BOARD OF HEALTH MINUTES

Meeting held at Town Hall on September 22, 2009 6:30 pm
Present were:  Chris Rogers, Christopher Slade, Laura Andrews, Bill Brookings, Lisa O’Leary

119 WILDER RD. VARIANCE HEARING
Present were: Jerry Buzanokski, Jen & Steve Beckwith (abutters 195 Wilder Rd.)
Received certified receipts, return receipts, abutters letter & newspaper ad.
Jerry explained the system had failed and the variances were required to avoid putting the new system in the reserve area and to keep it out from under the common driveway.  Jerry explained that the new system is a pump system.  They put a timer on the pump so they know the volume of water going to the system.  The only thing they could think of is storm water because it is very flat.
Steve Beckwith said that he is well within 100 ft of the existing systems he asked if there were original variances.  Bill Brookings explained that the regulations were not in place at the time the original system was installed.  Jen Beckwith asked exactly what they are doing.  Chris Rogers explained that the system will be pivoted.  Steve Beckwith expressed his concern about overloading in general.  Bill Brookings explained that there is not a lot of difference.  Requirement of 100ft was put in for a reason wants to know in the future.  Bill explained that any of those systems needed to be replaced.
Chris Slade asked if failure was caused by the surrounding systems, Jerry and Bill explained that it was not.  There are many things that could cause the failure.
Steve Beckwith asked who would be doing the work.  Jerry told him that Don Hawkins was doing the work.
There were no objections from the abutters.  The Board voted to approve all variances, on a motion made by Chris Rogers, seconded by Chris Slade and Laura Andrews, all in favor (Chris Rogers, aye, Laura Andrews, aye, Christopher Slade, aye).
Jerry brought a 9B to be signed by the Board.  Jerry signed the permit as agent for the owner.

LOT 17 DRUMLIN HILL RD.
Present was Larry Ducharme.
Larry Ducharme explained the Northwoods subdivision.  Larry gifted a lot to one of his sons to build on.  Chuck Black asked Larry if there was a way to get any more lots.  Larry thought if he takes Lot 17 largest lot (3.3 acres) and divides it and propose to move lot 36 into his son’s lot.
They would have to take the septic system for lot 17 and share it with the new lot created.  Chris Rogers remembers the Wattaquadock Hill Rd. the Stephenson property.  Bill Brookings explained that the regulations were changed not to require the reserve area to be preserved on the actual lot.

Larry wanted the Board’s opinion would feel about the new layout, configuration and shared system for the lot.

The house on the new lot 17A will be 705 feet from the septic so there would be a variance because it is over the length.  There is an inspection requirement on shared systems.  Chris Rogers asked if the new regulations would address the power for the pump and have constant power not in one house.
The Board said they did not see a problem with what Larry is doing.


SUNSET RIDGE
Present: Vin Gately and Gerry Lindsey
There is new information that the surveyors were off 15 degrees.  They surveyed off the line in the middle so the ledge encroachment is less than they thought.  The Board will be getting another plan.  Bill said he already ran the numbers on the reserve.  Gerry explained that they plotted a 4ft offset around the ledge.  They will not need the impervious barrier and use the upper area.  There is one trench that would be dog legged.

Christopher Slade said there is one other problem, the requirement of the dosing.  Gerry said they have not heard anything.  Mr. Slade commented that you are supposed to do testing, get a permit then do the building but we are doing it backwards.

Gerry said that a system over 2,000 gallons per day needs pressure dosing.  Gerry claimed that presby’s argument is that they are an alternative system and they are exempt.  Gerry said it is being worked on.  Christopher Slade would like to get this done prior to installation of the system.

Gerry said you cannot pressure dose a presby system he said they can insert a dosing tank in and if they need to add the pump they add the pump.  Bill Brookings explained sent a letter to DEP back in April and has not heard anything yet.

Gerry asked if they can truck in some sand, Bill said depends on what the revised plan is.  The Board agreed that once Bill is comfortable with the revised plan they can haul sand.

