Board of Health Minutes March 23, 2010
BOARD OF HEALTH MINUTES

Meeting held at Town Hall on March 23, 2010 6:30 pm
Present:  Christopher Slade, Laura Andrews, Bill Brookings, Lisa O’Leary

55 Bolton Woods Way
Greg Matte was present.  Greg wants to put a 8 x 14 or 10 x12 shed on cinder blocks on the septic easement on his property.  He said that the lot is small (¼ acre) and is not one of the 40B lots.  He said he does not have a lot of space and there is not enough space in the front or side yard.  He explained that he wanted to put it in the lower right corner of the lot where he has already gotten a verbal approval from the Conservation Commission.  The location he wants to put the shed in has a few pipes in the ground, he said that due to the fact that the shed will not be a permanent structure he could move it if he had to.  Greg noted that he does need to get a variance with zoning.  Bill Brookings explained that the easement would be executed by the association however Greg said that they just formed an association last April.  The Board agreed that as long as Greg checks with the Building Inspector to make sure the shed would not be considered a permanent structure then the Board would allow the shed on the septic easement.  The Board also explained that Greg would have to accept the responsibility of moving the shed if there is a problem, Greg said that he is aware that he may have to move the shed and accepts the responsibility.

NOMINATION OF INSPECTOR OF ANIMALS
The Board reviewed and approved the nomination paperwork naming Phyllis Tower as the Inspector of Animals.

MUNICIPAL ROADWAY VEGETATION MANAGEMENT PLAN 2010
The Board reviewed and approved the plan however Chairman Chris Rogers was not present to sign the plan.

BEAVER UPDATE
Quaker Lane - Mr. Slade spoke with Al Reska from the State to explain the location of the beaver dams in the 495 median culverts.  Lisa O’Leary spoke with Mr. Dixson of Quaker Lane and he confirmed that the water level has gone down.
Forbush Mill Rd. - Bill Brookings said that as an FYI, Curt Plante mentioned that there is beaver activity again at Forbush Mill Rd.

EMERGENCY MANAGEMENT PHER GRANT
Bill Brookings mentioned that Jim Garreffi suggested that we buy A-frame sign boards or a sign holder for the EDS signs.  Jim Garreffi said that the costs of the signs would be covered by the PHER grant money.  The Board agreed that if the cost is covered we should get the signs.

601 MAIN ST.
Bill Brookings explained that this property has a failed cesspool.  Bill was called by a tenant and went out two Fridays in a row, he said that he witnessed breakout to the adjacent wetland.  Bill drafted a letter that will be sent certified mail to the owner of the property.  The letter requires the cesspool to be pumped immediately and often to prevent breakout, in addition, a soil testing application must be received within 30 days.  The Board reviewed and approved the letter.




BOLTON COUNTRY MANOR
David Drugge was present.  Bill Brookings explained that the housing sanitary code does not specifically mention washing machines. The Board said that the feel that the laundry issue is being handled in a satisfactory manner and that the Town Nurse will continue to pursue services.  The Board agreed to help establish an escalation plan for issues at Bolton Country Manor.

188 STILL RIVER RD.
Bill Brookings explained that the engineer told him that when digging the bore holes in the rain the equipment slipped so the geothermal bore hole is less than 50 ft to the well.  Bill said that he spoke with DEP and DEP approved the slight offset.  The Board said that they will support the DEP approval.

233 WATTAQUADOCK HILL RD.
Bill Brookings explained that this is a failed system and the homeowner dropped off a plan for his review.  Bill pointed out a 3 ft groundwater offset with a stone bed.  The Board of Health will not support a 3ft groundwater offset with a stone bed.  The Board requires trenches.  The owner also wants to know if the Board will approve a presby system with the 3 ft offset.  The Board would approve of a presby system with the 3 ft. offset otherwise they require full compliance.  The Board agreed that due to the 3ft. offset a variance hearing would be necessary.

MOSQUITOES ALTOCID
The Board approved the altocid treatment for the catch basins.

BOLTON REGULATIONS REVIEW
The Board wants to review the Bolton local SDS Regulations 3 & Regulation 10 (locus info).  The Board agreed that the regulation review will be moved to the 4/13/10 meeting so they can review and discuss the regulations as a full Board.

SEPTIC PERMITS APPROVED:
387 Old Bay Rd. - D box permit for Holtorf

BUILDING PERMITS APPROVED:
122 Fox Run Rd. - addition- David Drugge brought plans of the current floor plan of the home.
Bill Brookings counted current number of rooms, he counted 5 rooms upstairs, 5 rooms downstairs, 1 room in the basement for a total of 11 rooms and the addition would add 2 more rooms which would be 13 rooms with a 5 bedroom septic.  The Board agreed that there will be a total of 13 rooms, therefore they require a 5 bedroom deed restriction be recorded prior to signing building permit.  The Board authorized Lisa O’Leary to sign the building permit once the recorded deed restriction was received.

INSPECTION REPORTS REVIEWED:
387 Old Bay Rd. – The Board reviewed the report and noted that the design flow was listed as 3 bedrooms but the actual was listed as 4 bedrooms.  The Board requests a room layout and deed restriction or an upgrade to a 4 bedroom system.
