Board Of Health Minutes

Meeting held on August 19, 2008 6:30 pm at Town Hall
Members present:  Mark Sprague, Andrea Gilbert, William Brookings

58 Old Bay Rd
Danielle & Jonathan Cochrane canceled the appointment prior to the meeting.

277 Sawyer Rd. Map 2B Parcel 2B1
Blair Brissette was present.  Mr. Brissette explained that he was scheduled to do test holes in April but it rained so much the equipment got stuck, and the tests were rescheduled the for August.  Mark Spraque is looking for the measurements to the abutting wells.  The question is whether or not to go through the normal variance process for out of season testing.  The variance requested would be for out of season testing.

The Board explained that the variance is a formality unless the abutters come up with something that would cause a problem with the plan.  The Board pointed out that the lot abuts properties in Bolton and Berlin and all abutters must be notified.  The Board described the variance process to Mr. Brissette.  There are no issues with the plan other than the out of season testing and updating the locus.   Bill Brookings will contact the engineer to get a new plan.  Public hearing is set for September 9, 2008 at 7:15 pm.

Emergency Deployment Worcester Regional Medical Reserve Corps
Lisa O’Leary explained to the Board that id badges & contact information for the Medical Reserves Corp were received and will be dispersed.

68 West Berlin rd.
The Board reviewed and approved the documentation submitted indicating the removal of a garbage grinder that had been previously noted on a Title 5 inspection report.

92 Golden Run
Follow up on Order to Correct Violations – Rubbish Nuisance.  After a short discussion, the Board voted to re-inspect after August 26, 2008 and add this to the September 9, 2008 meeting agenda.

18 Oak Trail (lot 1)
Follow up for Temporary Occupancy.  The Board reviewed the submitted recorded arsenic deed language and voted to approve occupancy.

23 Harvard Road
The board reviewed a letter they received from the Bolton Chief of Police dated August 11, 2008 that cited an ongoing problem of untethered farm animals in the public roadways from Hythe Farm, 23 Harvard Rd. that is owned by Nan Norseen.  The board questioned whether the Selectmen should appoint a fence walker possibly the Agricultural Commission to periodically inspect the fencing.  The Board requires that the fencing be brought up to an appropriate standard.  The Board recommends that Nan should have adequate fencing with an approved maintenance plan or she cannot have animals until she can provide that.  The Board voted to follow up with a letter since she hasn’t provided and maintained adequate fencing.

Sunset Ridge Peer Review
The Board will review a site review from Nitsche Engineering prior to the next meeting on September 9, 2008.

Force Main
The Board asked Lisa O’Leary to do some research on force main testing and maintenance.  The Board reviewed feedback from the City of Attleboro regarding pressure testing and maintenance.

305 Wattaquadock Hill Rd.
Housing violations.  The Board voted to continue with the condemnation hearing on September 9, 2008
at 8:00 pm.

82 Old Bay Rd.
The Board was informed that the Town Nurse is working with Mr. Warren Hills.

580 Main St. Bolton Office Park
The Board voted to have additional testing if DEP required tests do not to satisfy local regulations.

47 SugarRd. Colonial Candies
The Board had a brief discussion about the recently upgraded septic system.  The Board voted to have additional testing if DEP required tests do not to satisfy local regulations.

1092 Main St. Nashoba Office Park
The Board had a brief discussion about the new septic system.  The Board voted to have additional testing if DEP required tests do not to satisfy local regulations.

67 Bolton Woods Way
Poultry and rabbits complaint.  The Board voted to do a site visit then discuss at the next meeting.

87 East End Road
The Board discussed a complaint received about chickens inside the home.  The Board agreed that there is nothing they can do without a specific complaint in writing that would be an issue.

35 Woobly Rd
The Board reviewed a letter in response to a letter they sent to the owner regarding a trailer on their property.  The Board was satisfied with the response to their letter.

Bolton Public Library
Email from Gene Schrager regarding the Well Drilling Permit for the Bolton Public Library – The board reviewed the email, since there are no local variances they are just dealing with DEP.

2008 Clean Watersheds Needs Survey
Commonwealth of Mass Department of Environmental Protection 2008 Clean Watersheds Needs Survey– The Board voted to have Lisa O’Leary as the contact.

Regency At Bolton
Bill Brookings spoke to Jennifer Atwood Burney about the 40/20 split change to 20% of the units to no one under 18 allowed.  ZBA is waiting for DEP decision.  The Board briefly discussed the new floor plans sent by Shawn Nuckolls.

Building Permits:
24 Autumn Lane – Building permit for an addition with new porch, breakfast area, master bedroom, bath. The board reviewed the title 5 inspection report.  The Board counted the total number of rooms and agreed that there are 11 rooms. The Board voted to approve the building permit.
15 Danforth Lane – Building permit for a finished basement with playroom and bathroom.  The Board counted the total number of rooms and agreed that there are 10 rooms.  The Board found that the ejector pump had been previously installed and inspected on a plumbing permit.  The Board agreed to draft a memo from Board of Health to Fred Delorey, the plumbing inspector about installing pumps without Board of Health approval.
The Board voted to approve the building permit subject to bedroom deed restriction.
27 Sampson Rd. – Building permit for addition of a master bedroom suite.  Chris Rogers approved this building permit subject to possibly needing a bedroom deed restriction.  The Board voted to require the bedroom deed restriction recorded.
4 Deer Path – fiberglass inground pool – Not enough information, prior to approval the board requires that the pool and decking be drawn with measurements from septic and well on the original septic plan.
893 Main Street – Regency at Bolton temporary stage – The board voted to approve the building permit.

Septic Permits Approved:
68 Old Harvard Rd – D Box permit replacement based on a title 5 inspection
18 Corn Rd. – D Box permit replacement based on a title 5 inspection
46 Nourse Rd. – upgrade permit – Voluntary upgrade to bring the system up to current title 5,  The Board approved the permit and voted to have July 26, 2009 as the expiration date.
Forbush Mill Rd. – Maillet & Sons septic permit variance free, gravel pit across from the transfer station, driveway is already in.  The Board voted to approve the permit with these additional notes:  
A revised plan with additional locus information must be submitted prior to permit release.
Due to the proximity of the well to the existing town landfill and town barn (DEP release site),
the Town of Bolton will not provide any water testing nor assume any responsibility for water
potability.
the well be tested for Volatile Organics (VOC – EPA 524) in addition to the normally required
water tests
Lot 3 Annie Moore Rd. - Mark has recused himself as an abutter.  Andrea Gilbert reviewed the approved the permit.

Inspection Reports:
36 Farm Rd. – resubmitted pages 11 & 12 of 15 page report from 6/4/08- The Board was satisfied with the resubmitted information.
38 Drumlin Hill Rd – The Board reviewed the report, no failure criteria was noted.
Site Inspection report for 188 Hudson Rd. – annual inspection of long sewer line
