BOARD OF HEALTH MINUTES

Meeting held at Town Hall on September 8, 2009 6:30 pm
Present were:  Chris Rogers, Christopher Slade, Laura Andrews, Bill Brookings, Lisa O’Leary

65 BEAR HILL RD. – VARIANCE HEARING FOR EMERGENCY COMPONENT REPLACEMENT
Present: Brandon Ducharme
Brandon submitted copies of the newspaper ad, abutter’s notice, certified and return receipts.
Brandon Ducharme explained an emergency replacement of system components that requires a variance to:

Bolton Board of Health Regulation 5
Requirement - the septic tank to be 25' from a cellar wall and 100' from a well.  
Proposed septic tank is 11' from the cellar wall and 50' from the well.

Brandon explained that this situation of a failure with the septic tank created a backup of water.  He worked with Bill to get an emergency replacement online.  The concrete in the tank and the d box was aging the box and it was full of sand when they opened it.  When they dug a hole to inspect the trench it looked new.  They jet out all the trenches, installed a new tank and d box.  Bolton requires 100 ft separation from the well
The replaced the components are in the same place and the tank was upgraded from a 1250 to a 1500 gallon tank.

The Board voted unanimously to approve the requested variance to Regulation 5.

Bill Brookings said the existing permit was for 3 bedroom house.  Brandon said that at this time the house has 8 rooms which would be a 4 bedroom septic.  This system has 1500 sq ft of leaching field.  They purchased it under the assumption from a title 5 report that the house was a 4 bedroom.

The Board agreed that based on the calculations done at the time of the system replacement and the size of the leach field the number of bedrooms should be listed as 4 on the permit.

SUNSET RIDGE CEASE AND DESIST ORDER
Present: Vin Gately, Gerry Linsey, Bridget Haulsey
Gerry Lindsey explained that the uphill bed sections 1-7 will change but sections 8, 9, and 10 will stay the same.  They will push the system to a 10ft offset which is the Title 5 minimum requirement.  They will put 2-82ft expansion trenches and build the primary system in the expansion area.
Section 11 was changed because of the ledge.  Section 13 & 14 (the orange and green sections) they will get
40 x40 area that will have to be opened up to the south.

Gerry Lindsey said that he needs to work out the grading area.  To stay with a 3-1 slope he needs to move the swale (dip) in the easement.  Gerry pointed out that the grading is controlled by the swale.

Bridget Haulsey asked some questions regarding soil depths.  Bill Brookings explained that once the boulders are removed if there is soil underneath you stop because the test holes tell you there is at least 4 ft. of soil so you do not have to dig 4 ft under every boulder.  Bill said that assumptions made based on the testing.

The Board is waiting for an actual plan with elevations for the ledge.  This is a modification to the original permit.  The Board agreed to lift the cease and desist based on the new evidence presented that uses the existing area.


EMERGENCY MANAGEMENT DIRECTORS
Present:  Tom Moses and Peter Casello.
Tom & Peter explained that they are taking the lead from the State to keep H1N1 separate from the EDS.  Tom said that Ken Gikas wants to have a meeting with the EMDs and the Board of Health.  Lisa O’Leary will set up a meeting with Ken Gikas, Program Planner Massachusetts Region II Public Health Emergency Preparedness Coalition.

Tom Moses left a copy of the hazard portion of the Emergency Plan for everyone to review and markup, he wants to have it back in two weeks by our next meeting.

580 MAIN STREET - FLATELY BUILDING BOIL WATER ORDER
The Board discussed that there needs to be at least 2 clean water tests before the boil order is lifted.  Bill Brookings said that he does not know what DEP requires.  Bill explained that this is DEP jurisdiction and that they are strict with something this serious.  Laura will call DEP and report at the next meeting.

FORBUSH MILL RD. –USE OF A GEOTHERMAL HEATING AND COOLING SYSTEM
Marcell Maillet was present.  Marcell explained that for the house they are building on Forbush Mill Rd. he wants to install an open loop geothermal heating and cooling system.  Chris Rogers noted that there is a pump line for domestic water and one line for heating.  Bill explained that additional water quality is done once after the system is installed.  Marcell said that there is more detailed information about the system online at Northeastgeo.com.

The Board discussed that they approved systems in the past that were not sharing the same well.  The Board expressed that there is a level of comfort knowing that they are not using the same well.  Chris Slade wants to understand the system more before he approves the use.  The Board agreed that they need some specs and more information to make a decision.  Chris Rogers said that Skillings needs to explain the system to them.  The Board does not understand the new system and want to know how it works.  Marcell will get some information and will come to the next meeting.

116 BEAR HILL RD.
Upon review of the file for a tent permit, Bill Brookings noted that a new well was installed but the water quality test was not completed, we also do not know if they destroyed the old well.  Chris Slade said he will to Rob Held.

BOLTON PUBLIC SAFETY BUILDING MOVEMENT OF THE HYDRANT LINE
Bill Brookings explained that a hydrant line for the Public Safety Building was moved.  The line crosses in two locations.  The line is above the sewer line, fed by rain water it is not for potable water and is only used for training.  The Board agrees that they do not have to do anything above and beyond what they are doing.

LOT 13A OAK TRAIL
Bill Brookings explained that the well went in as shown on their plan but there are tiered decks and stone wall that have been added.  The stone work is close to the well.  Bill wanted to bring it to the Board’s attention.  The Board agreed that although the decks and walls were not part of the building footprint they are considered just landscaping and they do not have a problem with it.

H1N1 PLAN – COMMUNICATION
Chris Slade will be calling Jim Garreffi to discuss communication of H1N1 issues.



MASSACHUSETTS COMMONWEALTH CAPITAL GUIDANCE FY 2010 – APPLICATION
The Board reviewed the information submitted by the Town Planner, Jennifer Burney.  Neither the Board nor Bill Brookings was familiar with the application.  Bill Brookings will get together with Jennifer Burney to see if he can help.

HORSE GUIDELINES
The Board agreed that everyone should refer to the State laws.  The Board recommended that Phyllis Tower the Town of Bolton Animal Inspector come to a future meeting to discuss this.

WHITEWATER DISCHARGE MONITORING REPORTS
Lisa O’Leary updated the Board to remind them that Whitewater Monitoring Reports are now being received electronically via email.

INSPECTIONS REVIEWED:
359 Berlin Rd. – The Board reviewed the inspection report and noted that design and bedroom data is blank
105 East End Rd. – The Board reviewed the inspection report and noted that it was reported on an old form

BUILDING PERMITS:
46 Meadow Rd. – Jon Mechlin explained that this home has a 3 bedroom system, it was built in 1978 and the owner wants to finish the basement.  They have tested and approved a 5 bedroom system however they do not want to construct the system at this point.  Bill Brookings verified the new system is designed.  Jon explained that they are willing to do a deed restriction now.  The Board agreed that Jon will come in at the next meeting with a building permit, a plan, and the deed restriction language.  Jon asked the Board if there could be some language that allows the Board to remove the restriction once the new 5 bedroom system is installed.  The Board agreed that upon completion of the new system after the COC is issued the deed restriction could be rescinded.