189 FORBUSH MILL RD. VARIANCE HEARING
Present was Neil Gorman from David E. Ross Associates.

On Tuesday, September 22, 2009 at 7: 15 PM, the Bolton Board of Health conducted a variance hearing to discuss the following variances requested by David E. Ross Associates on behalf of their client Estate of Dorothy Sonia:
Bolton Board of Health Regulations: Regulation 5 Distances
  • Leaching facility shall be offset one hundred fifty (150) feet from a private water supply well in soils with a percolation rate of 2 minutes per inch or less.
  • Proposed: An offset of one hundred five (105) feet is provided.
  • Leaching facility shall be offset 35 feet from a road side line
  • Proposed:  An offset of 27 feet is provided.
Bolton Well Regulations: Regulation 4.1
  • A sewer line shall be offset fifty (50) feet from a well.
  • Proposed: An offset of forty-three (43) feet is provided.
Neil explained the reason for the variances requested, a three trench system is proposed, a 1500 gallon tank, 2 min soils they could not get 150 ft. from the well anywhere on the property.  They are keeping the sewer line in same place.  The new homeowner may increase the system in the future to 4 bedrooms and is aware that he would have to acquire more land to do so and a new well location.  They have planned ahead with oversize trenches.  Chris Slade said he is comfortable with it because they have lots of sand on that lot.

A motion was made by Laura Andrews to approve all variances, seconded by Chris Rogers and Chris Slade, all in favor (Chris Rogers, aye, Laura Andrews, aye, Christopher Slade, aye).

40 FORBUSH MILL RD. GEOTHERMAL SYSTEM
Present were: Marcel Maillet, Mike Pelliter
The Board explained that this will be the first closed loop system that uses the potable water well for the geothermal system.  Mike Pelliter said that he knows of no know systems that have contaminated the drinking water supply.  The problem with the system is that the wells are very deep, this well is a 500 ft. well because the wells are so deep they sometimes collapse at the very deep levels.  Chris Rogers said that it is similar to reverse air conditioning how the heating system will work.  Mike Pelliter explained that DEP supports these geothermal systems as long as they are done correctly.  The Board acknowledged the receipt of a letter from DEP that stated this.

Chris Slade has done some digging for the last two weeks and is satisfied with the information he has found about this type of system.

The Board approved the installation of the geothermal closed loop system with the one well.  The Board requires additional testing for geothermal and potable water quality testing, as well as, an acknowledgement letter from the buyers of the property that they will do water quality tests according to the guidelines. The Board also requires the DEP registration number from the state prior to the system going in.

SEPTIC PERMITS:
Lot 2 Wattaquadock Hill Rd. permit extension request.  The Board reviewed the request and granted a one year extension.

INSPECTION REPORTS REVIEWED:
83 Laurel Rd. – resubmission on new form.  The Board reviewed the report and found no failure criteria.
68 Quaker Lane The Board reviewed the report and noted that there was no age of components
83 Quaker LaneThe Board reviewed the report and noted that there was a d box replacement without a permit then the permit was applied for after the fact.  The Board requires a letter to inspector asking who did the d box without a permit and were they licensed.  The Board also wants to know why we have a permit application after the fact.  The Board wants the letter to ask for an inspection and it should be sent to both inspectors involved.

BUILDING PERMITS APPROVED:
46 Meadow Rd. – Jon Mechlin the Board approved the deed notice language and authorized Lisa to sign the building permit once the deed restriction has been recorded and the Board has a copy of the recorded document.

85 NASHAWAY RD.
The Board discussed an upgrade for 85 Nashaway Rd. that requires a variance that is scheduled for October 27, 2009.


BOLTON OFFICE PARK
The Board reviewed the Bolton Office Park Boil Water Order Termination.

206 HUDSON RD.
Mr. Birse applied for a building permit for a laundry room addition.  Bill Brookings explained that Mr. Birse applied for soil testing Nov. 93, however, we do not have a permit. The Board explained that there was a lot of ledge and wetlands on this property.  The Board requires a Title 5 inspection if he wants to move forward with the building permit.

739 MAIN ST. MURPHY INSURANCE DEP PWS LETTER
The Board reviewed a letter from DEP to Murphy Insurance the Board commented that DEP is trying to get all the non compliant water supplies in compliance.

FORBUSH MILL RD. JACKY FOSTER’S REQUEST FOR SOUND READINGS
The Board will respond with an email that explains that sporting events are exempt from DEP regulations.

88 DRUMLIN HILL RD. LOT 19
The Board reviewed a letter of assurance from the law offices of Joseph J. Connolly to record a quitclaim deed.

21 LEDGEWOOD CIRCLE LOT 23 PUMP SPECS AND BEDROOM DEED RESTRICTION
The Board agreed to send follow up letter to Kendall Homes and the current home owners verifying that the pump installed.

116 BARE HILL RD.
Christopher Slade left a message for Rob Held regarding the necessary water quality test and has not heard back yet.

18 WILDER RD.
The Board reviewed a letter of inspection from Agricultural Commission.
