BOARD OF HEALTH MINUTES

Meeting held at Town Hall on January 26, 2010 6:30 pm
Present: Chris Rogers, Laura Andrews, Christopher Slade, Bill Brookings, Lisa O’Leary

LOT 17 & LOT 17A DRUMLIN HILL RD.
Brandon Ducharme was present.
Brandon explained that the Northwoods FOSPRD can only have a total of 37 lots.  Lot 36 Harvard Rd. will be added to Brandon’s house lot (401 Harvard Rd.) and a portion of the lot will become open space.  Lot 17 will be split into 2 lots, both lots being an acre or more.  There will be a shared septic system with 2 septic tanks with a shared leaching field.  The Board explained that because it is a shared septic system, Regulation 8a is not necessary because Regulation 8b supersedes it.  The Board requires approval from all town boards for a shared system in accordance with the new Regulation 8b.  The Board recommends that there be two pumps and two chambers with a “Y” tie in to the force main.  A Regulation 7c long sewer variance will be required.  If the Board approves the plan then it has to go to DEP for their approval.  The Board approves the plan in concept and requires Brandon to come back before the Board with a formal submission.

LOT 4 NOURSE RD.
Greg Roy was present.
Greg explained that there were expired septic permits on the lots that were long snaking lines back toward the wetlands.  Mr. James owns 2 lots (lot 4 & lot 3) he wants to reconfigure the 2 lots to abandon the long snaking lines.  Greg is here to talk about Lot 4.  Greg sent an email to Dave Boyer from DEP asking if he could suspend the sewer line on the bridge deck (old railroad car).  Greg said it was a gravity system with about 300 ft of line.  Greg said that the Conservation Commission did not like the sewer line going through the stream.  Greg noted that additional soil testing has been done and he has proved the reserve area.  Greg asked about mottling vs. deep hole testing and the Board said if there is solid mottling they are okay with the out of season testing.  The Board requires a Title 5 inspection.  The Board also requires the existing home at 51 Nourse Rd. to have water testing (standard test needed for a new well) and deed notice long sewer line by homeowner recorded.  The Board wants the retaining wall be designed and submitted as part of the submission.

LOT 8 BERLIN RD.
Curt Plante was present.
Curt explained that this issue started back in 2000.  He said they had a septic permit for lot 8.  The Conservation Trust issued a cease and desist order due to a boundary line issue.  While researching the land records they found that there was a gap in the deed of transfer (after Coolidge).  Title insurance remedied everyone’s deeds.  A global agreement was made last fall with a revised plan.  In the global settlement Lover’s Leap Realty Trust will keep some of lot 10 and got their easement to service the septic for Lot 8.  There is a conservation restriction put on the land.  There is an ANR plan with several different parcels that was endorsed in December which is part of the global agreement although the agreement has not yet been recorded.  Lover’s Leap Realty Trust went from possessing Lot 8 & Lot 10 to just having Lot 8 which is now bigger and Lot 10 went to the Conservation Trust and other abutters.

The question now was how long the septic permit for lot 8 is valid for due to the tolling agreement?  The Board recommended that it would be best to get a new permit and system design, however, they did explain to Curt that according to the previous Board’s letter, he has 124 days to receive a Certificate of Compliance for the existing permit .   The Board wants a design plan for the “new” lot 8, proposed house location and system location.  The Board explained that they are willing to work with Curt.  Chris Slade asked if Title 5 was subject to tolling.  No one was sure so Bill Brookings will call DEP to get an answer whether Title 5 is subject to tolling.  Curt asked if there are any extensions on the existing permit.  Bill Brookings explained that there was already an extension on file for Lot 8.  The Board had some discussion about when the clock started on the 124 days.  The Board thought it may be once the deed for Lot 8 is signed.  The Board explained that there was already an extension for the permit so there is only 124 days to get a COC from the day that the deed for the lot is signed.
Curt said the next move is to get some engineering done, get a plan and special permit through Planning Board.

68 NOURSE RD.
Building permit that would require a new foundation wall less that 25ft offset to the tank
Greg Childs was present.  He said his house is the old Dempsey property and he wants to put an addition on the back with a 10 ft deck.  The addition would be a full foundation replacing an existing is a slab.  The end result will be the foundation may end up being over 14 or 15 feet from the septic tank.  The Board explained that bottom line is that if it is a new foundation less than 25ft. from the septic tank then he needs to go through the variance process.  The Board agreed that the room count will still be 7 after the addition.  The Board explained that Greg would need a variance to regulation 5 distances.

INSPECTION REPORTS REVIEWED:
188 Still River Rd. – the Board reviewed the report and noted no failure criteria

ANNUAL REPORT
Mr. Slade read his draft of the Board of Health Annual Report.  The Board agreed that Lisa will type up the report and email it for final review and approval.  Bill Brookings also said that Jim Garreffi will be sending me the numbers to include in the report.

198 MAIN ST.
Walter Haslett wants Board to confirm capacity of system.  Due to the septic permit stating 2/3 bedrooms and the support size of the system the Board agrees that the home can be listed as a three bedroom.

453 HARVARD RD.
Bill Brookings pointed out that the recent Title 5 indicates a 3 bedroom design but 4 bedrooms actual.  The Board agreed that there are a total of 9 rooms total.  The Board also reviewed a layout of the home that was submitted and determined that the home is a 4 bedroom.

738 MAIN ST. BOLTON LIBRARY OCCUPANCY
Bill said that he got a call from Ed O’Connor (GC of the Library project) he explained that need to have pressure testing documentation, DEP sign off and an As Built of the force main prior to sign off for the occupancy.  The library also owes DEP the cross connection documentation and a coliform test.  The Board will not sign off the OC until all items are received.

CENTURY MILL ESTATES NITROGEN LOADING EASEMENT/PLAN
The Board reviewed the revised conceptual plan submitted and memos from the Conservation Commission requiring a revised plan that accommodates future possibility of paving an access off the end of the cul-de-sac into the open space.

SUNSET RIDGE – TRAIL EASEMENT
The Board does not have a problem with the trail easement over the septic tank provided there is no vehicular traffic.

BOLTON PUBLIC SAFETY FACILITY – UPDATE ON WELL SAMPLING
Board reviewed the email reporting the well sampling.

EMERGENCY PREPAREDNESS SATELLITE PHONE
The Board recommends that the Police & Town Administrator or EMD be the 24 x 7 contact for the satellite phone.

715-719 & 723 MAIN ST. - SMITH PROPERTY
The Board reviewed a request from Attorney Douglas Rowe to be put on the agenda for the next Board of Health meeting on February 9, 2010.  The Board agreed to schedule an appointment for next meeting but wants to receive an outline of the proposed plans so they can review them prior to the meeting.

DOCUMENTS REVIEWED:
Heather O’Sullivan sent an email with her resume requesting to be a volunteer – The Board reviewed the email and resume Ms. O’Sullivan submitted and requested that she be added to the volunteer list.
