BOARD OF HEALTH MINUTES

Meeting held at Town Hall on May 11, 2010 6:30 pm

HOUGHTON FARM HEARING
Present:  Greg Roy, Brandon Ducharme, Bob Kiley, abutters Mike Cotter & Christine Rhodes
Sewage Disposal Systems Lot 5-12 Houghton Farm Lane
Greg Roy submitted the certified receipts, return receipts, abutters letter & newspaper ad.

Ducharme & Dillis on behalf of High Oaks Realty Trust request the following local Bolton Board of Health variances:

Regulation 5 – Distances
Requested to allow placement of the leaching facility within 25 feet of a property line.  It is proposed to locate the leaching facility less than 25 feet from an interior lot line for dwelling served by the common septic system.  The 25 foot offset is met on all perimeter property lines served by the common system.

Request to have 30 ft to roadline instead of 35 ft.

Greg gave a brief overview for everyone.  He explained the traditional plan shows 16 lots with proved systems with soil test, perc tests and deep holes.  During the process the Planning Board approved a FOSPRD layout with 15 lots.  This allowed them to move some houses and do some shared systems.  They are before us for 2 shared septic systems.  1 shared system on parcel A for 5 lots and 8 lots that will share a septic system off the end of the cul-de-sac.  Lots 1, 2, 3, 4, & 13 will share a system held by a homeowner association that will maintain it.  The system is in the meadow area because it has the best soils.  Condensed system, proposed using a presby, each home with septic tank with a gravity feed down to the electric duplex pumping system with a small building.  DEP needs to approve the systems.  The sewer line will cross the town right away and requires a Title 5 variance.  The sewer line will be a couple feet below the swales.  The shared system and the presby system requires an annual inspection.

Mike Cotter explained that Sugar Road was shut down due to water.  He expressed his concerned about his well water and his children.  He does not know all the details about his well.  He said his area and backyard was really flooded.

Greg explained that they have designed a storm water management to handle the water runoff.

Brandon noted that there is a 100 yr flood plain that runs across Sugar Rd in that area.

Bill Brookings thought that Mike’s home does have a drilled well but he is not sure if the well head is above grade, he will check the file.

Greg explained that they are way out of the 100 yr flood plain.  Bill said they recommend that the well head be above grade.

Christopher Slade explained that the presby has better technology with better treatment.

Greg gave copies of the deeds that included the shared system language and a home owner’s trust document.  These documents will tie together all the easements, parcels and ownership.  There will be an escrow agreement for the maintenance of the shared systems.

Greg said the offset to well is required to be 50ft from road or easement, they are 50 ft from everything except the temporary grading easement.  Brandon explained that once the road is in place that easement goes away.  Christopher Slade said he doesn’t see a problem with it.

The pump chamber for the shared system is less that 10 ft from the property line.  The offsets will be held to the exterior lines of the facility.  The Board will let the state rule on this as it makes sense to the Board that shared systems are on a shared area of land.

The Board did not have a problem with the testing and at the time of construction Bill could do a test hole to verify.

Christine Rhodes of 258 Sugar Rd. commented that after the first storm there was a lake in the field, after the second storm it did not go down.  She wanted to know how they did the percs.  Greg said that they did the percs 10 ft. above the flood plain.  She said the development is where the flood plain will be so how will you divert the water.  Greg explained that they designed the storm water management plan to handle the runoff.  Christine wanted to know if there will be a collection pool.  Greg said that there will be a collection pool outside the wetlands outside the cul-de-sac.  Mr. Slade explained that Board is not concerned because the septic systems are out of the flood plain and up on high land.  Christine explained that the high land is becoming low land and is under water.  Brandon pointed out that the Town of Bolton requires the deep hole testing when the ground water is the highest.  He said the holes he did in 2008 was the highest elevation that he had.  Christine said the spring and summer of 2009 has been the highest ground water so if percs were done in 2008 they may have missed it.

Brandon said that 60% of the development is open space, so everything is really tight.  Brandon said that they are trying to keep the simplicity of the system and to maintain gravity.

Discussion about lots 5-12

Brandon explained that on Lot 11 the distance from septic system to well is 125ft.  Bill said that if you have variable rates the Board can enforce the 2 min offset.  Lot 6 greater the sewer line is greater than 600’ from D box to facility.

The Board asked if they would be acceptable to a peer review if the Board requests one.  Mr. Kiley said it would be fine to do a peer review if the Board requests one.  Brandon said the timeframe would be the only concern on their end.

