BOARD OF HEALTH MINUTES

Meeting held at Town Hall on October 27, 2009 6:30 pm
Present: Laura Andrews, Chris Slade, Bill Brookings, Lisa O’Leary

85 Nashaway Rd. Variance Hearing
Present: Gerry Smith & Jack Sargent
Received certified receipts, return receipts, abutters letter & newspaper ad.
The system is 25 years old and at the point it needs to be replaced.  They are concerned about the weather.  The system will be installed right behind the shade tree.  The new leach field ix 20x30 the old one was 24 x 34, 1250 gallon tank and is in good shape, the d box is in good shape.  The system will go back into existing grade.
A motion was made by Christopher Slade to vote yes for both variances, seconded by Laura Andrews, all in favor (Christopher Slade, aye, Laura Andrews, aye).  The Board approved and signed the permit.

746 Main St.
Greg Roy of Ducharme & Dillis presented preliminary plans for a garage that has an approved septic plan from 2/08.  The approved plan is for a presby system for the yellow house right next to the library.  The presby is the only system that will fit on the lot with several variances.  The Hurds are exploring getting better access to the first floor from the back of the property.  They would also like to construct a garage.  This upgrade was approved but not built yet, it is a voluntary upgrade.  They need direction because they would like to put the garage in the fill.  It is an attached garage on a slab.  The wall will be taking out the breakout slope so they need to put a retaining wall.  The approved plan has an approved impervious barrier.  The Board agreed that with the barrier it is ok.  Greg said the barrier would be 10 ft.  The Board said they need to make sure the barrier is not on top of the poly.  The Board recommended that they do a plan revision and a note to protect the poly from the concrete.

164 SUGAR RD. VARIANCE HEARING
Present: Anne & Howard Dilling
Received certified receipts, return receipts, abutters letter & newspaper ad.
Variances requested for drilled well 31 ft. instead of 50ft. to the property line.  
Less that 20 ft to building footprint 12 ft to existing building
Sewer line 50ft proposed 25ft
The new well will have a pressure line.  Bill Brookings explained that the sewer line will be sleeved.  The existing well is a shallow well, it will be disconnected from the home and used only for irrigation.

189 FORBUSH MILL RD.
Duffy McNulty was present to discuss his driveway.  The existing well is now above grade and is 15 ft to edge of driveway.  Local regulations require 25ft from well to driveway.  The existing gravel drive is 7 ft. he proposes to go 15ft to driveway.  The Board accepts this preexisting condition and will require him to add granite barrier.

BOARD OF HEALTH MEETING DATES
The Board reviewed meeting dates scheduled for November & December.  The Board agreed to cancel the meetings scheduled for Nov. 24th and the Dec. 8., the Board also agreed to schedule a meeting for Dec. 1.  Laura Andrews cannot be present for the December 24th meeting.

PANDEMIC FLU RESPONSE PLAN
The Board reviewed an email from Dawn McHugh of Clinton Savings Bank requesting a copy of the Town of Bolton’s Pandemic Flu Response Plan.  The Board agreed that contact information for the Board of Health and Nashoba Associated Board of Health can be given.  The Board wants Lisa O’Leary to contact Ken Gikas to see if the plan can be distributed.

NEW REQUIREMENTS OF THE CONFLICT OF INTEREST LAW
The Board reviewed the new requirements of the Conflict of Interest Law.

REGION 2 PHEP EXECUTIVE COMMITTEE
The Board reviewed the documentation regarding the Public Health Emergency Response Funds.

DEFINITIVE SUBDIVISION PLANS – HOUGHTON FARM (GOLDEN RUN & SUGAR)
The Board will review the plans after Bill Brookings has had a chance to comment on the plans.

CENTURY MILL ESTATES – NITROGEN LOADING AGGREGATION PLAN
Bill Brookings said Title 5 limits to 440 gpd unless you have a nitrogen loading plan, if you do DEP will give you credit.  Bill said that the plan is fine when running the numbers.  This is right out of Title 5.  The approval process requires BOH review, letter of approval from the BOH which gets submitted with the plan to DEP for their review and approval.  Laura Andrews will take the plan and review it.  The Board wants to add this to next meeting for full Board review.

83 QUAKER LANE
The Board reviewed a Title 5 Inspection sketch and picture submitted by E. Lawrence Gogolin.  The Board agreed that no bedroom deed restriction is required.  The Board wants to issue a letter with a note to pull a permit for the unlicensed unpermitted d box replacement.

115 DRUMLIN HILL RD.
The Board reviewed and signed the Notice of Variance Long Sewer Line by homeowner.

MAHB – BOH CERTIFICATION PROGRAM
The Board reviewed the Massachusetts Association of Health Boards Certification Program schedule.
H1N1 MEMO
The Board reviewed the H1N1 memo from Jim Garreffi Nashoba Associates Boards of Health and authorized the posting of the memo.

103 BURNHAM RD.
Bill Taylor requests an emergency beaver permit.  Bill Taylor said flooding is affecting his driveway, well and basement.  Bill Brookings will contact Fish & Wildlife to determine current regulations.  The Board of Health will do site visit.

91 QUAKER LANE
The Board reviewed an email from Andrea Dollar concerned about water in her back yard.  Christopher Slade said that he will go by and check out this situation.

INSPECTION REPORTS REVIEWED:
95 Sampson Rd. – The Board reviewed the report and noted a discrepancy on age of system pg 9 says 1979 30 years old but the system was installed 1998.
109 Old BayThe Board reviewed the report and found no failure criteria.
144 Nourse Rd. - The Board reviewed the report and found no failure criteria.


BUILDING PERMITS APPROVED:
46 Meadow Rd. – The Board authorized Lisa O’Leary to sign the permit once bedroom deed restriction recorded
56 Annie Moore Rd. – Screened porch.  Dave Bergstom explained that the existing deck is18ft off the well under the deck, it is above grade, existing deck has footings.  He showed picture that well head is under the bottom stair.  Dave presented the plot plan and as built septic.  The Board pointed out the presence of a garbage grinder as noted in the file.  Dave said he will find out about the garbage grinder.  The Board recommended the well head be protected. Board agreed it is existing they are not changing anything and is making a better situation.  The Board approved and signed the building permit.
211 West Berlin Rd. – Erik Shartner wants to demo his existing garage and build new garage.  Erik said the well will be 2 ft off the new garage, right now it is 18ft out.  Garage will be concrete slab, 4 ft down.  Erik said the well is steel casing above grade.  The Board explained that this is pre- existing and recommended that the well be protected during construction.  Dave will find out about the garbage grinder.  
87 Laurel Rd. – Bob Zaik from Clean Energy explained that he is installing solar panels with pvc being installed over the septic area.  He said the tray is dug down 6 inches then filled in with gravel.  Bill Brookings asked about the weight of the panels.  Bob said the weight is approximately 31 lbs per square foot.  Christopher Slade said there is no problem over the reserve area and as long as you are not digging down over the primary.  Mr. Slade also noted that the owner needs to be aware that if the system needs to be repaired or replaced then the panels will have to be moved.  The Board approved and signed the building permit.
