Rogers – how many do we have in town. B. Brookings – less than 5.
- L. Andrews moved to approve the variances as presented and the updated variance request letter with the condition that a Title 5 inspection be performed two years after installation, C. Rogers 2nd. All in favor.
Title V inspections reviewed:
- 59 Bolton Woods Way – approved.
- 56 Century Mill Road – has a garbage grinder. M. Carlisle to send letter to have it removed.
- 179 Main Street – approved.
- 999 Main Street – approved.
- 256 W. Berlin Road – approved.
- 163 Kettlehole Road – approved.
- 103 Harvard Road – approved.
Septic Permits Reviewed:
- 24 Hudson Road, Ryan – Septic tank and pump chamber permit.
- Existing home. Wants to finish an area above the existing garage and tie the building into the existing system. Meets the 4 bedroom system.
- Lot 2 Rocky Dundee Rd. – permit extension request. No information.
- 7 Nourse Road, Jack Sargent – Septic tank permit. No information.
- Smith, Lot 2, 272 Harvard Road – Septic permit/new system.
- Existing 4 bedroom house. Destroying existing system and installing a new one.
- Variance free but requires an annual inspection by either the homeowner of an inspector.
- Board approved inspection by homeowner. M. Carlisle to send letter.
- Spedden, Lot 4 Annie Moore Road – new lot permit. Requires a variance hearing.
- 294 Vaughn Hill Road – D box permit. Signed by board.
- Old Stone LLC, Spectacle Hill Road, Lots 22A & 45A – new lot permits.
- Lot 22A - new plans designed for a single lot with an oversized system to obtain a building permit. Once shared systems are approved, lots will be divided and another home will be built and share the oversized system.
- Lot 45A – new plans, redesigned a new system and old system probably will not be used.
Discussion regarding future meeting dates. January – June, schedule every 2nd and 4th Tuesday.
Change meeting time for December 14th to 6:00pm. Cancel 12/28/10 meeting. If something arises, the Board can schedule a meeting.
L. Andrews motioned to adjourn at 7:53pm, C. Rogers 2nd. All in favor.