A motion was made by Laura Andrews to move to close the hearing and deliberate with Chris Rogers, seconded by Christopher Slade, all in favor (Laura Andrews, aye. Christopher Slade, aye)

408 STILL RIVER RD.
Present:  Greg Roy & Brendan Ducharme
Greg explained that the well is less than 100ft to system.  They did a Title 5 inspection and water tests.  The Board reviewed the Title 5 inspection report and found no failure criteria.  The Board also reviewed the water tests results and the results were acceptable.

INSPECTION REPORTS REVIEWED:
140 Century Mill Rd. – The Board reviewed the report and noted that ties need to be shown on the as built.
78 Golden Run Rd.The Board reviewed the report and found no failure criteria.
211 Green Rd.The Board reviewed the report and found no failure criteria.
294 Sugar Rd. – The Board reviewed the report and noted the presence of a garbage grinder.
103 Burnham Rd. – The Board reviewed the report and noted a conditional pass and D box needed.
408 Still River Rd. - The Board reviewed the report and found no failure criteria.
51 Nourse Rd. – The Board reviewed the report and noted that ties need to be shown on the as built.

REORGANIZE BOARD OF HEALTH
As discussed at the Board of Health meeting on 4/13/10, Laura Andrews made a motion to appoint Chris Slade as Chairman of the Board, seconded by Christopher Slade, all in Favor (Laura Andrews aye, Christopher Slade aye)

51 NOURSE RD.
Bill Brookings said that he will try to have permit and plan for the proposed new lot for next meeting.

LIST OF PROPERTY WELLS FOR DEP
Mr. Slade gave Lisa O’Leary a list of properties he had some additional information on.  Lisa O’Leary will contact DEP with the information.

LOT 6 SAWYER RD. SEPTIC PERMIT EXTENSION REQUEST
The Board reviewed and approved the septic permit extensions request and requires a Certificate of Compliance by May 8, 2011.

NORTH CENTRAL-FRANKLIN COUNTY TOBACCO CONTROL ALLIANCE
The Board reviewed a letter from the North Central Franklin County Tobacco Control Alliance commending the Board’s efforts in supporting local and state tobacco regulations.  The Board also reviewed the March 31, 2010 compliance check that indicated that Bolton has a 100% compliance rate.

BREAKOUT GRADING FOR SUNSET RIDGE BY MAY 1ST
Bill said when signed off the Board allowed Breakout grading to be done by 5/1/10, Bill said the engineer said it is done but we will send a letter requesting a revised plan.

601 MAIN ST.
The Board requested a hearing to be scheduled for 6/1/10 7:00 pm. for Regulation 5 and Well Regulation 4.1.1.  The Board did not want to wait because the failed cesspool has breakout encroaching on a wetland so it was decided to cancel June 8, 2010 and schedule a meeting for 6/1/10.

139 NASHAWAY RD. – ANNUAL INSPECTION OF BREAKOUT SLOPE FOR SYSTEM
Bill Brookings said this was one of the houses where the water was tested.  The Board requires an inspection of the sewer line length and the breakout slope but has not received any.  The Board wants to send a reminder letter.

NASHAWAY & VAUGHN HILL WATER TESTS RESULTS
Bill Brookings said that all eleven houses were test for coliform and all results were negative.

746 MAIN ST. – INSTALLER INFORMATION REGARDING DEPTH OF CESSPOOL
The Board reviewed the letter submitted by Chris Merrill that indicates a failed system at 746 Main St.  The Board wants to send a letter.


APPLE VALLEY RD. SAWYER RD. REDESIGN FROM STONE TRENCHES TO CULTECH BEDS
The Board requires redesign plans be submitted.

LOT 3 HARVARD RD. H2O RESULTS
Bill Brookings noted that local well regulations require test results and they are only good for 2 years for sign off of Certificate of Occupancy.  The test results for Lot 3 Harvard Rd. were dated 2006 but the well pump contractor retested in 2010.  The Board reviewed the test results and accepted the water results.

BOLTON COUNTRY MANOR ESCALATION PLAN FOR ISSUES
The Board reviewed the escalation plan.

563 MAIN ST.
The Board reviewed an email outlining issues at 563 Main St.  The Board recommends that the concerns be brought to the property owner.

10 HARRIS FARM RD
The Board reviewed and approved the garbage grinder removal documentation.
