BOARD OF HEALTH MINUTES

Meeting held at Town Hall on April 28, 2009 6:30 pm
Members present: Chris Rogers, Christopher Slade, Laura Andrews, Lisa O’Leary

SEPTIC PERMITS APPROVED:
Camp Virginia 96 Hudson Rd. - Follow up to Feb. 24, 2009 request to tie in existing latrines into the existing system.  The Board reviewed and signed the permit

INSPECTION REPORTS REVIEWED:
172 Vaughn Hill Rd. - The Board reviewed the report and noted that the date last occupied was March, 2008 therefore the Board requires a 6 month re-inspection.
113 Green Rd. - The Board noted that the inspection report dated 4/6/09 page 6 of the report indicates that the system is designed for a 3 bedroom dwelling but the actual number of bedrooms is 4.  The Board requires a sketch of the existing room layout of all habitable space to determine if a 3 bedroom deed restriction is necessary or if the system must be upgraded to handle a 4 bedroom flow (which would include a fully compliant primary and reserve area).  Also, have your inspector resubmit page 10 of the report, as the sketch submitted was not legible.

Page 6  Board requires a room layout and wants confirmation on the number of bedrooms.  The Board requires evidence the system will handle 4 bedrooms if there are 4 bedrooms..
66 Nashaway Rd. - The inspection report was reviewed and no failures were found.
58 Farm Rd. - The inspection report was reviewed and no failures were found.
233 Wattaquadock Hill Rd. - The Board reviewed the inspection report that notes the system has failed.  The Board also noted that a previous report indicated SAS is less than 100 ft to well, this report indicates it is more than 100 ft. to well.  The report also reported that the sump pump is discharging over the distribution box.  The Board requires the standard failure letter be sent including verification of the SAS location and the removal of the sump pump discharge over the distribution box.
41 Farm Rd. The inspection report was reviewed and no failures were found.

41 FARM RD.
Mark Elliott was present.
Mr. Elliott came before the Board to review a building permit he had for finishing his basement and to discuss his Title 5 inspection report.  The Board explained to Mark Elliott that the permit says the system is designed for 4 bedrooms but the house is 5 bedrooms.  The Board agreed that the tank size is fine and he can install an ejector pump in basement.  The Board noted that an ejector pump cannot be installed if the size of the tank is less than 1500 gallons.  The Board pointed out that the other requirement was to verify if the septic system has the capacity for 5 bedrooms.  Mr. Elliott said that he was sold the house as a 5 bedroom.  The Board suggested that Mr. Elliott can either hire an engineer to determine whether the system was designed to handle the 5 bedroom flow or he can record a 4 bedroom deed restriction.  Mr. Elliott asked for the name of some engineering firms and the Board responded with Thomas Land Surveyors, Ducharme & Dillis, David E. Ross Associates, Foresite Engineering.  Chris Rogers explained that if Mr. Elliott brings them his plans they will measure the trenches and do the calculations from the As Built plan.  Mark Elliott held on to his building permit.

23 HARVARD RD. HYTHE FARM – HORSE LOOSE
The Board discussed the loose horse problem.  The Board agrees with the direction Chief Alfano is pursuing in order to resolve this public safety issue.

730 MAIN STREET
The Board discussed the letter sent to the Selectmen from Mr. Burnett at 730 Main St.  The Board will send a memo to the Selectmen addressing the Board of Health concerns.  The Board should be notified if/when Mr. Burnett has an issue with odor or dust from the Public Safety Construction site.  The Board agreed that if Mr. Burnett is concerned about his well he should have his well tested.  They recommend periodic testing be done to ensure water quality.  Surface activity should not affect water quality of a properly installed drilled well.

BOLTON ORCHARDS
The Board discussed the recent expansion of the Bolton Orchards menu and if it will impact the flow there.  The Board feels that if the septic tank and pump chamber are being inspected monthly the system should be okay.  However, the Board reserves the right to require that the septic tank and pump chamber be upgraded.  The Board needs to get the calculations, if the flow rate exceeds the system then Bolton Orchards would have to upgrade.  The Board wants to follow up with meter readings.  Chris Slade will check to see where the meter readings are.

LOT #3 HARVARD RD. – SEPTIC SYSTEM PERMIT EXTENSION REQUEST
The Board granted a one year extension already therefore, no further extensions are allowed per Title 5.

WORCESTER REGIONAL MEDICAL RESERVE CORPS – MEMORANDUM OF UNDERSTANDING FOR MEDICAL RESERVE CORPS VOLUNTEER SERVICES
The Board agreed that the Chairman, Chris Rogers can sign this document.

SWINE FLU
The Board briefly discussed the Swine Flu, there is a short incubation period (48 hours) and there are four vaccines available that will treat it.  Lisa O’Leary had information from MEMA posted on the website and also had a town crier put in the Bolton Common.

APPOINTMENT OF THE ANIMAL INSPECTOR
A motion made by Rogers and seconded by Slade to appoint Phyllis Tower as the Town of Bolton’s Animal Inspector (Slade yes, Andrews yes, Rogers yes)
