BOARD OF HEALTH MINUTES

Meeting on February 24, 2009 6:30 pm

NEW BOARD OF HEALTH MEMBERS
Chris Rogers and Bill Brookings welcomed new members Chris Slade and Laura Andrews.

41 FARM RD.
Mark Elliott was present.  The Board reviewed a building permit submitted by Mr. Elliott to refinish some walls in his basement and add a bathroom. Mark explained that he wants to renovate his basement, just insulate and put up some drywall.  He explained that there was existing wall with wiring he tore it out and wants to put new walls, leaving the concrete floor and a drop ceiling.  He was thinking of putting a bathroom with an ejector pump.  He said that he is not sure where that sits with his septic system.  

Chris Rogers explains the situation is that his house has 5 bedrooms with a 4 bedroom system.  Chris said that the upside for him is that his system is older.  He needs to get an engineer to certify that the system can accommodate 5 bedrooms.  

The Board discussed the room count.  Mr. Elliott said that the sunroom has electric heat and thermal pane doors leading to it.  He said that he only uses it 3 seasons.  The Board agreed that the total room count is 11 (10 existing with 1 finished in the basement), the three season room will not have to be counted.

The Board did not sign the building permit.  The Board gave Mr. Elliott back his building permit with floor plan and explained to Mr. Elliott that he has the following issues:

1.  He has a 5 bedroom home and a 4 bedroom septic permit.
The Board recommended that he hire an engineer to certify that system can accommodate 5 bedrooms.  The Board explained that if the engineer does not feel comfortable certifying the system with 5 bedrooms then he needs to record a 4 bedroom deed restriction.  The Board requires either a 4 bedroom deed restriction or a letter from an engineer stating the system is certified for 5 bedrooms.

Ejector pump needs 1500 gallon tank per Title 5 currently his septic permit is for 1250 gallon tank.

2.  To put a bathroom in the basement he needs to install ejector pump.
In order to install an ejector pump he needs to have a 1500 gallon tank per Title 5 currently his septic permit is for a 1250 gallon tank.  The Board recommended that he have an engineer check the size of his tank.

The Board agreed that Mr. Elliott is finishing existing space so there is no need for a Title 5 inspection.

CAMP VIRGINIA
Gerry Buzanoski was present.  
Gerry explained the capacity for the existing 1978 system and that they would like to tie in two latrines.  Before they design the system, they want to run thru the criteria for the system.  The existing system is from 1985 has capacity of 2460 gallons per day.  The camp operates July 1st to September 30th, Monday thru Friday 9-5pm, spring and fall only on weekends using only the campground areas.  The camp no longer supplies food the kids bring their own food.  So the three gallons per day that was allotted for a kitchen function is no longer used.  Gerry said that the number of persons allowed at the camp is 150.  The NABH Camp license is issued for 150 persons, the system was designed for 170 persons (max) and DEP water supply has 160 persons.

The Board questions if total number of 170 campers/users would have included the latrines.  The site flow is the site flow no matter where they are going and the camp is licenses for only 150 persons.

The most economical way to accomplish this is to drop a few grinder pumps and pump it to the septic tank but that would require state approval.  The tank seems plenty large enough, but it is only a single compartment tank.  The camp would rather try to follow the trail with smaller shallow pipe so there is minimal disturbance to the natural landscape.

Gerry said that they will have to apply for a component change.

The Board agreed that the existing system will handle tying in the 2 latrines because the Camp is only permitted for 150.  The Board has accepts the flow of 170 campers times 10 gallons per day.

ADVISORY BOARD – FY 2010 BUDGET
The Board met with the Advisory Board to discuss budgets 510, 439, 522.  The Board agreed to change the following:
Rabies testing changed to $500.00 from $1,000.00
Advertising changed to $100.00 from $200.00
Travel changed to $450.00 from $525.00

Advisory Board asked to check on amounts for the following:
Department 22 Nurse (Nashoba)
Department 510 Nashoba Boards of Health Assessment.  

Advisory would like to budget the exact amount actually billed by Nashoba.  Currently, Department 22 Nurse is budgeted for $8,000 and Department 510 Nashoba Boards of Health Assessment is budgeted for $7,418.  Actual payments have totaled $7,000 for Department 22 Nurse and $6861.00 for Department  510 Nashoba Boards of Health Assessment.

MOBIL STATION TOBACCO COMPLIANCE CHECK
The Board discussed the recent non compliance check at the Mobil Station and agreed to waive the $100.00 fine but want to suspend the license for one day.

BOLTON LIBRARY - 738 MAIN ST.
The Board reviewed the well abandonment letter from the Board of Selectmen.

AMEC RIGHT OF WAY MANAGEMENT CSX TRANSPORTATION INC.
The Board reviewed the letter asking for private drinking water wells 100 ft. from the railroad tracks.  The Board also reviewed a map created from GIS of the area that showed addresses for parcels located within 100 ft. of the railroad tracks.  The Board asked Bill Brookings to verify the well locations for the abutting parcels and prepare a response to the letter.

PUBLIC SAFETY BUILDING - 15 WATTAQUADOCK HILL RD.
The Board reviewed a letter from Garcia Galuska Desousa in response to the Board of Health letter dated 2/5/09 to Groom Engineering.  The Board was satisfied with the response that was submitted.

FORCE MAIN
The Board reviewed the letter dated 2/5/09 RE: Sewer Extension Main St & Wattaquadock Hill Rd. Public Notice.

REGENCY MAIN STREET
The Board discussed the Town Planner’s Request for Regency to change lighting.  The Board has no jurisdiction over lighting, as long as the lighting is not in the public roadway they did not have any problems with it.

GROUNDWATER SEASON
Per the Town of Bolton local Subsurface Disposal of Sanitary Sewage Regulation 3: Groundwater Elevation, the Board voted that the groundwater period will be March 15, 2009 – April 15, 2009 with a 5 ft. offset.

LOT 24 & 25 OAK TRAIL
Ken Elworthy owns both lot 24 & lot 25 on Oak Trail and he wants to combine the two lots to one lot (lot 24A).  His house is on Lot 24 and he has a garage/barn on lot 25.  He wants to put in a pool on lot 24 where the house is but the only place for the pool is where the reserve area is.  He wants to use the primary area on lot 25 as the reserve area for lot 24.  The Board did not see a problem with this plan as long as Mr. Elworthy gets approval to combine the lots.  Bill Brookings will revise the septic permit and plans once he receives approval for lots being combined by the Planning Board.

The Board reviewed a letter from Martha Remington to Town Clerk received 2/2/09.

CAUCUS ON MONDAY MARCH 16, 2009
The Board reviewed a letter from Bolton Town Clerk regarding the Caucus on Monday March 16, 2009 at 7:30pm.

SUNSET RIDGE
The Board reviewed Sheet No. 2, Existing Conditions Plan from the site approved for this project, requested by Bill Brookings. The final stamped plans dated April 9, 2009 with an updated sheet 6 with modifications from Bill Brookings comments were given to Bill Brookings.

HYTHE FARMS 23 HARVARD RD.
The Board reviewed a letter submitted by Nan Norseen regarding the fencing status on her property.
