BOARD OF HEALTH MINUTES
Meeting Held at Town Hall on October 26, 2010 at 6:30 PM
Members Present:        Christopher Slade, Chair, Laura Andrews, Clerk and Christopher Rogers, Member
Also Present:   Bill Brookings, Health Agent, Nashoba Associated Boards of Health and
                        Michelle Carlisle, Health and Permitting Assistant

Call to order: 6:37pm

Minutes reviewed for 10/12/10
  • L. Andrews moved to approve the minutes from 10/12/10, C. Slade 2nd. All in favor.
Action/Discussion:
  • Budget Review for FY12 – C. Slade asked who put the Mosquito Spraying on the warrant. C. Rogers stated that the decision was made outside of this board. L. Andrews stated Don Lowe, Town Administrator and the Board of Selectmen had it put on the warrant.
  • C. Slade - what discussion should take place. L. Andrews stated she would take the lead as a toxicologist to explain to the residents about the possible toxicity if any.
  • C. Slade wants to do due diligence and research before the board decides if they support joining the CMMCP.
  • C. Slade - have talks in December with the CMMCP to find out what is in the spray mix so L. Andrews can give an objective statement regarding the spraying.
  • C. Slade wants to find out how effective it is and what it will cost. Research first and then have a public hearing.
  • M. Carlisle to contact CMMCP and invite them to our first meeting in December.
  • 14 Harris Farm Road – board received documentation stating that the condensation from the air conditioning unit is no longer discharging into the septic system. M. Carlisle to send email to Bob Frechette letting him know the board is ok.
  • 694 Main Street – Geothermal wells. B. Brookings stated that there are 4 bore holes completed and they meet DEP guidelines. C. Slade -do we agree that this is not a well as defined by the Bolton Board of Health Well Regulations and therefore a variance is not required. All ok. M. Carlisle to send letter.
Building Permits Reviewed:
  • 46 Meadow Rd. – 12’X14’ detached screen porch. Bill signed 10/8/10.
  • 158 Kettle Hole Rd. – interior work. Bill signed 10/8/10.
  • 163 Sugar Rd. – finish rm. over garage, 8 rms., 4 bd. SDS. Bill signed 10/8/10.
  • 248 Sugar Rd. – finish rm. over garage, no plumbing. Bill signed 10/8/10.
7:00PM Variance Request Public Hearing – Ducharme & Dillis, Lot 10 Wattaquadock Hill Rd.
  • Brandon Ducharme presented new plans for a Presby system which is very large. Property has a very steep slope and you can tilt a Presby bed.
  • Requesting variance from Bolton BOH Regulation 3: Groundwater Elevation and Regulation 4a: Percolation Test.
  • Audience member asked what a Presby system is. C. Slade explained.
  • B. Ducharme explained that a Presby system requires and annual inspection.
  • B. Brookings stated that the new code requires inspection ports in a conventional system.
  • L. Andrews motioned to accept variances as presented, C. Rogers 2nd. All in favor.
  • M. Carlisle to send letter.
Title V inspections reviewed:
  • 220 Main Street – review sketch requested. Board reviewed and approved. M. Carlisle to send letter
  • 426 South Bolton Rd. – review room layout requested. Board reviewed the room layout sent by the property owner. Board requires a 4 bedroom deed restriction. M. Carlisle to send letter.
  • 56 Burnham Road – letter regarding Title 5 Inspection Report. New well was installed and water quality test was done. Board approves. M. Carlisle to send letter.
  • 69 Bolton Woods Way – approved.
  • 19 Woobly Road – requires clarification re: “seasonal use”. M. Carlisle to send letter.
  • 36 East End Road – re-review of a previous report. Board required a Presby Inspection be done. Report was submitted and board approves. M. Carlisle to send letter.
Septic Permits Reviewed:
  • Dixon, Bare Hill Road – Permit Extension request. Original approved in October 2007 and will expire in October 2010. Asking for a one year extension. Board ok.
  • 239 Vaughn Hill Road – D Box permit.
  • 24 Hudson Road, Ryan – Septic tank and pump chamber permit. Not reviewed yet.
  • Lot 2 Rocky Dundee Rd. – permit extension request. No information yet.
  • 7 Nourse Road, Jack Sargent – Septic tank permit. No information yet.
7:15pm Variance Request Public Hearing – Ducharme & Dillis, 401 Harvard  Rd.
  • Brandon Ducharme presented plans for a new system. Current system is in failure.
  • Requesting a variance from Bolton BOH Regulation 3: Groundwater Elevation and  Regulation 4: Percolation Test.
  • Wants to install a Presby system and increase the current flow.
  • Possibly looking into a detached in-law, therefore wants to install a new system that will allow for that in the future.
  • Looking for a 4 foot offset instead of 5 foot. 2 percolation tests instead of 4 (which is in compliance with Title 5)
  • C. Slade asked what the percolation rate is. B. Ducharme stated 21 min perc in one area, and 13 min perc in another.
  • C. Rogers asked what size. B. Ducharme - 6 bedroom.
  • Per BOH Regulation 7, the Board requires that a deed notice requiring an annual inspection of the area above the sewer line and leaching facility be performed by the homeowner.
  • L. Andrews moved to approve the variance requests as presented along with the requirement of a deed notice, C. Rogers 2nd. All in favor.
  • M. Carlisle to send letter.
7:30pm Appointment – Attorney Douglas Rowe, Smith Property
  • Present - Attorney Doug Rowe. Stated that the tenants in the two family are willing to move out and will be gone within 30 days.
  • Board would like B. Brookings to do a site inspection once all buildings are vacant to assure that the location is secure.
  • Now that the buildings are vacant, board has no issues.
  • Mr. Ochsenbein asked is the Board has condemned the property? C. Slade stated no, wanted to avoid the litigation.
  • M. Carlisle to send letter.
Board cancelled the meeting for November 9, 2010.
