Board of Health Meeting Minutes for April 22, 2008

7:00 – 7:15 pm 141 Fox Run Rd – 14x22 shed/pool house for Gregory Roth
Gregory Roth explained that the pool was put in a year ago and now he needs storage for the pool.  He plans on doing a full block foundation from frost line.  The back side of the pool area has a retaining wall, so there is about 30 inches he needs to bring up the shed to be the same level of the pool.  There will be no plumbing in the shed.   There is only 15 feet from the corner of the shed to the well .  The requirement is 20ft. from the well to the building footprint which is technically to the edge of the building.  Greg said that both the existing patio and retaining wall are only 4 feet from the well.  

The Board voted that a variance hearing will be necessary because the shed does not meet the well setback requirement.  The Board explained that this needs to go through the variance process as a matter of fairness to the abutters.  The Board explained the variance process to Greg.  He needs to submit a written request to the board meeting for public hearing, notify abutters via certified mail and put a notice in the newspaper.  Greg was concerned that the process will impact his ability to keep his current contractor.  The majority of the Board had agreed that he can proceed at this own risk as long as there is no new information, the building permit does not change and on 5/13/08 he will present the same plan to the Board.  Greg took his permit and plans.

7:15 – 7:30 pm 110 Wattaquadoc – proposed garage for Mike D’Orlando
The Board express concern that there was no well or septic plan with the original building application.  Bill Brookings knows this property and reviewed Mike’s hand drawing and measurements.  The garage is 40 ft from the septic, 87 ft from the well and 36 ft from the abutter.  The Board approved and signed off on the building permit.

7:30 – 7:50 pm 37 Whitcomb Rd – permits to add a bath in basement and build a barn for Tammy Mercier
Tammy gave Bill Brookings the specs on the pump.   Bill needs to know if the pump is a GPM discharge, grinder or no grinder pump.  Tammy needs to have her plumber contact Bill about the pump specs.

Tammy said she is adding a bathroom in the basement for the band room in the basement.  She is building a barn with a bath and an upstairs studio.  She said her parents are moving in and they have lots of stuff, cars and a tractor that needs to be parked inside.  Tammy said that Tom Brunelle of Circle B is building the barn.  Tammy said that they will tie into the water main of the house instead of putting in a redundant system in.

The existing dwelling has:  Library, dining room, family room, kitchen, 4 bedrooms upstairs for a total 9 rooms with band room in basement = 10 rooms total in the existing house.  The proposed one room in the basement and studio in the barn will make a total of 12 rooms.  The Board explained that Tammy will need a deed restriction filed at the registry of deeds.  Tammy doesn’t have a problem with the deed restriction.  The board explained that the deed restriction is a standard form so you don’t have to hire an attorney.  Fill out the Deed Restriction form, have it Notarized then record it at the Worcester Registry of Deeds.

The Board also voted to put an annual inspection in place for the long sewer lines.  Mark explained that long sewer lines requirements requires either an annual homeowner inspection – homeowner fills out and sends in to us or a Title 5 Inspector has to walk the field and certify that.  This was an existing long sewer line before the requirement was in place.  Tammy said that they keep the path clear for the sewer line.

The Board approved the building applications and they were signed by Mark Sprague.  Lisa will be holding the building permit for the bath in the basement until the deed restriction is recorded.   The building permit for the barn is tied to the sewer line requirement.  Once the long sewer line inspection is received the building permit for barn will be released.

SEPTIC PERMITS:

Flatley Upgrade permit~ - fast unit (fixed activated sledge treatment) tank with treatment inside it.  If there needs to be an increased the fast unit can be upgraded. – Board approved and signed the permit.
94 Spectacle Hill Rd – D box permit for Elworthy – Board approved and signed the permit.
Oak Trail Lane – 6 lots reissue expired permits (Lots 18a, 21, 25, 29, 31, 34) – Board approved and signed the permit.
46 Meadow Rd – adding an addition need new septic system for Jafry – Board approved and signed the permit.
Existing 3 bedroom house with addition – John Mechlin doing addition no plans yet – Bill is holding this one until he receives a proposed plan.
Lot 8 Autumn Lane – septic permit for Khani – added conservation line and trail easement on the plan
Board agreed that it is out of the flood plan – Board approved and signed the permit.
Lot 3 Harvard Rd – Septic permit extension granted must get a certificate of compliance by 5/10/09.

INSPECTION REPORTS:

14 Corn Rd – Third party annual subsurface disposal system inspection – Board reviewed and accepted.

ACTION/DISCUSSION:

Review Deed Restriction language – 10 Drumlin Hill Rd for Scott Carpenter  - the board voted to add language to restrict the use as an inlaw apartment.  Mark will send out a draft for the board to accept. The deed restriction needs to be drafted, the board will circulated it and then the Board must accept the revised language.  Homeowners will have to record it before the building permit can be signed.

Bolton Woods Way Title 5 Requirement – Yes, per code at the time of installation of the system. There is a covenant specific to Bolton Woods Way that requires annual pumping.

336 Sugar Rd. permit for barn for Laquidara – he wanted an outbuilding we asked for sketch showing the building in relation to the well and the septic – Bill Brookings said that there was not enough information submitted with the building permit so we should return it to him with a letter stating that.

Manure Complaint – 67 Green Rd. Martha Ashe- Invite the Ag commission Joe Kovacs, Ken Nicewicz, Rob Heidi to the next meeting to discuss it.  They should take a look before they come in.   Their expertise is needed to help resolve the issue.  The Board has not found any nuisance.

C& B Enterprises 235 Long Hill Rd. swine & offal permit renewal – Board approved and signed the permits.
Jobarb Contracting Inc. swine & offal permit renewal – Board approved and signed the permits.
Broomfield Labs – Still River Rd. well easement language – review deed language old permit looking to get signed off -  Mark is taking this ask about it next week.

Lot 24 Oak Trail – water test results – Bill is handling this and is going to get it retested.
