The Board met at the Town Hall at 6:30 p.m.  

BUILDING PERMITS APPROVED:
27 Millbrook Lane – Deck
307 Harvard Road – Sunroom
49 Powder Hill Road – Addition approved subject to a 4 bedroom deed restriction being placed on the property.

SEPTIC PERMITS APPROVED:
Lot 30 Fieldstone – Annual Inspection by Homeowner
Lot 31 Fieldstone
17 Merrinott Lane - Sewerline
188 Vaughn Hill Road - Sewerline
359 Berlin Road – Approved subject to annual inspection of area around sewer line, forced main and leaching facility by Title 5 Inspector; and in accordance with Bolton Board of Health Regulation 12, due to the fact that what is being proposed is a cultec system, there is a requirement for an annual Title 5 Inspection for the first three years.

INSPECTION REPORTS:
170 Long Hill Road - The Board of Health reviewed the inspection report and no failure criteria were noted in the report
282 Harvard Road - The Board of Health reviewed the inspection report and no failure criteria were noted in the report
29 Old Sugar Road - The Title 5 Inspection Report submitted certifies that the subsurface sewage disposal system (SDS) at  29 Old Sugar Road is a “failure”.  According to the provisions of Title 5,  310 CMR 15.000, the SDS shall be “upgraded” within two (2) years  from the date of the inspection or sooner if ordered by the local Board of Health.

93 NASHAWAY ROAD – SHEAFER

Present:  Kevin Hardiman and David Riddle, Abutter

Kevin Hardiman of Ross Associates met with the Board to discuss a septic upgrade at 93 Nashaway Road.  Mr. Hardiman is requesting variances to Regulation 5, distances as follows:

Offset to foundation
Distance to public well (115)
Offset to wetland.

Due to the small area that could support a new system, after discussion, the Board voted to approve the requested variances as presented.

871 MAIN STREET – ERLICH

Ms Erlich met with the Board to discuss the results of her water tests.  Bill Brooks stated that the Board wanted to see the results of the water tests before discussing the possible of applying for a variance.  A review of the water tests showed that all tested items fell within the acceptable range, however, the well tested positive for arsenic.  Correspondence with be sent to Ms. Erlich requiring a deed notification and treatment equipment for arsenic.

Ms. Erlich is requesting a variance, which will be heard on January 9, 2007 at 7:45 pm.

279 LONG HILL ROAD – GLOVER

This hearing is continued until January 9, 2007 at 7:30 pm

AIR QUALITY REPORTS – EMERSON AND FLORENCE SAWYER SCHOOLS

The reports were given to Mark Sprague for review.

94 FOX RUN ROAD – TEMP OCCUPANCY WATER ISSUE

At the time the well was drilled the water was tested and as under the legal limit for arsenic.  At the time of occupancy, the well was retested and, because the legal limit was reduced, the arsenic was no longer in the acceptable range.  Temporary occupancy was requested.  After discussion, the Board voted to allow temporary occupancy with the condition that treatment equipment for arsenic be installed in the property.  The owner has 30 days to install treatment equipment, retest and put a notice in the deed.  Correspondence will be sent.

11 STILL RIVER ROAD – duFOSSE

This is a residence that was included for the first time this year in the annual testing for the capped landfill.  Upon testing, the well showed MBTE present.  MBTE in not naturally occurring and is an additive in gasoline products.  The owner of the property was contacted to do a retest and DEP has been notified.

55 QUAKER LANE – BOB HARDING

Mr. Harding is installing an upgrade to the septic system at 55 Quaker Lane.  Title 5 Regulations limit the amount of fill over a system to three feet (depth of cover)  Mr. Harding would like to have one more foot of fill over one of three lines of the leaching facility.  Chris Rogers stated that he would be in agreement with the additional fill if all three lines were vented.  After discussion, the Board voted to allow the additional fill with the installation of a vent on all three lines which will pass through the wall to the breakout so it is not visible. (Rogers yes, Sprague yes, Gilbert no).

662-664 MAIN STREET – SHARED SYSTEM ESCROW

The owner of 664 Main Street contacted the Board to work out a payment schedule on the back money owed to bring the shared system escrow current.  It was decided that Mr. Hannaway would be permitted to double his monthly payments until the escrow was brought current.  To date, there has been no response from Mr. Pat Carroll.  Follow-up correspondence will be sent.

244-248 HARVARD ROAD

Payment in the amount of $2,126.25 was received from Mr. Black of 244 Harvard Road.  This brings Mr. Black portion current through December, 2006.
